I. APPLICATION SUBMITTAL REQUIREMENTS
As a minimum, specifically respond to all the following items below and attach any additional information to
be submitted with this application:
1. Please submit, in narrative form, the nature and character of the Special Use requested.
Submit plans and supporting information (i.e. letters from responsible agencies). lnclude
specifications for the proposed use including, but not limited to, the hours of operation, the
number and type of vehicles accessing the site on a daily, weekly and/or monthly basis, and
the size and location of any existing and/or proposed structures that will be used in conjunction
with the proposed use, and provisions for electric power service and any other proposed utility
improvements. Be specific.
lf you will be using water or will be treating wastewaier in conjunction with the proposed use,
please detail the amount of water that would be used and the type of wastewater treatment. lf
you will be utilizing well water, please attach a copy of the appropriate well permit and any
other legal water supply information, including a water allotment contract or an approved water
augmentation plan to demonstrate that you have legal and adequate water for the proposed
use.
Submit a site plan /map drawn to scale that portrays the boundaries of the subject property, all
existing and proposed structures on the property, and the County or State roadways within one
(1) mile of your property. lf you are proposing a new or expanded access onto a County or
State roadway, submit a driveway or highway access permit.
4. Submit a vicinity map showing slope / topography of your property, for which a U.S.G.S.
1:24,0OO scale quadrangle map will suffice.
5. Submit a copy of the appropriate portion of a Garfield County Assessor's Map showing all the
subject property and public and private landowners adjacent to your property (which should be
delineated). ln addition, submit a list of all property owners, public and private landowners and
their addresses adjacent to or within 2OO ft. of the site. This information can be obtained from
the Assessor's Office. We will also need the names (if applicable) of all mineral right owners of
the subject property. (That information can be found in your title policy under Exceptions to
Title).
6. Submit a copy of the deed and a legal description of the subject property.
7. lf you are acting as an agent for the property owner, you must attach an acknowledgement
from the property owner that you may act in his/her behalf.
8. Submit an statement that specifically responds to each of the following criteria from Section
5.03 of the Zoning Regulations:
(1) Utilities adequate to provide water and sanitation service based on accepted
engineering standards and approved by the Board of County Commissioners shall either
be in place or shall be constructed in conjunction with the proposed use.
(2) Street improvements adequate to accommodate traffic volume generated by the
proposed use and to provide safe, convenient access to the use shall either be in place or
shall be constructed in conjunction with the proposed use;
(3) Design of the proposed use is organized to minimize impact on and from adjacent
uses of land through installation of screen fences or landscape materials on the periphery

of the lot and by location of intensively utilized areas, access points, lighting and signs in
such a manner as to protect established neighborhood character;
9. Depending on the type of Special Use Permit requested, you may need to respond to
additional review standards in the Garfield County Zoning Resolution Section 5.00
[Supplementary Regulations]. This may include uses such industrial uses [section 5.03.07 &
5,03.081, Accessory Dwelling Units [section 5.03.21], Utility line/Utility Substations, etc. Specific
sections of the Zoning Resolution which can be located on the Garfield County web site at
http://www.garfield-county.com/building and olanninqlindex.htm, or information can be
obtained from this office
10.A $400.00 Base Fee: Applicant shall sign the "Agreement for Payment" form and provide the
fee with the application.
1 1. Submit 2 copies of this completed application form and all the required submittal materials to
the Building and Planning Department. Staff will request additional copies once the Special
Use Permit application has been deemed technically complete.
II. PROCEDURAL REQUIREMENTS
(The following steps outline how the Special Use Permit Application review process works in
Garfield County.)
Submit this completed application form, base fee, and all supplemental information to the
Garfield County Planning Department. lt will be received and given to a Staff Planner who
will review the application for technical completeness.
Once the application is deemed technically complete, the Staff Planner will send you a
letter indicating the application is complete. ln addition, Staff will also send you a "Public
Notice Form(s)" indicating the time and date of your hearing before the Board of County
Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum
regarding your requested Special Use. (lf Staff determines you application to be deficient,
a letter will be sent to you indicating that additional information is needed to deem your
application complete.)
It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the
requested Special Use and the public hearing. lf proper notice has not occurred, the
public hearing will not occur. Notice requirements are as follows:
a. Notice by publication, including the name of the applicant, description of the subject
lot, a description of the proposed special use and nature of the hearing, and the
date, time and place for the hearing shall be given once in a newspaper of general
circulation in that portion of the County in which the subject property is located at
least thirty (30) but not more than sixty (60) days prior to the date of such hearing,
and proof of publication shall be presented at hearing by the applicant.
b. Notice by mail, containing information as described under paragraph (1) above,
shall be mailed to all owners of record as shown in the County Assessor's Office of
lots within two hundred feet (200') of the subject lot and to all owners of mineral
interest in the subject property at least thirty (30) but not more than sixty (60) days
prior to such hearing time by certified return receipt mail, and receipts shall be
presented at the hearing by the applicant.

