Dear Mr . Jarman:
1. That all representations of the Applicant , either within the application or stated at the hearing
before the Board of County Commissioners, shall be considered cond itio ns of approval unless
explicitly altered by the Board .
Response: Oxy will comply with all representati ons and BOCC Conditions of Approval.
2. That the operation of the facility be done in accordance with all applicable Federal , State, and
local regulations governing the operation of this type of facility .

3. That the Applicant shall comply with the fire protection provis ions inc luded in th e rules and
regulations of the Colorado Oil and Gas Conservation Commiss ion (COGCC) and the
International Fire Code as the Code pertains to th e operation of this faci lity.
Response: Oxy wi ll comp ly with the internation al fire code as it pertains to the operati on of th is
facility . COGCC regulations are not app licab le to this facility .
4. Vibration generated : the facility shall be so operated that the ground vibration inherently and
recurrently generated is not perceptible , without instruments, at any point of any boundary line
of the property on which the use is located .
Response: Thi s condition wi th be complied with at all times.
5. Emissions of smoke and particulate matter: the fac ility, diesel generator, related driveway and
parking area shall be so operated so as to comply with all Federal , State and County air quality
laws , regulations and standards, including CDPHE APCC Regulation 1 for dust.
Response: This condi ti on will be complied with at all tim es .
6. Emission of heat, glare, radiation and fumes: the facility, diesel generator, related roadway
and parking area and shall be operated so that it does not emit heat, glare, radiation or fumes
which substantially interfere with the existing use of adjoining prope rty or which con stitutes a
public nuisance or hazard.

