provlding economical and adequate municlpal services to the Saddleback

Saddleback Metropolitan District and that the Service PIan be submitted for

TO THE BOARD OF COUNTY COMMISSIONERS OF COUNTY OF GARFIELD
AND STATE OF COLORADO:
The Petitioners and Proponents of the proposed
Saddleback Metropolitan District, Garfield County, Colorado
by their attorney, pursuant to the provisions of the "Con-
trol Act", Title 32, Article 1, Part 2 C.R.S., as amended,
respectfully petition the Board of County Commissioners of
the County of Garfie}d, State of Colorado, for a Resolution
of Approval of the Service Plan and certain other Pre-liminary actions relating thereto, for said District.
In support of said Petition, your Petitioners
state:
1. That on the 7th day of December, 1987 there
was filed with the Board of County Commissioners of Garfield
County, a Servj-ce Plan for said purposed District.
I 2. That such Service PIan fuIIy complies with the
I provisions of the "Control Act" as io all of the information
required to be contained therein.
I 3. That Petitioners have also accompanied thea Service PIan with the maximum processing fee required by Iaw
in the amount of $200.00.
WHEREFORE, Petitioners Pray that this Honorable
Board will enter such orders as may be necessary or proPer
preliminary to and in connection with a Resolution of
Approval of the Service Plan of the proposeC District.
It is further respectfully requested that the
Board of County Commissioners convene within ten (10) days
after the date of filing of this service Plan to set a
public hearing on this Service Plan to be conducted not
later than thirty (30) days thereafter.

SECTION I
IITTTRODUCTION
Thls Service Plan (nservice Planr) sets forth a proposal for the fornation
of the Saddleback lletropolltan Dlstrict ("Saddleback lletropolitan Dis-
trlct') vtthin an unlncorporated portion of Garfield County, Colorado.
This introductlon vlll briefly ldentify the scope and purposes of the pro-
posed l{etropolitan Dlstrict as ceIl as certain statutory requirenents for
the approval of the l{etropolitan Dlstrict.
GENEML OVERVIEIT
The Battlement l{esa Planned Unit Developnent (rBattlenent l{esa p.U.D.r) ls
currently belng developed by Battlement Hesa, rnc. 0n Harch lg, Lggz, the
Board of County Comnlssloners of Garfield County approved the organizatlon
of the Battlement Hesa lfater and Sanltation District. It vas the anticipa-
tion of the proponents of the Battlement l{esa Uater and Sanltation District
that the Battlenent llesa P.U.D. vould develop rapldty and provlde houslng
for the oll shale connunity required for development of oll shale by Exxon
Company, U.S.A. Over the past fev years it has become apparent that devel-
oPEent of the Battlement Hesa P.U.D. vitt occur over a longer perlod of
time and that the infrastructure requirements and the method of provislon
thereof need to be adjusted. The infrastructure needed for the Battlement
Hesa P.U.D. vill be constructed in phases in order to localize the costs of
providing such facilities and linit the burdens thereof to the residents
and property ovners specificarry benefiting from such facilities.
The Battlement Hesa lletropolitan District vas organized in 1986-87 as the
eentral service-providing entity for the Battlement Hesa P.U.D. in order to
properly Banage the provision of essential services to the Battlement l{esa
P.U.D.
Ihrring the hearing before the County Conmissioners on the organization of
the Battlenent Hesa lletropolitan District, the proponents of the Battle-

