Proposed Text Amendments to the unified Land use Resolution of 200g
(z'd tlat| of Batch #7) that addresses uses associated with Electric power
Generation Focilities & when Legal Descriptions should be Required
Background and Purpose
As expected and anticipated, as Staff has been administering the new Unified Land Use
Resolution of 2008 (the New Code), we have identified substantive conflicts, mis-
references, typographical errors, unintended timelines, and unanticipated omissions of
language and regulatory provisions that did not carry over into the New Code from the
Zoning Resolution of 7978, as amended and the Subdivision Regulations of L984, as
amended (together known as the Old Code). ln order to resolve these issues, this
memorandum contains a list of proposed amendments to the New Code to address
these identified issues.
This set of amendments specifically clarify the fairly confusing array of uses related to
"Electric Generation Facilities" and the multitude of associated uses that go along with
that use such as substations, transmission lines, distribution lines, etc. Additionally,
these amendments better define what areas need to be surveyed on site plans.
1. Electrical Substation is in Table 3 - 502. Did we mean to eliminate it from Table 3-
501?
Planning Commission Recommendation
The Planning Commission recommended adding "Electrical Substation" as a Limited
lmpact Review in all zone districts in Table 3-501 and as a use-by-right in public Lands.
Additionally, due to the considerable differences in the definitions and what is listed in
Tables 3-501 and 305-2 as well as the points in the letter from Holy Cross Energy, the
Planning Commission recommends the following:
a. Delete the current definition of "Electric Substation" in Article 16 which currently
states:

b. Replace "Electric Substation" with the following:

transformation or voltage control required for the transmission of electricitv
sixtv-nine (69) kilovolts or greater. (Application review timelines shall follow
Process and review requirements set forth in CRS 29-20-108(2), as amended.)
c. Include this new use in Tables 3-501 and 3-502 as a Limited Impact Review in all
zone districts and as a use-by-right in Public Lands and eliminate the term
"Electric Substation" in Table 3-502.
2. "Utility Lines" and "Utility Substations" are not allowed at all except in the Resource
Lands. The Planning Commission recommended adding the uses to Table 3-501;

Holy cross Energy has been discussing various 2008 unified Land use
Resolution text changes that affect the electric power industry with planning
staff. We understand that staff has recommended several of these changes
and that the changes will be discussed at tonight's Planning commission
meeting.
Please consider Holy Crnss Energy's input contained in this letter when
deliberating electric power related text changes.
In Seotion 3-50lon page 3-33 of the Land use Resolution, please consider
making the following changes to Table: Rual, Residential, commercial and
Industrial Zane Districts :
l. Delete the Use entitled "Major PUC Regulated Electric or Natural Gas
Diltlibution,Facilities". Although the PUC is rnade awale of larye electric
power projects early in the process, actual permitting typically starts at the
local level.
