Please note that one of the Service Plans con- tains the original petition to the County Commissioners which formerly files the Service Plan, accompanied by the $200.00 statutory processing fee. Please see that the original is delivered to the County Clerk for appropriate filing, together with the filing fee. Enclosed herewith are numerous additional documents which you asked me to prepare in draft form for considera- tion for use by the County in processing this matter. In order to assist you in processing the Service Plan, I have enclosed the following: 1. Proposed Resolution of the County Commissioners setting the hearing for January 11, 1988. All blanks will need to be filled in. Please attempt to obtain a 1:00 p.m. or 2:00 p.m. hearing time. 2. Notice of County Commissioners Hearing. The first notice must be published at least twenty days prior to the hearing. I would suggest publication dates of December 16, 23, and 30, 1987. The proponents of the District have determined that in addition to publishing in the Glenwood Post, they would like to publish in the Rifle Telegram. Accordingly, I have enclosed transmittal letters and notices addressed to both newspapers requesting publication on the dates suggested. I have also enclosed all other notices required by law. It is my understanding that Mildred Allsdorf will take care of mailing these notices. All blanks will need to be completed on all of the notices before they are mailed. The statutes require that the postcards be mailed to all electors of the proposed District not more than thirty nor less than twenty days prior to the hearing. Again, I would suggest December 16, 1987 as the mailing date. Please fill in the hearing time on the back of each postcard before they are mailed. 4. Certificates of Mailing. These certificates should be completed and signed by Ms. Allsdorf after she has mailed the notices. They should be returned to me for completion of my file. By copy of this letter, Don DeFord will receive each of the enclosures so he can review them and make any necessary changes prior to their use by Ms. Allsdorf or yourself. I understand the Planning Commission Hearing will be held on December 9th at 7:30 p.m. I would request again that the County Commissioners hearing scheduled for January 11, 1988 be scheduled in the early afternoon to accomodate flight plans if at all possible. A Hearing on the proposed Saddleback Metropolitan District was held by the Board of County Commissioners, pursuant to the provisions of Title 32, Article 1, Part 2, C.R.S., as amended, in accordance with a Resolution adopted and approved by the Board on the 14th day of December 19 87 . Thereupon Commissioner Marian Smith intro- duced and moved the adoption of the following Resolution: • • Bfl 72S Prr,E155 RESOLUTION 88-011 WHEREAS, pursuant to the provisions of Title 32, Article 1, Part 2, C.R.S. as amended, the Board of County Commissioners of Garfield County, Colorado, held a public hearing on the Service Plan of the proposed Saddleback Metropolitan District on the 11th day of January 1988 ; and WHEREAS, Notice of the Hearing was duly published in the Glenwood Post and the Rifle Telegram, newspapers of general circulation within the County, on December 16, December 23, December 30, 1987, as required by law, and Notice was forwarded to the Petitioners and to the governing body of each municipality and special district which has levied an ad valorem tax within the next preceding tax year and which has boundaries within a radius of three miles of the proposed District; and WHEREAS, the Board has considered the Service Plan and all other testimony and evidence presented at the Hearing; and WHEREAS, it appears that the Service Plan should be approved without condition or modification; THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO: Section 1. That the Board of County Commissioners of Garfield County, Colorado, does hereby determine that all of the requirements of Title 32, Article 1, Part 2, C.R.S., as amended, relating to the filing of a Service Plan for the proposed Saddleback Metropolitan District have been fulfilled and that Notice of the Hearing was given in the time and manner required by law. Section 2. That the Board of County Commissioners of Garfield County, Colorado, does hereby find and determine that: (a) There is sufficient existing and projected need for organized service in the area to be served by the proposed District; (b) The existing service in the area to be served by the proposed District is not adequate for present and projected needs; -2- • • (c) Pa^K, 728 ?.1E156 Adequate service is not, and will not be, available to the area through annexation by other existing municipal or quasi- municipal corporations within a reasonable time or on a comparable basis; (d) The proposed special District is capable of providing economic and sufficient service to the area within its proposed boundaries; (e) The area to be included in the proposed District has and will have the financial ability to discharge the proposed indebtedness on a reasonable basis; The facility and service standards of the proposed District are compatible with the facility and service standards of adjacent municipalities and special districts; (f) (g) The proposal is in substantial compliance with a master plan adopted pursuant to section 30-28-108, C.R.S.; and (h) The proposal is in compliance with any duly adopted county, regional, or state long-range water quality management plan for the area. Section 3. That the Service Plan of the proposed Saddleback Metropolitan District is hereby approved without condition or modification. Section 4.
