PERTAIN TO THE UNIFIED LAND USE RESOLUTION OF 2008, AS AMENDED
This Policy is written specifically to address the question of whether Traffic lmpact Fees can
be applied to Divisions of Land in Garfield County as further regulated in Article V of the
Garfield County Unified Land Use Resolution of 2008, as amended (the ULUR) even though
they are not specifically called out in that document.
The short answer:Yes, while not specifically referenced in the ULUR, Resolution 97-tLL
(further refined in Resolution 98-28) still applies and requires fees to be
paid based on cost / per ADT within specific Traffic Study Areas.
ln 7997, the Board of County Commissioners (BOCC) approved Resolution 97-04 (attached as
Exhibit A) which amended the existing Subdivision Regulations of 7984, as amended to add
Section 4:94 and Appendix A, the impact fee work sheet. This resolution recited CRS 30-28-
i-33, as part of its regulations for subdivisions, by establishing minimum standards.
Later that same year, the BOCC approved Resolution 97-717 (attached as Exhibit B) which
referred to the same section of CRS and also recited the adoption of the road impact fee
requirement set out in Resolution 97-O4, and further recites that the BOCC is required to
establish the road cost based on a Capital lmprovement Program to establish a road impact
fee for a subdivision. Resolution 97-111 divided the County into Traffic Study Areas and
imposes the road impact fees based on the road costs and capacity by area. lt includes the
calculation of allthe impactfees as a cost perADT, based on the calculation usingthe formula
adopted in the Subdivision Regulations of 1984, as amended.
Resolution 97-tTl established Traffic Study Areas and determined the cost per ADT, "based
upon the area in which the subdivision is proposed to be located..." per the ** to Exhibit B
(the Traffic Study Area Map) to the resolution. (Note, Resolution 98-28 amended Resolution
97-77L a year later by further refining the area of Battlement Mesa into two Study Areas: l"
and 14 which is attached as Exhibit C.)
The Road Standards in Article Vll of the ULUR dqtnqlude the following sections:
7-307 A.1. Subdivision Access. Access to all subdivisions sholl he from o public street system.
3. Circulotion ond Alignment. The rood system shall provide odequdte and efficient
internol circulation within the development and provide reosonable access to public
highways servicing the development.
6, Congestion and Sofety. The road system shall be designed to minimize rodd
congestion and unsafe conditions.
8. Comprehensive Plons and tntergovernmental Agreements. The road system shall
be in conformance with applicable provisions of the Comprehensive Plan ond
intergovernmental agreements with odioining municipdlities
o. The applicant mav be required to moke necessdrv improvements to the
impocted roods as a condition of plot approval.
The County's Comprehensive Plan of 2000, as amended: Objectives, 3.3 provides:
Proposed developments will be evaluated in terms of the obilitv of Countv roads to
adequatelv hondle the traffic qenerated bv the proposal.
Section 3.6 Policies, stotes:
Development proposals will be required to mitiaate troffic impacts on Countv roods
proportional to the develooment's contribution to those impacts, Mitigotion moy
include, but not be limited to the following:
A, Physicol roodwoy improvements;
B. lntersection improvements;
C. Tronsit amenities;
D. Signage requirements;
E. Alternative traffic flow designs;
F. Funding mechonism to implement necessory mitigation.
Therefore, Resolution 97-711 (amended by Resolution 98-28) remains the specific funding
mechanism to determine the proportional contribution to road improvements for
development. The fact that the ULUR does not presently specifically refer to the impact fees
established by the BOCC via Resolutions 97-04,97-t1,7 and 98-28 does not mean they still do
not apply. Both the ULUR and the Comprehensive Plan require that improvements may be
required to mitigate traffic impacts on County Roads proportional to the development's
contribution to those impacts.