c. The site shatl be posted such that the notice is clearly and conspicuously visible
from a public right-of-way, wilh notioe signs provided by the Planning Department.
The posting must tako place at least thirty (30) but not more than sixty (60) days
prior to the hearing date and is the sole responsibility of the applioant to post the
notice, and ensure that it remains postod until and during the date of the hearing.
The Appticant is required to appear before the Board of County Commissioners at the time
and date of the public hearing at which time the Board will consider tha request. In eddition,
the Applicant shall provide proof, at the hearing, that proper notice was provided.
Once the Board makes a decision reganding the Spacial Use request, Staff will provide the
Applicant with a signed resolution memorializing the action taken by the Board. Following
the Board's approval, this office will issue the Special Use Permit to the applicant. lf tho
Board's approval includes specific conditions of approval to be met, this office will not issue
the Ofiicial Special Use Permit certificate until the applicant has satisfied all conditions of
approval, The Special Use Permit approval is not finalized until this office has issued the
Officiat Special Use Permit certificate signed by the Chairman of the Board of County
Commissioners.

This special use permit is requested as a condition of sale for the property located
at 0315 Surrey Street, Carbondale, Colorado, and indicated as Tract A on the attached
Floodplain Map. This application is for a special use permit allowing the construction of
a residential dwelling on Track A which is within the flood fringe of the Roaring Fork
River. The proposed building has not yet been designed.
The attached exhibit includes a vicinity map, a floodplain map, and the Garfield
County Assessors Map. The property is principally located in the NW % of Section 36,
T.7S." R.88W, and approximately 1800 ft. north of the main channel of the Roaring Fork
River. The attached Floodplain Map shows the elevation and extent of the 100 Year
Floodplain in the vicinity of the property. The northern most extent of the floodplain is
located along the northern edge of the property. Water surface elevations of the 100 year
flood range from 6204' upstream (east) of the property to 6200' downstream (west) of the
property. The design of the proposed residential dwelling should comply with the
requirements outlined in section 6.09.02 of the Garfield County Zoning Resolution. In
particular, the lowest floor, including basement, of the residential building shall not be
less than one (1) fbot above the maximum water elevation of the 100 Year Flood.
Additionally, the construction should be reasonably safe from flooding, adequately
anchored to prevent flotation. collapse or lateral movement, and constructed with
materials and utility equipment that is resistant to flood damage.
The property is Tract A located within the Elder Amended Plat, which is a
resubdivision of a portion of the Ranch at Roaring Fork IV, and has been approved by
Garfreld County. A copy of the deed is included with this application. The plat titled
"Elder Amended Plat, A Resubdivision of a Portion of Ranch at Roaring Fork IV, Filing
No. Three, County of Garfield, State of Colorado" was recorded with the Gartleld County
Clerk on April 13, 1995 (Reception # 476659). This fully developed subdivision has
adequate utilities and street improvements to accommodate this proposed residential
dwelling.
The attached Garfield County Assessor's Map shows the adjacent properties and

Attached please find our response to your comments regarding the Application for Special Use,
submitted on behalf of Falmouth, lnc., as outlined in your letter dated December 23, 2005. This
application is being submitted as a condition of sale for the property indicated as Tract A of the Elder
Amended Plat, A Resubdivision of Lots 47 lhru 63, Ranch at Roaring Fork lV, Filing No. Three. Future
construction by others on this residential lot must comply with the conditions outlined in this letter and

The following items are taken from the letter dated December 23,2005, addressed to David M. Kotz,
P.E., from Fred A. Jarman, AICP:
l. Submit a copy of the appropriate portion of a Garfield County Assessor's Map showing all the
subject property and public and private landowners adjacent to your propefi (which should be
delineated). We will also need the names (if applicable) of all mineral right owners of the subject
property.
SGM Response: Attached please find the Gafiield County Assessor's Map, titled "Garfield
Co Assesso rs Map," and associated revised list of adjacent property owners. The mineral
rights have not been severed.
2. Please sign the Aqreement to Pay form enclosed with this letter.
SGM Response: Attachedplease find the signed Aqreementto Pav form.
3. Depending on the type of Special Use Permit requested, you may need to respond to additional
review standards in the Garfield County Zoning Resolution Section 5.00 [Supplementary
Regulationsl. This may include uses such industrial uses [section 5.03.07 & 5.03.08], Accessory
Dwelling Units [section 5.03.21], Utility line/Utility Substations, etc. Specific sections of the Zoning
Resolution which can be located on the Garfield County web site at http.//wutw.garfielel:
countJt.comlburldinq_and planning/index.htm, or information can be obtained from this office
More specifically, Section 6.08 of the Zoning Resolution of 1978, as amended provides an
administrative procedure to obtain a floodplain Special Use Permit which requires an Applicant to
address each of the following requirements:
1) Io assure that all necessary permits have been received from those governmental
agencies from which approval is required by Federalor Sfate Law, including Section 404
of the FederalWater Pollution Control Act Amendments of 1972, 33 U.S.C. 1344.
SGM Response: Attached please find a copy of the letter from the Army Corps of Engineers
which authorized the construction of the existing driveway under Nationwide General permit
number 29.
2) To determine whether proposed building sltes will be reasonably safe from flooding, and
that the structure will be in compliance with the applicable provisions for uses and
standards for construction set forth in this Resolution.
SGM Response; Ihe building site is located within the 100 year flood fringe and as such
construction of any building will comply with the provisions outlined in Section 6.09 of the
Zoning Resolution of 1978.
3) To determine if the proposed development is located in the floodway. lf located in the
floodway, assure that encroachment provisions of Section 6.09.01(1) (A) are met.
SGM Response: The proposed development is not located within the floodway. Please see
attached exhibit titled "Floodplain Map."

