WHEREAS, the Board of County Commissioners opened a public hearing on
Monday, January 17'h, 2005 upon the quistion of whether ttre above-described SUP for
Storage should be granted or denied, during which hearing the public and interested
persons were given the opportunity to express their opinions regarding the issuance of
said SUP;and
WHEREAS,.the Board of County Commissioners closed the public hearing on
Monday, January 17th, 2005 to make a final decision; and
WHEREAS, the Board of County Commissioners on
competent evidence produced at the aforementioned bearing,

1' That proper publication, public notice, and posting was provided as required by law
for the hearings before the Board of County Commissioners.
That the public hearing before Board of County Commissioners was extensive and
complete; all pertinent facts, matters and issues were submitted; and that all interested
parties were heard at those hearings.
The proposed special use Permit conforms to Sections z.oz.31(4),3.02.03,5.03,
5-03-07 and 5.03.08 of the Garfield County ZnningResolution of 1978, as amended.
4. The proposed use is in the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garfield County.
Now, THEREFORE, BE m RESOLVED by the Board of county
Commissioners of Garfreld County, Colorado, that based on determination of facts set
forth above, the Special Use Permit request for "storage" is approved with the following
conditions:
1. All representations of the Applicant, either within the application or stated at the
meeting before the Board of County Commissioners, shall be considered conditions
of approval, including but not limited to:
A. Normal business hours of operation: 6:30 a.m. to 5:30 p.m., Monday thru Friday;B. A maximum of 20 vehicle trips per day shall be allowed which shali be limited to
_ all delivery / employee/ work trucks, and residential traffic to and from the sirc;C. No semi truck deliveries to the property;
D. Compariy truck parking shall be located on the lower bench and adjacent to the
structure;
E. No retail or wholesale shall be permitted;andF. All storage shall occur inside the subject structure.

2' Any changes to the conditions of approval must be specifically altered by the Boardof County Commissioners through- the appropriate land use and pubtic hearingprocess.
3' The Applicant shall
-.g1p^ly with all.applicable requirements of the Garfield County
4' The Applicant shall comply with all State and Federal regulations and standards, suchas Noise Abatemenr, Water and Air eualiry.
5' Groundwater resources shall be protected at all times. In the event of potentialviolations with .respect to water pollution, the Applicant shall provide iroof ofcompliance with applicable Federal, State and

laws, regulatilns andstandards.
6' No noise shall be created by work production other than that noise generated fromtraffic to and from the propefty.
7 ' AII waste to be stored outside that is considered to be edible or consumable attractingwildlife shall be housed within a bear-proof garbage receptacle and disposed ofaccordingly.
8' All lighting associated with the storage Structure shall be of a design that is motion-sensored and shall be directed inward and downward towards the interior of theproperty.
