Dear Mr. Jarman:
Thank you for discussing with me the contents of the Floodplain Special Use Permit for
the above property, dated February 21,2006 (the "Permit"). The contents of the Permit were
somewhat difficult for me to understand, and your interpretation of certain provisions was both
necessary and greatly appreciated in anticipation of my closing on the property March 9,2006.
As we discussed, the finished floor height referenced in Items 2 and 11 of the Permit
shall be at an elevation of at least 6203 feet. This constitutes one foot above the flood plain floor
(6202 feet elevation). The 100 Year Water Shed elevation of 6202 feet is specified on an
updated plat that is incorporated into the Permit.
As I understand it, building at a minimum of 6203 feet on the lot should also satisfu the
requirements of Item 6 in the Permit. Item 6 states, "All new construction and substantial
improvements of residential structures shall have the lowest floor, including basement, elevated
above the highest adjacent grade ofthe nearest street to or above the depth number specified on
the Flood Maps."
If I have mischaracteized your interpretation of these provisions, please let me know.

Dear Chris,
As you are aware, on Tuesday, February 21,2006, the Board of County Commissioners approved
the request for a Floodplain Special Use Permit with the following conditions:
1. That the testimony provided by the Applicant in the public hearing before the Board of
County Commissioners shall be considered conditions of approval unless specifically
modified by the Board of County Commissioners.
2. The lowest floor, including basement, of any new or substantially improved building
designed for residential occupancy shall not be less than one (l) foot above the maximum
water elevation of the 100 Year Flood at an elevation of 6203.
3. All new constrtrction or substantial improvements shall be reasonably safe from flooding.
4. All new construction or substantial improvements shall be designed and adequately
anchored to prevent flotation, collapse or lateral movemen! be constructed with materials
and utility equipment resistant to flood damage, and be constructed by methods that
minimize flood damage.
5. New or replacement water supply systems md smitry sewage syste,ms shalt be designed so
as to minimize or eliminate infiltration of floodwaters.
6. All new construction and substantial improvements of residential structures shall have the
lowest floor, including basement, elevated above the highest adjacent grade of the nearest
street to or above the depth number specified on the Flood Maps- Any new construction or
substantial improvements of nonresidemtial structures in aeas identified as srbject to sheet
flow shall have the lowest floor, including basement, elevated above the highest adjacent
grade to or above the depth number specified on t}re Flood Maps, or, together with attendant
utility and sanitry facilitiss, be completely flood-proofed to or above th elevation of the
