Attached is a drawing which shows the Administration Building and its relationship to other facilities on the property. The Administration Building is in the northeast corner of the property. I believe this will take care of all statutory review requirements as per CRS 30-28-110 (2)(A). It is my understanding that you will try to schedule this matter before the Planning Commission at their April 9th meeting. I can bring a full scale drawing of the entire Wastewater Treatment Facility if you feel it is necessary. Please call me at 963-2733 if you have any questions. Part of the Board's recent decision to deny a rezoning application in the County was based on the lack of the required separation of some of the proposed lots and the existing sewage treatment facility. It is still our position that residential structures should not be located within the setbacks required for the placement of sewage treatment works. This issue was not included in the site application reviewed by the Board of County Commissioners and the Board of Health. It is our recommendation that the Town adhere to the requirements of all other site applications. It appears that the future expansion of the treatment facility may not be appropriate in the present location and that a site further down stream may be appropriate. Town of Carbondale Wastewater Treatment Facility Dear Dick and Dwain, d 11it���.„ r ,11 The purpose of this letter is to follow up on our recent meeting on the preliminary design layout of the Carbondale Wastewater Treatment Facility. By way of background the Town received site application approval for the expansion of the Wastewater Treatment Facility in 1996. In 1997 the town has begun the preliminary engineering to locate various processes. The administration building which will be displaced by future processes has been bid and construction will start in April of 1997. Over the last two months SGM has been working closely with Town operation staff to not only locate processes for this phase but also to allow the facility to be expanded in the future. We believe that the growth that is occuring in the Carbondale area will require the need for future expansions. Attached please find enclosed a preliminary layout of the existing Carbondale Wastewater Treatment Facility along with the proposed footprint of certain processes. We believe these footprints represent the most efficient use of this site and is condusive to expandability in the future. Unfortunately ..,me of these buildings fall within the 100 ft. setback line from a row of tragi 's within the Mountain Valley Mobile Home Park, some of which are owned uy the Town of Carbondale. Please note that some of the existing processes including the existing pretreatment building and the secondary clarifier are within the 100 ft. setback line. You will note on the map that six trailers are located within the property boundary of the site and are owned by the Town of Carbondale. The owners of these trailers lease the site from the Town. During the site application process the town met with these Homeowners and outlined the towns expansion plans. The Town currently has a 30 day termination clause for these sites. Without exception all of these owners wish to remain at the present site despite the Wastewater Treatment Plant expansion. Trailer sites are extremely limited in the Roaring Fork Valley. The displacement of these trailers would likely result in a relocation of these owners as far west as the Silt and Rifle area. We believe the plant expansion can occur within the 100 ft. setback distance and NPR -1E 97 13:58 FROM:CDPHE GRAND JUNCTION 1-978-248-7158 TO:919457785 PAGE:03 Page 2 ApHI 7, 1997 Bowman, Watson yet maintain the goals and policies of the Department of Health as well as the Town of Carbondale i.e. water quality, regionalization and protection of public health. Themitigating factors which support this conclusion are as follows: 1. The trailers are situated approximately 30 ft. higher than the proposed WWTP site. 2. All of the proposed basins will be covered. 3. All of the buildings will be positively vented to one discreet location. This location can be on the riverside of the proposed buildings. The air handling systems will be designed to accommodate odor control in the future. 4. We believe that complaints in the past were due to the existence of a Forest Service septage odor vault located within the existing pre-treatment building. In the past the town accepted septage from the Forest Service and treated that waste on site. A second source of odor is from the sludge handling process. currently because there are no sludge thickening or de -watering facilities on site the Town must decant sludge within the aerobic digesters. After the decanting process defused air is reintroduced into the digestor which creates odor. The plant expansion being proposed for this next phase will introduce sludge thickening which will eliminate the need for decanting. 5. The prevailing winds in the vicinity of the Wastewater Treatment Facility are along the river corridor or along the valley floor in an East West direction. If the town were able to expand the treatment facility efficiently and within the 100 ft. setback distance several positive goals can be maintained. Those are as follows: 1. The plant can be expanded for this next phase to accommodate future expansions. 2. The aeration basins can be clustered around the existing buildings leaving the eastern half of the site for future expansion and future processes. 3. If the ammonia background levels within the Roaring Fork River required ammonia removal, adequate space would be available for these processes. 4. Watson inevitable future growth in the Crystal River and Roaring Fork Valleys. 