tlenent llesa PttD, the proponents vould petition the County for the organi-
zatlon of addlttonal dlstrlcts vhich vould obtaln servlces fron the Bat-
tlenent l{esa Hetropolltan Dlstrlct. The Saddleback Hetropolltan District
ls the flrst of such dlstrlcts proposed to be organlzed to neet the needs
of contlnulng developnent vith the PUD.
The boundaries of the proposed Saddleback Hetropolitan District are shovn
ln Figure I-1 (p.3), and vll} lnclude five parcels of the P.U.D. It |s
antieipated that upon conpletion of development wlthin the Battlenent l{esa
p.U.D., aII of the then-existing special dlstrlcts (to date the Battlement
Hesa llater and Sanltatlon Dlstrict, the Battlement l{esa l{etropolltan Dts-
trict and the proposed Saddleback Hetropolitan District) vithin the Battle-
ment Hesa P.U.D. nay consolidate into a single district to coordinate long-
term service to the entire development.
The najorlty of the facilities and services necessary to naintain existing
developnent vithin the Battlenent l{esa P.U.D. have been constructed by Bat-
tlement llesa, Inc. It is anticlpated that the Saddleback Hetropolltan Dis-
trlet and Battlement Hesa, Inc. vitl enter an agreement for the acquisition
of vater and vastevater facllitles vithln the Saddleback Hetropolitan Dis-
trict boundaries. It is also antlcipated that the Saddleback lletropolitan
District viIl contract vith the Battlenent Hesa Hetropolitan Dlstrict for
vater and vastevater service and any other services as deemed by the Sad-
dleback Hetropolitan District to be in the Saddteback Hetropolitan Dis-
trict's best lnterest (see Draft Agreementr Exhibit A)'
Consolidation of the ovnership of capital facilities into and the operation
thereof by, the Saddleback l{etropolitan District vill bring the provision
of essentlal services vithin the control of an elected board of directors
vhose actions are governed by Colorado statute as opposed to the current
sltuation vhere the provision of such services is governed by a private
corPorat ion.

STATUTORY REOUIREI{ENTS POR APPROVAL
The Servlce PIan ls subuitted ln accordance vith the requlrenents of Ar-
tlcle 1 of Tltle 32 of the Colorado Revlsed Statutes, as anended (the
iSpeclal District Actn). The maJor purpose of the Servlce Plan ls to pro-
duce satlsfactory evldence that the requlrements for County approval of the
proposed l{etropolltan Dlstrict, as set forth in Sections 32-t-203(2> and
(2.5), C.R.S., as amended, have been net:
(1) There ls sufficient existing and proJected need for or-ganized service in the area to be serviced by the proposedspeelal distrlct;
(2, The exlsting service in the area to be served by theproposed special distrlct ls lnadequate for present and pro-
Jected needs;
(3) The proposed special distrlct is capable of providing
economical and sufficient service to the area vithin its pro-
posed boundaries;
(4) The area to be lncluded in the proposed special districthas, or vi11 have, the financial ability to discharge theproposed indebtedness on a reasonable basis;
(5) Adequate service is not, or wiII not be, available tothe area through the county, other existing municipal orquasi-municipal corporations, includlng existing speclaldistricts, vithin a reasonable time and on a Lompirable
basis;
(6) The faeility and service standards of the proposed
special district are compatible vith the facility and servicestandards of each county vithin vhich the proposed specialdistrict ls to be located and each municipality vhieh is aninterested party under section 32-L-20aQ);
(7) The proposal is in substantial conpliance vith thenaster plan, if any adopted pursuant to section 30-28-105,
C.R. S. ;
(8) The proposal is in compliance vith
county, regional or state long-range vaterplan for the area; and

vlsed Statutes;
(6) A general descriptlon of the estinated cost of acquirlngIand, engineering services, legal services, adninistrativeservices, initial proposed indebtedness and estinated pro-
posed uaximum interest rates and discounts, and other major
expenses related to the organization and initial operation of
the District; and
(7) A description of any arrangement or proposed agreementvith any political subdivision for the perforuance of any