7. All equipment and structures associated with this permit shall be painted with non-reflective
paint in neutral colors to reduce glare and mitigate any visual impacts.
Response: All structures are painted with non-reflective neutral colors.
8. Volume of sound generated shall comply with the standards set forth in the COGCC Series
800 Rules and Regulations.
Response: The field office is not regulated by the COGCC. Therefore, COGCC Series 800
rules and regulations regarding the generation of sound is not applicable. However, this use will
comply with noise standards set forth in Series 800 and Colorado Revised Statute at all times.
9. Lighting shall be pointed downward and inward to the property.
Response: This condition will be complied with at all times.
10. To ensure safety to wildlife and domestic animals:
A. Division of Wildlife 'wildlife friendly' fencing shall serve as the guide for any fencing erected
on the site;
Response: Fences are not proposed at this facility. Should a fence be erected at a later date,
wildlife friendly fencing will be utilized.
B. A bear-proof dumpster or waste container shall be provided on the site; and
Response: A bear-proof waste container is provided on-site.
C. No domestic animals, such as dogs, shall accompany employees or subcontractors to the
site.
Response: This condition will be complied with at all times.
11. Prior to the issuance of a Land Use Change Permit, the Applicant shall provide the following
documents to the satisfaction of the Planning Department Project Engineer in the County
Building and Planning Department:
A. An adequate site map and documentation that depicts pre and post development drainage,
and how the drainage plan satisfies section 7-206 of the Unified Land Use Resolution of 2008,
as amended;
Response: The attached site diagram prepared by DR Griffin demonstrates pre a:nd post
construction grading. The site has been designed to not impact the drainage patterns for this
area. The attached Nolte drainage analysis demonstrates the drainage from the field office site
will be accommodated within the capacity limits of Oxy's drainage infrastructure.
B. Drainage calculations that demonstrate that the drainage basins (existing and proposed) are
sized;
Response: On-site drainage basins are not proposed for this project. The field office location
was disturbed prior to the completion of the Nolte Regional Drainage Analysis which
demonstrates Oxy's current drainage infrastructure within the Conn Creek Watershed as
adequate.
C. Adequate drainage plans and spill containment measures for the diesel fuel tank shall be
included as an amendment to the Drainage Plan.
Response: An excerpt from Oxy's SPCC plan demonstrating drainage pathway and distance to
navigable waters and adequacy of spill containment has been included as an attachment to this
letter.
12. The Applicant shall provide a short-term revegetation security in the amount of $7,500
($2,500 per disturbed acre) or another security acceptable to the BOCC to be held by the
County. This revegetation security shall be held by Garfield County until vegetation has been
successfully reestablished according to the Reclamation Standards in the Garfield County Weed
Management Plan. It is the responsibility of the Applicant to contact the County, upon
successful revegetation establishment, to request an inspection for security release
consideration.
Response: A "short-term" revegetation bond in the amount of $7,500 has been submitted to
Garfield County Treasures Office. A copy of this bond is included as an attachment to this letter.
13. Regarding Erosion Control, any straw or hay bales used in erosion control shall be certified
weed free.
Response: This condition will be complied with at all times.
14. Prior to the issuance of a Land Use Change Permit, the Applicant shall provide proof of
proper building permits for the office trailers and permits (if applicable) for Overweight/Oversize
Vehicles as administered by the Garfield County Road & Bridge Department.
Response: A Building Permit was obtained from the Building Department on January 12, 201 O
and is included as an attachment to this letter.
15. Prior to the issuance of a Land Use Change Permit, the Applicant shall be required to drill a
water well. This well shall be drilled and meet the following standards pursuant to Section 7104
(B) of the Unified Land Use Resolution of 2008, as amended:
A. A minimum 24 hour pump test shall be performed on the wells) to be used. The results of the
pump test shall be analyzed and summarized in a report including basic well data (size, depth,
static water level, aquifer, etc.) pumping rate, draw down, recharge and estimated long term
yield. The report shall be prepared by a qualified engineer of ground water hydrologist and
include an opinion that the well will be adequate to supply water for the proposed uses. The
report shall also address the impacts to ground water resources in the area.
Response: A copy of the 24 hour pump test and the pump test analysis for this well are
included as an attachment to this letter.
B. Water use assumptions shall include an average of no less than 3.5 people per dwelling,
using 100 gallons of water per person per day, plus and irrigation and livestock watering uses.
Response: This assumption was used.
C. At a minimum, the water quality of the well shall be tested by an independent testing
laboratory for the basic Colorado Primary Drinking Water Standards for inorganic chemicals
(heavy metals, nitrate, sulfate and asbestos), bacteria and radioactivity. The results should
show that the applicable standards are met or otherwise identify a treatment system to meet the
standards. Testing for the
Secondary Drinking Standards (taste, odor, color, staining, scaling, corrosion, etc.) is
recommended.
Response: The well was tested by an independent laboratory for the basic Colorado Primary
Drinking Water Standards. The water quality analysis indicated an arsenic concentration above
the Maximum Contaminant level (MCI) of 0.010 mg/I. A report prepared by Bradley A. Simons,