5. The town can maintain badly needed attainable housing. We would appreciate direction from the Colorado Department of Public Health and Environment on the setback issue in particular for this site. To summarize we believe that the goals of the Colorado Department of Public Health and Environment and the Town of Carbondale can be met by expanding the facility in an r;Yient safe manner, yet within the distance of the 100 ft. setback. That letter commented on the Town of Carbondale effort to work with the CDOPHE on locating various processes within the present boundary of the Town's Wastewater Treatment Facility. Specifically your letter addressed the 100 foot setback issue. RECEIVED MAY 15 1997 GARF ELD COUNTY COMMISSIONERS o :s„, Through this letter we hope to begin a dialogue of the issue of the Wastewater Treatment Plant expansion and explain to you the issues involved in locating various processes on site particularly as they pertain to the 100 ft. setback rule. By way of background the Town received site application approval for the expansion of the Wastewater Treatment Facility in 1996. In 1997 the Town has begun the preliminary engineering to locate various processes. The Town had hoped to finalize these decisions so that final design could proceed with plans complete in the June 1997 time frame. This would allow construction to proceed in July of 1997. Substantial foundation and yard piping work could proceed through 1997 so that work could proceed through the winter months without being delayed by cold weather. The administration building which will be displaced by future processes has been bid and construction started in the last week of April. Over the last two months, Schmueser Gordon Meyer, the Town's consulting engineer has been working closely with Town operation staff to not only locate processes for this next phase but to also give consideration to expandability in the future, We believe that the growth that is occurring in the Carbondale area and rural Garfield County may require the need for future expansions. Prudent planning dictates the efficient use of the precious resource of !and available for wastewater treatment. Attached is a drawing which is a culmination of that planning which attempted to layout the footprints to not only meet the next phase of expansion but the long term needs of Carbondale and Rural Garfield County. As you can see on the map, the footprint for the next phase aeration basin is Tess than 100 ft. from adjoining mobile homes within the Mountain Valley Mobile Home Park. Because of this and because of our awareness of the setback policy of the CDOPHE we held a meeting with Town staff, SGM, Mr. Bowman and Mr. Watson of the CDOPHE to discuss these issues. You will note on the map six trailers are located within the property boundaries of the site and are owned by the Town of Carbondale. The owners of these trailers lease the site from the Town. During the site application process the Town met with these homeowners and outlined the Town's expansion plans. The Town currently has a 30 day termination clause for the sites. Without exception all the owners wish to remain at the present site despite the Wastewater Treatment Plant expansion. We believe the Plant expansion can occur within the 100 ft. setback policy and yet maintain the goals and policies of the Department of Health as well as the Town of Carbondale and Garfield County i.e. water quality, regionalization and protection of public health. The State policy is only a policy and suggests that the minimum horizontal distances shall be maintained between habitable structures and newer expanded Wastewater Treatment Facilities unless specific mitigating factors exist. We believe that mitigating factors exist and that measures can be taken to resolve the concern of all parties. The mitigating factors which support this conclusion are as follows: 1. The trailers are situated approximately 30 feet higher than the proposed Wastewater Treatment Plant site. 2. All of the proposed basins will be covered with buildings. 3. All of the buildings will be positively vented to one discreet location. This location can be on the riverside of the proposed buildings which is more than 100 feet away from the mobile homes. The air handling systems will be designed to accommodate odor control in the future. 4. Past complaints were received by the Town for odors but were due to the existence of a Forest Service septage odor vault located within the existing pretreatment building. In the past the Town accepted septage from the Forest Service and treated that waste on site. The Town no longer accepts septage from the Forest Service or any other sources. A second source of odor is from the sludge handling process. Currently because there are no sludge thickening or dewatering facilities on site the Town must decant sludge within the aerobic digestors. After the decanting process diffused air is reintroduced into the digestor which creates odor. The Plant expansion being proposed for this next phase will introduce sludge thickening which will eliminate the need for decanting. 5. The prevailing winds in the vicinity of the Wastewater Treatment Facility are along the river corridor or along the valley floor in an East West direction. In addition to these mitigating factors the Town is proceeding with some long term objectives which impact this issue. The Town has undertaken the process of annexing this segment of Town. Secondly, the Town is currently working with CRMS about the possibility of the school abandoning their Wastewater Treatment Facility percolation ponds and connecting to the Carbondale Wastewater Treatment Facility. May 13, 1997 BOCC Page 3 Expanding the Treatment Facility efficiently and within the 100 -foot setback distance will result in several advantages. Those are as follows: 1. The plant can be expanded for this next phase to accommodate future expansions. 