I observed that the illegal exterior circular staircase and second story kitchen had been removed, the interior stairway had been made functional and that the house was apparently not being used as a two family dwelling. Fish Jr. RECE\\I'DA?R?gig$ cc: John Brodee GARFIELD COUNTY Building and Planning Department July 30, 1999 Mr. John Fish Via fax (608) 244-9117 Re: Fish SpeciaUConditional Use Permit Dear Mr. Fish: On July 6, 1999, at a public hearing before the Board of County Commissioners, the Board denied your request for a special use permit to place an accessory dwelling unit and other building improvements in the floodplain. The Board also denied your request for a conditional use permit to place a studio in the floodplain. The application was denied after the Board received testimony about an accessory dwelling unit that was allegedly already in existence and currently occupied. Your representative, Mr. Edward, did not deny the allegations. The Garfield County ZoningResolution of 1978, as amended, only allows the possibility of one (1) accessory dwelling unit on a lot in the A/R/RD zone district. The Board had no testimony or proof that accessory dwelling unit had been removed and thus, had they approved of the request, they may have violated the Garfield County Zoning Code. The Board also heard testimony that a downstream neighbor had concerns that his "house would be in grave danger" if obstructions were built in the floodplain. Section 6.09.02 (D) of the ZoningResolution states as a prohibited use in the floodplain: "Any obstruction which would adversely affect the effciency of or restrict the flow capacity of a designated floodplain so as to cause foreseeable damage to others". Due to testimony given at the public hearing, the Board decided not to approve the application as recommended by staff. The Board was unable to make the finding that the application was in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. The Board was unable to make the finding that the application was in conformance with the Garfield County Zoning Resolution of 1978, as amended. Therefore, the Board denied the requests. After the application was denied, Chairman Martin stated "you need to go ahead and get a transcript of what took place, address those issues, and I believe that you can go ahead and again try to work something out... and resubmit addressing the problems that arose here". Once again, if you are interested,I suggest you re-apply for a speciaUconditional use permit. You will need to submit a completed application, the 5400.00 fee, and any supporting information needed. Public notice requirements must be met. You may want to attend the public hearing in person to provide personal testimony. During our telephone conversation on 7112199 you had requested I hold off on the resolution for awhile. The Commissioners received testimony and a letter from Teresa Faber at the hearing. When Joseph Edward was asked whether renters were occupying an illegal dwelling unit, he was unable to provide testimony to the contrary. Another neighbor had concems about the possible impacts of building in the floodplain and it's possible negative effect on his downstream property. Once a decision is made by the Board of County Commissioners at a noticed public hearing, there is no process for "reopening" the hearing. A resolution will be drawn up and signed by the Board of County Commissioners denying the application. The resolution will be recorded with the Clerk and Recorders office. I will fumish you with copies of the resolution once it is completed. You may obtain a copy of the minutes of the hearing, or a copy of the tape, from Marian Clayton in the Garfield County Clerk & Recorder's offrce (970-945-2377). You are welcome to re-apply for a special/conditional use permit. You will need to submit a completed application, the $400.00 fee, and any supporting information needed. Public notice requirements must be met. I suggest you listen carefully to the tape of the public hearing and include a letter explaining the purpose of the re-submittal.
