Public Hearing for Zone District
Text Amendment to Section 3.02.02;
Uses, Conditional; to add "Boarding
or Rooming House"
APPLICANT: John M. Traul
I. DESCRIPTION OF THE PROPOSAL
The applicant proposes to add "Boarding or Rooming House" as a
conditional use in the Agricultural/Residential/Rural Density (A/R/RD)
zone district. The proposal would allow for small scale commercial
lodging establishments, including Bed and Breakfasts, subject to
review by the Board of County Commissioners. The Board, under the
conditional use permit review process, may refer the application to
the Planning Commission, require a public hearing, and impose
conditions of approval, but may not formally deny a request.
II. MAJOR ISSUES AND CONCERNS
1. The A/R/RD zone district currently does allow for commercial
lodging in the form of "resorts" and "camper parks", both
requiring Special Use Permits.
2. The Zoning Resolution defines "Boarding or Rooming House" as, "A
residential building, or portion thereof, other than a hotel,
motel, or lodge, which is used both as a residential building and
to provide lodging (with or without meals) for four or more
persons for compensation . . . ". A "hotel, motel, or lodge" is
defined as, "A building providing six or more rooms for the
lodging of members of the public . ". Based on these
definitions, a boarding or rooming house could maintain a maximum
of 5 rooms for rent before being categorized as a hotel or lodge.
3. The new zoning regulations, currently being developed by the
Board of County Commissioners, include Bed and Breakfast and
Boarding House in the Agricultural Zone District as a "use by
right subject to standards". The proposed standards include a 12
guest maximum, limits on kitchen facilities, signs, and
requirements for off-street parking.
4. Existing zoning regulations applicable to Boarding and Rooming
Houses include sign code limitations and off-street parking
requirements of one space per rentable room.
5. Given the potential impacts of the proposed activity, it is
appropriate that each proposal be reviewed on a site specific
basis by the Board of County Commissioners, which is provided for
under the Conditional Use permitting process.

III. SUGGESTED FINDINGS
1. That an application for a zone district text amendment was made
in conformance with the requirements of Section 10.00 of the
Garfield County Zoning Resolution of 1978, as amended.
2. That the Board of County Commissioners is authorized by the
provisions of Section 30-28-109-116, C.R.S. 1973, amended to
provide for the approval of amendments to the Garfield County
Zoning Resolution.
3. That the public hearing before the Board of County Commissioners
was extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at the hearing.
4. That the Garfield County Planning Commission has reviewed the
proposed zone district text amendment and made a recommendation
as required by Section 10.04 of the Garfield County Zoning
Resolution of 1978, as amended.
5. That the proposed text amendment is in the best interest of the
health, safety, morals, convenience, order, prosperity and
welfare of the citizens of Garfield County.
IV. RECOMMENDATIONS
On September 9, 1987, the Garfield County Planning Commission recommended
approval of the following Zone District Text Amendment:
Section 3.02.02; Uses, Conditional
Add: Boarding or Rooming House
The Planning Commission included with their recommendation the informal
suggestion of a maximum of 32 square feet for signs associated with
Boarding or Rooming Houses.