2. The aeration basins can be clustered around the existing buildings leaving the eastern half of the site for future expansion and future processes. 3. If the ammonia background levels within the Roaring Fork River required ammonia removal, adequate space would be available for these processes. 4. By allowing for a larger facility that can be expanded in the future may eliminate the need for smaller packaged treatment plants that will serve the inevitable future growth in the Crystal River and Roaring Fork Valleys. 5. The Town can maintain badly needed attainable housing. We would appreciate your consideration in this matter. We would welcome the opportunity to sit down with you and discuss this in more detail. To summarize, we believe that the goals of the CDOPHE, the Town of Carbondale and Garfield County can be met by expanding the facility in an efficient and safe manner yet within the distance of the 100 -foot setback. The Town has considered through the Master Plan process the relocation of the plant site. A site on the CRMS property near the present CRMS lagoon was considered. The cost of that facility, the necessary interceptors and lift stations necessary were in excess of $7 million and did not include the purchase price of the land. Filter to Waste (Y/N): N ID TREATMENT Objective Process Description 01 N 997 Treatment Applied at Plant INTERGOVERNMENTAL AGREEMENT BETWEEN GARFIELD COUNTY, COLORADO AND TOWN OF CARBONDALE, COLORADO THIS AGREEMENT is entered into this 14th day of April 1997, by and between the BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO (the "County"), and the TOWN OF CARBONDALE, COLORADO (the "Town"), a municipal corporation organized pursuant to C.R.S. §31-2-101, et. seq., both being political subdivisions of the State of Colorado and being collectively referred to herein as the "Parties." WHEREAS, C.R.S. §29-1-203 provides that the Parties may enter into intergovernmental agreements; and WHEREAS, the Town desires to construct improvements for its Wastewater Treatment Facility, and to construct a new administration building; and WHEREAS, said improvements will be located on property located within the County but not within the Town; and WHEREAS, both the Town and County have land use authority and have enacted land use and building codes pursuant to C.R.S. §31-23-101, et seq., and §30-28-101, et seq., respectively. NOW THEREFORE in return for the mutual promises and covenants herein and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by the Parties it is mutually agreed as follows: 1. The Town has complied with all requirements applicable to its planned improvements and the site application for the Wastewater Treatment Facility and all other aspects of statutory review required as per C.R.S. §30-28-110(2)(A) have been fulfilled. 2. All building review inspections required to be obtained for the construction and operation of the improvements to the Wastewater Treatment Facility and the administration building shall be administered by the Town officials as agents for the County Planning and Building Department. Any and all modifications to said structures shall also be the responsibility of the Town. Applications for permits shall be prepared by the Town or construction contractor and submitted to the Town Building Inspector for review and issuance. The Town shall make inspections and the Town Building Inspector shall take final action issuing County building permits. 3. In administering the construction of the improvements, the Town officials shall apply the building codes of the County. However, in the event a Town building code provision would be more restrictive, the Town building code may be applied at the Town's option. CARBONDALE-County-Agreement-1 -1- 4. The Town agrees to be wholly responsible for these facilities as Town facilities and agrees to hold harmless and to indemnify the County for any and all losses that may arise by virtue of this Agreement or resulting from any future operations or inspections of the Wastewater Treatment Facility or Administration Building. 5. In the event of annexation of all of the underlying property to the Town, this Agreement shall be null and void. 6. The laws of the State of Colorado shall govern this Agreement. 7 This Agreement constitutes the entire Agreement between the Parties hereto concerning the subject matter hereof and supersedes all other prior conversations, proposals, negotiations, understandings and agreements whether written or oral all of which are merged herein. 8. This Agreement may not be amended or modified except in written form executed by the parties hereto. The comments submitted previously expressing concern about the lack of separation between the Town's wastewater treatment facilities and some nearby residences are withdrawn by this letter and our previous recommendation of approval is again valid. Based on a presentation by the Town staff and engineer, the Board has concluded that the proposed expansion of the Carbondale Sewage Treatment works has been designed to allow for the future expansion of facility in an economical manner and that potential odor problems have been mitigated. The replacement of existing pretreatment building should also eliminate most of the present complaints about odor. In summary, the Board of County Commissioners and Board of Health, withdraw their previous concerns about the lack of separation between the Town's sewage treatment facilities and the nearby residential uses.