P.E. demonstrates that standards can be met by the utilization of various types of treatment
systems. Oxy has installed a Reverse Osmosis Point-of-Entry device.
16. The Office facility shall contain no more than 19 employees. When the ISDS is installed and
operational, the incinerating toilets presently on site shall be removed.
Response: The office facility will not accommodate more than 19 employees. The incineration
toilets are scheduled for removal and have been deactivated.
17. Prior to the issuance of the Land Use Change Permit, the Applicant shall provide the County
with a letter from De Beque Fire Department that concurs with the following requirements:
Response: An email from Fire Chief Nick Marx of the DeBeque Fire Protection District
addressing this GOA is included as an attachment to this letter.
A Fire suppression for the office trailers can be accommodated by the installation of appropriate
hand held extinguishers and augmented by a Fire Department Connection to the existing water
supply of 2,500 to 3,000 gallon storage tank.
Response: An email from Fire Chief Nick Marx of the DeBeque Fire Protection District
addressing this GOA is included as an attachment to this letter.
B. Fire suppression for the proposed stick-built structure will be determined prior to construction
and after a meeting with the Fire Protection District to identify an appropriate fire protection
system which may include C02, Halon, water, or a combination of these. No building permit
application shall be accepted by Garfield County without an appropriate fire protection plan that
has been approved by the DeBeque Fire Protection District.
Response: An email from Fire Chief Nick Marx of the DeBeque Fire Protection District
addressing this GOA is included as an attachment to this letter.
18. No Land Use Change Permit shall be issued until a permitted water well and a permitted
ISDS have been installed and completed prior to nine months beyond the date of BOCC
approval (7/19/10) and proper building permits for the trailers have been issued by January 19,
2010. By this condition, the current six office trailers may continue to be occupied by the
Applicant prior to this date understanding that the Applicant is bound by these terms to provide
the proper permits by dates certain.
Response: Copies of the Division of Water Resources water well permit, ISDS permit/letter of
completion are included as an attachment to this letter. Building Permits were obtained for the
office trailers from the Building Department on January 12, 2010.
19. The Applicant may replace the six office trailers with a stick-built structure and 1 office trailer
at any time in the future so long as the proper building permits have been obtained and that the
office employee count does not exceed 19 employees.
Response: All proper building permits will be obtained prior to the construction of a stick-built
structure. Oxy understands that upon completion of a stick-built structure only one (1) office
trailer may remain on-site.
20. The Applicant shall submit a "long-term" reclamation security in the favor of the Board of
County Commissioners in the amount of $12,316 in order to reclaim and revegetate the office
trailer locations after the office trailers have been removed or until a certificate of occupancy has
been issued for the stick-built office replacing the office trailers.
Response: A "long term" reclamation bond in the amount of $12,360.00 has been submitted to
Garfield County Treasures Office. A copy of this bond is included as an attachment to this letter.
21. The Applicant shall obtain proper building permits for the trailers by January 19, 2010. By
this condition, the current six office trailers may continue to be occupied by the Applicant prior to
this date understanding that the Applicant is bound by these terms to provide the proper permits
by dates certain.
Response: Building permits were obtained for the office trailers on January 12, 2010. Copies
of the building permits are included as an attachment to this letter.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material Injury to existing water rights. The issuance of this permit does not ensure that
no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civfl court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has
been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(I) and the pol!cy of the State Engineer for appropriation of ground water tributary to Colorado
RiVer system.
4) The use of ground water from this well is limited to drinking and sanitary facilities as described in CRS 37-92-602(1)(c), for a commerclal
business. Water from this well shall not be used for lawn or landscape irrigation or for any other purpose outside the business building structure.
5) The pumping rate of th ls well shall not exceed 15 GPM.
6) The annual amount of ground water to be diverted by this well shall not exceed 1/3 acre-foot (108,600 gallons).
7) Approved as the only well on a tract of land of +-40 acres described as Tract B of Tract 83 all in Sec. 5, Twp, 7 South, Rng. 97 West. 6th
P .M., Garfield County, more particularly described on the attached exhibit A.
8) The return flow from the use of this well must be through an indivldual waste water disposal system of the non-evaporative type where the
water is returned to the same stream system in which the well !s located.
9) A totalizing flow meter must be installed on this' well and maintained In good working order. Permanent records of all diversions must be
maintained by the well owner (recorded at least annually} and submitted to the Division Engineer upon request.
1 O) Pursuant to Rule 6.2.3 of the Water Well Construction Rules, the well construction contractor shall submit the as-built well location on work
reports required by Rule 17.3 within 60 days of completion of the well. The measured location must be accurate to 200 feet of the actual
location. The location information must Include either the 1/4, 1/4, Section, Township, Range, and distances from section lines, or a GPS