4) Io assure that adjacent communities, the Colorado Water Conservation Board and
Federal Emergency Management Agency have been notified of the proposed
watercou rse alteration or relocation.
SGM Respo nse: Not applicable for construction in the flood fringe.
5) Io assure that the carrying capacity of the altered/relocated watercourse is maintained.
SGM Response: The impact of the proposed development on the carrying capacity of the
watercourse will be negligible.
The Applicant shall also specifically address the following review criteria for development in the
floodplain pursuant to Section 6.09.02 of the Zoning Resolution:
(1) Prohibited tJses and Activities. The following uses and activities are prohibited in the Flood
F i n g e/F lood P rone Are a s:
A. The development, use, .fi\\, construclion, substantial improvement or
alteration on or above any portion of the Flood Fringe or Flood Prone
Areas which alone, or cumulatively v,ith other activities, would cause or
result in the danger of'substantial solid debris being carried clov,nslream
by floodwaters.
SGM Response: The proposed development will meet the Performance Standards outlined in
Secfion 6.09.02(1) of the Zoning Resolution and as such will not cause or result in the danger of
substantial solid debris being carried downstream by floodwaters.
B. The storage or processing o.f' mctlerittls lhal in times of' ./looding are
buoyant, .flammuble, explosive or otherwise polentially infuriou,s lo
human, animal or plant lifb.
SGM Response: Materials which are buoyant, flammable, explosive or othervvise potentially
injurious to human, animal or plant life will not be stored or processed within the proposed
development.
C. The disposal of garbage or other solidwaste materials.
SGM Response: Garbage or other solid waste material will be drsposed of off site.
D. Any obstruction which would adversely a/fect lhe e-fficiency o.f or reslrict
lhe flou, capaciQ o.f a designated .floodplain :;o as to cause foreseeable
damage lo olhers.
SGM Respo nse: The proposed development will not adversely affect the efficiency of or restrict
the flow capacity of the floodplain and will not cause foreseeable damage to others.

(2) Permissibte tJses. Att Specia/ Uses permitted in the Floodway, and all lavvful uses permifted
by the underlying zoning, subject to Section 6.09.02(1) of this Regulation and the regulations
concerning the Special lJse Permit, are permitted in the Flood Fringe and Flood Prone Areas.
SGM Respo nse: Not Applicable.
(3) Performance Standards. The fottowing performance standards must be met for development
in the Flood Fringe or Flood Prone Areas:
A. The lowest .floor, including basement, of any nev) or substantially
improved building designed .for residential occupancy shall not be less
than one (l).foot above the maximum water elevation of the 100 Year
Flood.
SGM Respo nse: The lowest ftoor, including basement, of the proposed development shall not
be /ess than one (1) foot above the maximum water elevation of the 100 Year Flood.
B. All new conslruction or substantial improvements shall be reasonubly ,safb
.from Jlooding.
SGM Response: The proposed development shall not be less than one (1) foot above the
maximum water elevation of the 100 Year Flood and as such shall be reasonably safe from
flooding.
C. Any new construction or substantial improvement designed for
commercial or industrial uses shall either:
(i) Elevate the lowest ./loor level, including basement, to not less than
one (l).foot above the maximum water surface elevation oJ'the 100
Year Flood; or
(ii) Provide flood-proofing improvements so that below an elevation of
one (l) foot above the maximum water elevation o.f the 100 Year
Flood, the structure, together with attendant utility and sanitary
.facilities, is water tight with walls substantially impermeable to the
passage of water. Structurnl components shall be capable o.f resisting

engineer or architect that the flood proofing meet the standards cts set
forth herein.
SGM Response: The proposed development will not be designed for commercial or industrial
uses.
D. Any proposed development shall be reviewed by the Floodplain
Administralor to insure that the potential .for .flood damage by the 100
Year Flood is minimized, that all public utilities and.facilities are located,
designed and conslructed so as lo minimize damage by the I00 Year Flood
and that adequate drainage is provided to reduce exposure to .flood

hazards.
SGM Respo nse: There is no ptan to construct any public utilities. Future site grading per
applicable building codes will be sufficient.
E. All new construction or substantial improvements shall be designecl and
adequately anchored to prevent.flotation, collapse or lateral movement, be
constructed with materials and utility equipmenl resislant to ./lood
damage, and be constructed by methods thal minimize flood damage.
SGM Respo nse: The proposed devetopment shall be adequately anchored to prevent flotation,
coltapse or lateral movement, be constructed with materials and utility equipment resistant to
flood damage, and be constructed by methods that minimize flood damage.
F. New or replacement waler supply systems and sanitcrry sewage syslems