(7) The acquisition, construction, conpletlon, installation
and/or operation and naintenance of street inprovements, ln-
eluding curbs, gutters, culverts, and other drainage faclli-tles, sldevalks, bridges, overpasses, bike paths and pedes-
trian vays, interchanges, nedian islands, pavlng, Ilghtlng,grading, landscaping, irrigation, and parking Iots and struc-tures, together vlth all necessary, lncidental, and appurte-
nant facilities, land and easements, together nith extensionsof and inprovements to said facilities vithin and vithout the
boundaries of the Hetropolitan District;
(8) The acquisition, construction, completion, installationand/or operation and maintenance of television relay andtranslator facilitles, including cable TV, together vith aII
necessary, lncidental and appurtenant facilities, Iand and
easements, and aII necessary extensions of and lnprovenentsto sald facilities vlthln and vlthout the boundaries of the
Hetropolitan District ;
(9) The acquisition, construction, completion, installation
and/or operation and maintenance of a system to transport thepublic by bus, rail, or any other neans of conveyance, or
conbination thereof, or pursuant to contract, including park
and ride facilities and parking lots, structures, and facili-ties; together sith aII necessary, incidental and appurtenantfacilities, land and easements, and all necessary extensionsof and inprovenents to said facilities or systems vithin andvithout the boundaries of the l{etropolitan District; and
(10) The acquisition, construction, conpletion, installation
and/or operation and naintenance of a conplete potable and
nonpotable local vater supply, storage, transnission, and

BOARD POIIERS
The povers of the Saddleback lletropolitan District, as llsted above' vill
be exerclsed by the Board of Directors of the Saddleback Hetropolitan Dis-
trict to the extent necessary to provide the services contenplated ln thls
Service PIan. In addition to the above povers, the Board of Directors of
the Saddleback Hetropolltan District shall have the folloving authority:
(1) To amend the Service PIan as needed, subJect to appli-
cable statutory proceduresl
(2) To forego the financing and construetion of certaln
inprovenents if such improvenents vould be best developed by
another entity;
(3) To provide additional services or exercise additional
authority in order to perform all functions permitted by im-
pllcatlon of the Special District Act; and
(4) To cooperate or contract vith other governmental enti-
ties to provide regional servlces or facilities, and to share
the costs lnvolved.
AII Saddleback Hetropolltan District activities vill be undertaken in ac-
cordance vith and pursuant to the procedures and conditions contained ln
provisions of the Special District Act and other applicable statutes' as
the same may be amended from time to tine.

The Saddleback lletropolitan Dlstrlct is located vlthin the Battlenent Hesa
P.U.D. vhich ls located ln vestern Garfleld County, Colorado Just south of
Interstate 70 and the Colorado Rlver. Battlenent llesa ls approxlmately 40
rniles west of Glenvood Sprlngs and 45 mlles east of Grand Junctlon, CoIo-
rado, as shovn on the vlcinlty nap, Flgure II-1 (p. 10).
The Battlenent l{esa P.U.D., enconpassing approxinately 3,082 acres of land,
began developnent ln 1981 to provlde houslng for an lncreased populatlon
due to the oll shale lndustrles. The development \ras to ultlmately lnclude
about 8r000 dvelling units vith a proJected populatlon of 24,000. The con-
struction of the infrastructure vas based on supporting this population
through phased development of urban support facilities.
As a result of economic conditions and a delay in the development of the
oil shale industry, the existing population of the Battlement Hesa P.U.D.
ls approximately 1r600.

P.U.D. The Battlenent tlesa P.U.D. vater system deslgn and constructlon is
based on the folloving general design crlteria that:
1. Adequate vater supplies, both potable and nonpotabler exist to
support the systen needs.

The vater systen is to be operated and rnaintained to meet aII appropriate
standards of the Anerican lfater lJorks Association and the Colorado Depart-
nent of Eea1th. Service is to be of the highest standards. IJater supply,
treatnent, transmission, and storage facilities to serve the proposed Sad-
dleback Hetropolitan District are ovned, operated, and uraintained by the
Battlenent llesa l{etropolitan District. Saddleback Hetropolitan District
vlll be provided service by the Battlement Hesa l{etropolitan District on a
contractual basis.

