I hereby request to include in the existing Garfield County Zoning Resolution, Paragraph 3.07, Commercial/ Limited, last amendment date September 30, 1985, the following: Uses by right of a 36 hole miniature golf course with bathroom facilities, ticket office, plus clubhouse, for an outside amusement. The amendment change becomes necessary due to the exclusion of outdoor amusement in the current zoning resolution. Respectfully submitted, W. APPLICANT: Reno C. Pretti, Trustee, John Pretti Trust I. PROJECT INFORMATION Section 3.07, Commercial/Limited (C/L) zone district allows "indoor recreation" as a use by right, but does not make any provisions for outdoor recreation facilities. There is a group interested in locating a 36 hole minature golf course in the West Glenwood area. Because a minature golf course does not fall into any category of uses allowed in the C/L zone district, it was suggested that a zoning text amendment would be the appropriate course of action. II. ISSUES AND CONCERNS A. The request for a "36 hole minature golf course with bathroom facilities, ticket office, plus clubhouse, for an outdoor amusement" is more specific than necessary for the zoning resolution. It would be more appropriate to use the following wording "minature golf course and accessory facilities". B. Outdoor recreation facilities is proposed as a use by right subject to conditions in the proposed zone district text amendments. A minature golf course would fall into this category, but the timing for the adoption of new zoning regulations was not consistent with the development plans. III.SUGGESTED FINDINGS 1. That an application for a zone district text amendment was made consistent with the requirements of Section 10.00 of the Garfield County Zoning Resolution of 1978, as amended; 2. That the Board of County Commissioners is authorized by the provisions of Section 30-28-109 through 30-28-116, C.R.S. 1973, as amended to provide for the approval of amendments to the Garfield County Zoning Resolution; 3. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the meeting; 4. That the proposed text amendments are in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. IV. We discussed this amendment at the City department directors meeting and have no staff objections.
