PROPOSAL:Zone District Text Amendment to
Section 3.07.03 lJses, special, add
kennels as a special use

DESCRIPTION OF THE PROPOSAL - It is proposed to add to Section 3.07.03
IJses, special, provisions for a "kennel". As a result of the Planning Commission review
of this proposal, the applicant has proposed the following modifications to Section 5.03:
All kennels shall be required to control and abate such sound from
emanating beyond the property boundary aqf may be incompatible with
the surrounding property uses. The means by which noise abatement
may be accomplished shall be determined at the public hearing. The
County shall retain continuing jurisdiction alter approval on the issue of
noise abatement.
All odors will be contained within the kennel and on the property.
That individual sewage disposal system capable of handling all waste for
the kennels shall be installed.
II.MAJOR ISSUES AND CONCERNS
Zoring The applicant's proposal to add "kennel", as a special use in the
Commercial/Limited (CIL) zone district, does not require any additional changes
to the zoning resolution if the recently approved changes to the A/R/RD zone
were kept in place. To make the previous changes, it was ne@ssary to make
some additionat changes to the ZonrtgResolution to better dehne the uses and
to establish some standards for reviewing a special use permit application for a
kennel. The following definition was developed by the Board as a part of the
previous proposed zone district text changes to the fuR/RD zone district:
(l)Kennel: An establishment other than a pet shop or veterinary clinic, in
which more than four (4) dogs or domesticated animals are housed,
groomed, bred, boarded, or trained, with or without fees being charged
for services and no more than two (2) litters of dogs or domesticated
animals are born in any one calendar year.

Standards were added to Section 5.03, establishing the following minimrtm standards:
Kennel
All kennels shall be completely enclosed within a building that prevents
any sounds from emanating beyond the property boundary.
All odors will be contained within the kennel and on the property.
An Individual Sewage Disposal System capable of handling all waste for
the kennel shall be installed.
No outdoor dog runs will be allowed.
At the Planning Commission meeting, the applicant's proposal was intended to deal
with kennels in commercial areas. Staff would suggest that the language in the
applicants proposal be modified to only allow outdoor dog runs in commercially zoned
areas, but under other stipulations than those proposed. Some suggested language
would be:
a. All kennels shall be required to control and abate sound emanating
beyond the property boundary in all agricultural and residential zone
districts. Commercial zone districts willmay allow kennels with outdoor
dog runs provided dogs are only allowed outside during the hours of 8:00
a.m. to 5:00 p.m. and it can be demonstrated that no noise will emanate
beyond the property boundaries to any residential area after those hours.
d. No outdoor dog runs will be allowed, except in commercially zoned areas
and approved with conditions consistent with a. above.
IIr.SUGGESTED FTNDINGS
That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and all
interested parties were heard at the meeting; and
That the proposed text amendment has been presented to the Planning
Commission for their recommendation as required by the Garheld County
Zontng Resolution, as amended; and
That for the above stated and other reasons, the proposed zone district text
amendment is in the best interest of the health, safety, morals, order,
convenience, prosperity and welfare of the citizens of Garheld County.
VL RECOMMENDATION
That the Planning Commission recommended APPROVAL of the proposed zone district text
amendment to add "kennel", to Section 3.07.03, [Jses, special on December 14,1994, subject
to modifying Section 5.03 to allow for outdoor dog runs in the C/L zone district.