In accordance with the requirements of Section 7-104(8) of the United Land Use Resolution of
2008, a 24 hour pump test was performed on the new well installed for use at Oxy's facility north
of DeBeque, Colorado located in the SE 14, SW 14 of Section 5, Township 7 south, Range 97
west, Garfield County, Colorado. As required by the Land Change Use Permit application the
following items are addressed in this letter report:
• Well construction data (size, depth, static water level, aquifer)
• Pumping rate
• Drawdown
• Recharge
• Estimated long term yield
• Opinion of adequate water supply
• Impacts to groundwater resources in the area
Well Construction Data: The well casing is initially 7" and then reduced to 5" diameter. The
well is 90 feet in depth with a static water level of approximately 43 feet below ground surface
(waler level measurements of 43.6 on 2/10/1 O and 42.9 on 7/1/10). The well is completed in the
alluvial aquifer which is at least 47 feet thick in this area (Conn Creek Valley).
Pumping rate: The 24-hour pump test was performed by Samuelson Pumping Company at a
pumping rate of 7 gpm. The well pump has a maximum capacity of 15 gpm.
Drawdown: The well was drawn down 6.25 feet and stabilized after approximately 6 hours.

Recharge: The well recovered to within Y, foot of static water level within 3 hours after the
pump was turned off. This indicates that recharge to the well is adequate for recovery after
sustained pumping.
Estimated long term yield: The 24 hour pump test indicates a specific capacity for the well of
1.12 gpm/ft. Based on this information, the well would require approximately 13 feet of
saturation to sustain flow at 15 gpm. The aquifer thickness is more than adequate for the
desired yield.
Opinion of adequate water supply: The water supply at the new well is adequate for the
demand since at no time will there be more than 19 office employees on-site. The site is an
office facility with restrooms and sinks. The well is not intended nor will it be used for laundry,
showers or lawn watering which have higher demands.
Impacts to groundwater resources in the area: There will be little to no impact to existing
water wells in the area since the maximum annual withdrawal will be less than 1/3 acre foot
(108,600 gallons) and the actual use will likely be much less than that. Additionally, there are
no registered wells within a 2 mile radius of the new well.

The water quality analysis for the Cascade Creek Water Well (Well No. 280305), which will be
used as the potable water source for the Oxy USA WTP LP (Oxy) field office, indicates an
arsenic concentration above the Maximum Contaminant Level (MCL) of 0.010 mg/I. Since the
source water is above the MCL for arsenic, it will require treatment to bring the drinking water
arsenic concentration to below the MCL.
For a small system such as this field office, a Point-of-Use (POU) device would be a suitable
option for water treatment. POU devices are designed to treat water at a single tap, most often
at the kitchen sink, bathroom sink or break room area, to provide treated water for drinking and
cooking. Health concerns involving arsenic stem from ingestion of water. Larger Point-of-Entry
(POE) devices are also common for potable water treatment. However, for most small systems
a POU device is capable of reducing most health risks associated with elevated levels of
arsenic.
There are two primary methods of treatment used in the POU systems on the market today;
cartridge based adsorptive media systems and reverse osmosis (RO) treatment systems.
Adsorptive media systems use an iron or aluminum based material specifically designed to
chemically bind with arsenic to remove it from water. These systems typically consist of a media
cartridge that is inserted into a stainless steel or plastic housing. When the capacity for
removing arsenic from solution has been exhausted, the cartridge is replaced. Cartridge life may
range from several weeks to over a year depending upon the quality and amount of water
treated. Examples of this type of system include:

Sample Adsorptive Media Setup
In reverse osmosis (RO) treatment, untreated water flows under pressure past a membrane.
The membrane selectively rejects arsenic and other contaminants and allows treated water to
pass through. Examples of this type of system include:

The initial costs or POU adsorption units range from $150 to over $500. The majority of these
devices cost $200 to $300. Costs of replacement media filters vary from $40 to $500, with the
majority in the $100 to $200 range.
The POU RO units range in cost from $300 to over $1100. The majority of devices cost $300 to
$700. The costs of replacement membrane cartridges vary from $40 to $250, with the majority
in the $100 to $200 price range. Larger POU devices range in cost from $10,000 to $15,000,
depending upon the features selected.
A POU device should be installed on each of the four proposed sinks (men's restroom, women's
restroom, unisex restroom and break area) serving the field office. No showers or sleeping
areas are proposed for the field office.
The waste stream from a POU RO treatment system is generally around 25 percent. However,
any waste water from the POU RO devices will be incidental to the engineered ISDS designed
for a load of 50 employees at 15 gallons per person per day.
Adsorptive media system cartridges only have the replacement cartridge as a waste project.
Accordingly, no waste water will be sent to the engineered ISDS.
