All representations of the Applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval, including but not limited to: A. Normal business hours of operation: 6:30 a.m. to 5:30 p.m., Monday thru Friday; B. A maximum of 20 vehicle trips per day shall be allowed which shall be limited to all delivery / employee/ work trucks, and residential traffic to and from the site; C. No semi truck deliveries to the property; D. Company truck parking shall be located on the lower bench and adjacent to the struchre; E. No retail or wholesale shall be permitted; and F. A11 storage shall occur inside the subject structure. 2. Any changes to the conditions of approval must be specifically altered by the Board of County Commissioners through the appropriate land use and public hearing process. 3. The Applicant shall comply with all applicable requirements ofthe Garfield County Zortrng Resolution of 1978, as amended. 4. Groundwater resources shall be protected at all times. In the event of potential violations with respect to water pollution, the Applicant shall provide proof of compliance with applicable Federal, State and County laws, regulations and standards. 6. No noise shall be created by work production other than that noise generated from traffic to and from the property. 7. All waste to be stored outside that is considered to be edible or consumable atffacting wildlife shall be housed within a bear-proof garbage receptacle and disposed of accordingly. 8. All tighting associated with the Storage Structure shall be of a design that is motion-sensored and shall be directed inward and downward towards the interior of the property. This office will prepare a resolution for signature memorializing the action taken by the Board in the next few weeks. Once the conditions listed above have been satisfied, this office will prepare a Special Use Permit for signature by the Board and a copy will be sent to you for your files. Fred stated this is a request for a SUP for storage for Scott Fenske located at 0589 County Road 1 i3, Carbondaleapproximately t/z mlle from the Intersection of Highway g2 and cR 1 13 on 1 .67 acres. The applicant also proposes to use the building to store p".ronu1 items such as snowmobiles, bicyclcs,lawnmower, r,ehicles, etc. The lower mouth of Cattle Creek basin, approximately 1 mile up from the intersection of CR 113 and Highway g2 has beenchanging over the years with the beginning of the comme rcially zoned areas at the very base of the intersection with Hwy g2. The properties on the;}eq side of CR 1 13 from Hwy 82 up to tie subject properry are zoned Commercial Limited and havesupported conrmercial uses including Funl-and, Rudd andMorris. The Momis property directly across CRI 13 tiom the subjectproperfy was a legally non-conforming salvage yard, which has existed on the properry since i962. The County recentlyrezoned that property from AARD to CL. The property just east of Morris is owned by Capital Construction, LLC and zoned ARRD. The Board recently approved a SU1,for an office, plumbing material storage and warehouse and associated vehicle parking. The Board approved a SUp for pine Stone Yard n 1992 which allows for the processing, storage and material handiing of*natural resources.During a recent attempt to rezone the subject property as well as the Pine Stone anld Capital Construction properties fromARRD to CL, the Planning commission felt shongly that the existing SUPs fr[ther up ^cattle creek Road served as a regulatedbuffer zone against the ARRD properties located fioth"r up cR 113."Moreover, commercial grow6at the mouth of cattle Crcckshould not extend up cR 113 past what is visibre from the Hwy g2 corridor. j|ra;,fi4' This request today is not only consistent with the approved uses in the surrounding area,and c'onsistent with the planning Commission perspective but is less intensive. Davis Farrar - Fred covered the application as there is an existing building and it's on a bench shieldcd from CR 1 13. Storagc will all be inside. Most trips are in the morning and evening. Mr. Fenske is prepared to put a chain across the containers to keelr the bears out. Fred - other similar types of things were proposed but wanted to make it clear. Davis * storage is generically. Right now to amend a SUP if Mr. Fenske decided to sell to an electrical contractor, the only difference in the storage would be the types of materials. Therefore, the applicant would like to include this in the SUP. Commissioner McCown - other than some testimony the application is for storage, plumbing supplies were alluded to in thc testimony, but Garfield County wouldn't have a problem as long as the storage for anyone purchasing this would be includecl in this building. Commissioner Houpt - historically, does someone come in if there's an ownership change. Fred - when there is a drastic change. Commissioner McCown is correct and the County test would be an initial staff tevir'u', do the new owners comply with the conditions more than just pipe. If it's similar to this, there would not be a problenr. Commissioner Houpt - should we have a condition that will not include heavy equipment, hazardous material, etc.'/ Davis stated that this is in their application. Fred - standardslf.5.08 are mitigating the impacts and so long as they don't conflict with those standards, then that lvoulcl beokay. bp Jan - in the publiUnotice it lists out storage of plumbing supplies. In favor: Houpt - aye; McCown - aye; Martin - aye. q- FROM DATE TO RE MEMORANDUM Board of County Commissioners Building and Planning Departrnent, Fred Jarman December 6,2004 Special Use Permit for o'Storage" I. BACKGROUND The Building and Planning Department received a Special Use Permit (SUP) application for "storage" for a property located on the northeast side of County Road 113 also known as Cattle Creek Road. The property owner is Scott Fenske. More specifically, the application states that the Applicant is in the plumbing business and proposes to use an existing building on the property for storage of plumbing supplies, related tools and equipment (examples include saws, compressors, pipe threading equipment, hand tools and similar items). Plumbing supplies also includes pipe, fittings, hot-water heaters, boilers, heat exchangers, pumps, motors and similar items. The building may also be used for storage of personal items such as snowrnobiles, bicycles, lawnmower, vehicle etc. The proposal specifically excludes "storage of heavy equipment". The County regulations do not define "heavy equipment". Heavy equipment could be defined as earthmoving equipment over a certain size and weight. No retail activity is proposed and vehicle trips to the property would consist of an average of two deliveries a week with no semi-truck deliveries. Hours of operation are from 6:30 AM to 5:30 PM. U. REQUEST Section 9.03.04 of the Zoning Resolution of 1978, as amended requires that Special Use Permit applications be initially brought to the Board so that the Board may determine if a recommendation from the Planning Commission is necessary. III. STAFF RECOMMENDATION Due to the limited nature of potential impacts, the location of the property such that it is situated in an area where the surrounding zoning includes Commercial / Limited and several more intense Special Use Permits including Pine Stone rock yard and the Capitol Construction plumbing business, and that all storage will be contained entirely inside an existing building, Staff recommends the Board direct Staff to schedule a public hearing for the Board and not refer the matter to the Planning Commission.