Domestic Denands
For nunicipal water facillties, the criteria design flov rate is the daily
quantity requlred durlng a peak day and peak hour. The distrlbutlon piplng
has been deslgned to assure adequate flre protection flovs' Potable vater
storage tanks have been deslgned to provide lnstantaneous peak rates uPon
demand. The vater storage tanks are ovned and operated by Battlement llesa
t{etropoli tan District.
The unlt cater supply figures used herein are based on records of Past
vater use rlthin the Battlenent l{esa P.U.D. and the experlence of other
conmunltles ln vestern colorado. The average per caplta vater use for ln-
house domestic use is estimated to be 130 gallons per capita per day'
The average lavn area for the patio and nodular home areas is 3t500 square
feet per unit. The irrigated area for the tovnhouse/condominiun areas is
estinated to be 750 square feet per unit vhile the apartment area irriga-
tlon is based upon 500 square feet per unit. The irrigated area by parcel
is given in Table III-1. IJith a total irrlgated area of 104'8 acres' the
total annual irrigation requirement is estimated to be 150 l{G (461 AP)
based upon an annual irrigation requirement of 4'4 acre-feet per acre' The
peak day demand to serve the entire Saddleback l{etropolitan District in-
eluding the projected inclusion is estlnated to be 3'4 urillion gallons per
day (l{GD) in 2010 as indicated on Figure III-1 (p' 20)'

ArticlellareessentialtotheProPerinterpretationofthis

Section40-1-103(1)(a),norassuchtermsaredefinedinany
constitutional provitfo'', statute' or law of the State of
cororado, nor as defined in any rure or regnrration of any
entityorPersonassertingjurisdictioninmattersrelating
to this Agreement, or the subject matter hereof'
(b)ItisnottheintentionoftheMetroDistrict
toofferorprovideservicebythisAgreementtomembersof
the general public; rather' it is the Metro Districtrs
intention to offer and provlde service sorery to user which
serviceUsermaymakeavailabletoPersonsofitschoosing
subjecttothetermsandconditionsofthisAgreement.

or attempt, to dedi'cate any of its property to a public use'
ortomakeanyoffertoprovideservicetothepublic,orto
make any rePresentation that it is capable of providing
servicetothepublicatlargewhetherwithinoroutsidethe
Metro District' The Metro District does not desire' and
shalI not be construed as offering' to furnish water or
wastewater service to the public or any i'ndlvidual resident
or proPerty owner within or outside the Property'

available to the Property pursuant to this Agreement' The

heaters,boilers,orotherappliancesresu]-tingfromshutting
water off or for turning water on; damage to real or personal
property due to inadequate or sporadic Pressures not caused
by negligent operation and maintenance of the Water or
wastewater rmprovements; or for doing anything to the systems
owned by the Metro District deemed necessary by the Metro
District, or 1ts employee for proper operation and mainte-
nanceoftheWaterandWastewaterlmprovements.Thelvletro
District shall notify user of the existence of any of the
foregoing conditions but shall have no responslbility for
notificationtoCustomersofanyoftheforegoingconditions.

damage or destruction of the Water and Wastewater

11.02Parties'Insurance.Thepartiesheretoshall
each,duringthetermofthisAgreementoranyrenewalsor
extension hereof, maintain at their respective cost the
followingtlpesofinsurancecoveragewithcompaniesandin
amounts acceptable to both parties' The costs of such
insurance coverage shaII be considered a cost of this

tion to the parties for any and all contractual liability

11.03 Emplovees' Insurance. Each party wiII make
prOvision for Workment s comPensation insurance, SociaI

sation for its own employees performing this Agreement as
required by any law of the state of colorado or the federal
government and will, uPon request, exhibit evidence thereof
to the other PartY.
11.04 Certificates. Vlithin thirty (30) days of a
written request of a party the other party shall furnish to
the other party certificates or memoranda of insurance
showingcompliancewiththeforegoingrequirements.Said
certificates or memoranda of each party shall state that the
policy or policies wiII not be cancelled or altered without
at least thirty (30) days prior written notice to each party'

ARTICLE XII.

objectives. Both parties shalI be free to contract for
similarservicestobeperformedbyorforotherPersons

suchottrercontractsorservicedonotinterferewiththe
timelyattendanceto,andthecompletionof,theobligations
contained in this Agreement, and do not permit cross
connections with, or cause damage to, the water and waste-
water ImProvements.
