HomeMy WebLinkAbout2.0 BOCC Staff Report 12.19.1988REQUEST: APPLICANT: LOCATION: SITE DATA: WATER: SEWER: ACCESS: EXISTING ZONING: ADJACENT ZONING: BOCC 12/19/88 PROJECT INFORMATION AND STAFF COMMENTS Special Use Permit for a Natural Gas Pipeline and Compressor Station Colorado Gathering Corporation Begins at the compressor in the Southeast Quarter of Section 23, Township 63, Range 94 West, thence Northwesterly through Section 23 across the Denver and Rio Grande railroad and Interstate 70 into the Southeast Quarter of Section 14, thence Northeasterly through the Southwest Quarter of Section 13, continuing Northeasterly through Section 13 and ending in the Northwest Quarter of Section 18, Township 6 South, Range 93 West. Approximate width of right-of-way is 40 feet. Located approximately 3 miles southwest of Rifle off County Rd. 320, I-70, U.S. Highway 6. The site consists of approximately 2.7 miles of pipeline easements and right-of-ways. N/ A N/A Existing and proposed private access off County Rd. 320, I-70 Frontage Rd., and U.S. Highway 6. RELATIONSHIP TO THE COMPREHENSIVE PLAN The pipeline will pass through the following districts as designated on the Comprehensive Plan Management District Map: District C, Rural Areas Minor Environmental Constraints, District D, Rural Areas Moderate Environmental Constraints, and District F, Rural Areas and River Floodplain Areas, Severe Environmental Constraints. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The pipeline is proposed in a rural area characterized by rural residential, open space and transportation uses. It will cross the Colorado River, the DRG&W Railroad right-of-way, and Interstate Highway 70. The nearest residence to the compressor station will be approximately 300 ft. from the facility. • 1 B. Project Description: The applicant proposes to construct approximately 2.7 miles of 4" gas pipeline with a maximum operating pressure of 1440 PSIG. A 500 HP compressor is to be located at the southern end of the pipeline. The applicant proposes to begin construction in January, 1989, with completion anticipated within approximately 6 weeks. The pipeline will transport gas gathered from wells permitted for Bonneville Fuels, Inc., to an existing compressor station and pipeline on the north side of the Colorado River. Colorado Gathering Corporation is a subsidiary of Bonneville Fuels, Inc. III.MAJOR ISSUES AND CONCERNS 1. The applicant has submitted lease agreements with three private property owners allowing for the placement of the pipeline across the property. The applicant has represented that they are negotiating with the remaining private property owner, Questor Pipeline Company, and that they would attempt to have documentation of authorization or agreement from them at the time of the public hearing. 2. The Garfield County Attorney's office has indicated that in order for the application to be considered complete and be heard by the Board of County Commissioners, it must include authorization, in some form, from all private property owners. Section 9.03.01 of the Garfield County Zoning Resolution requires that "all special use permit applications shall be filed by the owner or owners of the subject lot". 3. The applicant has received authorization from the Army Corps of Engineers for the Colorado River crossing. Agreements with the Colorado State Highway Department and the DRG&W Railroad are being completed. 4. The applicant has represented that the pipeline would be designed in accordance with ANSI (American National Standards Institute) and CFR (Code of Federal Regulations) standards. 5. The applicant has applied to the State Department of Health for an Air Pollution Emission Permit for the compressor station. Final approval has not yet been received. 6. King Lloyd, Garfield County Road and Bridge Supervisor, has indicated that a $20,00 restoration bond has been required for the gathering portion of the pipeline. IV. SUGGESTED FINDINGS 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. • • V. RECOMMENDATION APPROVAL, subject to the Board of County Commissioners determination that the application is complete, and the following conditions: 1. All representations of the applicant, either within the application or stated at the public hearing before the Board of County Commissioners, shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 2. The applicant, contractor, and subcontractors shall notify the County Clerk's office and Assessor's office to ensure proper licensing and assessment of equipment and vehicles based in the operation, prior to final approval. 3. The applicant shall comply with all regulations of Garfield County relating to industrial operations in the zone districts in which the pipeline will be located, and shall construct and operate the pipeline and compressor in accordance with all applicable State and Federal Regulations. 4. The applicant shall submit an approved Air Pollution Emission Permit for the compressor station from the Colorado State Department of Health. 5. The applicant shall submit permits or agreements with the DRG&W Railroad, the Colorado State Highway Department, and Questor Pipeline Company, allowing for the pipeline. Restoration shall be addressed by these agreements or separate restoration agreements shall be be submitted. Oft' 41
