Clerk of the Board Ed Green , County Manager when the following proceedings, among others were had and done, to-wit: RESOLUTION NO.2OO5- 15 A REsoLUTToN coNCERNr, *rrrffiF A spECrAL usE PERMIT APPLICATION ['OR TIIE EXTRACTION PROCESSING AND MATERIAL HANDLING OF'NATURAL RESOURCES TO ALLOW A TEMPORARY, PORTABLE HOT MIX ASPEALT DATCH PLANT AT TTIE UNA GRAVEL PIT WHEREAS, the Board ofCounty Commissioners of Garfield County, Colorado ("Board"), has received an application from Rodney Powers, Bill Patterson, and Ronald Tipplng, and Grand Junction Pipe and Supply for a special use permit ("SUP') to allow for a temporary, portable hot mix asphalt batch plant at the Una Gravel Pit within the AIR/RD (Agricultural / Residential / Rural Density); and WHERX,AS, the SUP is active in portions of Sections 27,33 and 34 in Township 7 Souttu Range 96 West. 6m PM, south oflnterstate 70 in southwest of the town of Parachute; and WHEREAS, the Board held a public hearing on the 72'h day of April, 2004, upon the question of whether the above described SUP should be granted or denied, at which hearing the pubiic and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has rnade the following determination of fact as listed below: ) )ss ) .'\ ,,.t.q i' .\A LLU H[f 'I U U ItlLl ! t[ !HlllIr,]lJIl lilHu r ;';i-i i-s-.oia D s.oo GARFIELD couNTY c0 1. Proper posting and public notice was provided as required for the meeting before the Board of CountY Commissioners' 2. The meeting before the Board of county commissioners was extensive and complete' that atl pertinent facts, matte., *J irturt were submitted and that all interested parties were heard at that meeting' 3. The above stated and other reasons, the proposed special use permit hasbeen determined to be in the best inte;e; of th" h;ahh, safety, rnorals' convenience' order' prosperity and welfare ofthe citizens ofGarfield County' 4. The application has met the requirements of SpecialUse (Sections 5i03' 5:03:07' 5:03.0g *Je,or; the Garfield-co*ty z,onwResolution of 1978. NOW THEREI'ORE, BE IT RESOLVED by the Board of county commissioners of Garfield County, Cotorudo, that Special Use Permit is irereby approved subject to compliance with all of the following specific conditions: L Additionally, the applicant has obtained (purchased and paid) all yearly (2004) oversiz"/overweight perrnits and permits for the oversize/overweight equipment already hauled to the locaiion. The applicant will need to continually maintainthese permits every Year as a condition of aPProval' 2. The Applicant shall remove all unused materials from the property at the time the crusher is removed as part of the use of the current special use Permit request' 3. Demonstrate that sound levels of noise radiating from a property line at a distance of 25 feet or more there from in excess of the dB(A) established for the following time periods and zones so as not to constitute a public nuisance' 4. A new driveway access shall be constructed that is a minimum of 80-feet wide to allow for trucks to turn in and out ofthe location without damaging the shoulder of the road' 5. At the time of that improvements are made to county Road 300the Applicant shall construct an asphalt mai tire width ofthe driveway extending into the loeation for 20-feet and a depth oi 4-inches attached to the paved edge of the existing road. There is a possibility that CR 300 will be under reconstruction and coordination belween all companies will be needed. 6. The Applicant shall install two (2) signs stating that trucks will b€ turning, to be placed 300-feet north on the west side of CR 300 and 300-feet south on the east side of CR 300. These signs will be installed as required by the MUTCD (The Manual on Uniform Traffic Control Devices). These sigrrs will be the high visibility type and a minimum size of 36- inches by 36-inches. 8. Traffic control will be required during the hauling phase of the operation only when and if traffic control is deemed necessary by the Garfield County Road and Bridge Department. Traffic control will be in the form of certified flaggers and a traffic control plan which shall be required to be sent to the Road and Bridge Department. The traveling public will have the right-oFway over the haul trucks. 9. The Applicant shall make the Road and Bridge Department aware of any complaints or problems that arise concerning CR 300 or any issues that may concern the County. 10.