WHEREAS, this Board deems it necessary and advisable to adopt these amendments to the
SuMivision Regulations for the purpose of promoting and protecting the healttr, safety, welfare,
morals and general prosperity of the inhabitants of Garfield County, C,olorado, by establishing
mhimum standards for the desigrr and development of subdivisions, in accordance with the
requirerncnts of Title 30, Article 28, Section 133, C.RS., as amended.
NOW, TIIEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Garfield Courfy, Cobrado, at its nrceting held on the 7th day of January, 1997 , iltait said "SuMivision
Regulatiom of Garfield County, Colorado, of 1984," *rall be arrended by the addition of section 4:94
with the following:
4:94 Oflsite road irnpacts shall be evaluated for suMivisions through completion
of a traffc study identifying the volurne of traffic gererated from the
developnrnt based ou Trip Generation Rate calculations utilizing the most
curtent lnstitute of Traft Engineersr Trip Generation Manuaf to establish an
Average Daily Traffic (ADT)- The road rryact fee shall be established as a
result of entering the applicable data identified in the Road Impact Fee
Calqrrlation Work Sheet located in Appendix A.
Fifty percent (5trlo) ofttre road iryact fees shall be collected at the Final plat
for a subdivisiorl if the affected County road project is scheduled to start
within five years in a Capital Improvements Plan adopted by the Board of
County Commissioners. All ottrer road impact fees will be collected at the
issuance of a building permit
any road irryact ftes coilected'will'iie put into a separate iirterest ileznng
account in the County Treasurels office, for each road that inrpact fees are
collected. All fees collected and interest accrued must be spent on capital
imFroverrents to the specific road for which the fees were collected within
twenty (20) years of the date that the fee is establistred. All capital
eperdih:res must be consistent with the capital inprovements plan used as
a basis for establishing the fee. If after twenty (20) years, the Ges collected
have not been spent in accordance with the capital improvefircnts plan used
to establish the fee, all fees will be returned to the land owner of the property
assessed an impact fee, with interest accrued.
To ttre extent the County has expended funds consistent with a capital
inprrovermrts plan for a particuJar road and a property owner has not paid a
road irrpact fee as required for a building permit which establishes additional
ADT, th€ impact fee shall be colhcted at the tirre a building permit is issued
to recoup the expenditures. Any fees collected after the completion of an
identified road project, will be credited to the appropriate project and will be
used to reimburse the Courty for the funds advanced to complete the project.

The County may use road inpact fees for a specific road improvanent
idertified as a criti:al frcility with a high priority for heallh and safety rernons
in a Capital Improvements PIan adopted by the Board of County
Conrnissicners, in adrarre ofthe completion of the entire road irnproverrent
project. Any such use of funds must be consistent with the basis for tlre
impact fee. It after the use of road impact fees for a critical facility road
irryroverrent, the County fails to complete the entire project identified in the
capital irprovenrents plan within tlrc twenty (20) year period of collection, the
proportionate share, with interest, will be returned to the owner of the
property subject to the impact fee based on the actual annunt of the
expeditures made on a particular road system.
As a part of the Capital Improvements Plan, the Board rnay determine that
certainportions of the road improvements to a road are critical to complete,
before there are any additional traffic generating rues added to the road. If a
development is proposed before the County has scheduled to make tle
necessary improvernents identified in the Capital knprovenrents Plan, the
developer rnay be allowed to pay the total cost of the needed irryrovernents
prior to the C,oudy's schedule. Tlre C,ounty will reimburse the portion of the
cost tlal exceeds tlrc amount that would be applicable for road irryact fees,
plus ifrercst, by the tirne that the project had originally been scheduled to be
coryleted.
Ifthe Board ofCounty Commissioners have not established a base road cost
per ADT for the area in questiorq the applicant will not be obligated to
provide an analysis of the off-site road impacts.

Note the narp of the project or fee payer on lirc I as well as the type of land use.
Euter the road cost at the point of service on line 2. Tlre road cost will be based
on a Capital Iryroveurents Plan adoptd by the Board of County Cornrnissioners.
Enter the road capacity (expressed in Average Daily Trips [ADTI) at the point of
service. Thrs may be determined by the Special Report 209, Highway Capacity
Monual ( I 994, Transportation Research Board).
Calculate the base road cost per ADT at the point of service by dividing Line 2 by
Lire 3. Enter tlrc result on Line 4.

mentioned Capital Improvements Plan addressing the Road and Bridge lnfrastructure to establish

WIIEREAS, the Board deems it necessary to divide the County into districts for tLre purpose
of establishing cost of road improvements for an area and to establish a road impact fee firr the area;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commir;sioners of
Garfield Cot[rty, Colorado, at its meeting held on the 9th day of December. 1997, that the Cormty
will be divided into traffic study areas shown on the attached Exhibit A;
NOW, THEREFORE, BE IT FURTIIER RESOLVED by the Board that the afon,mentioned
traffic study areas shall have road impact fees based on the road costs and road capacity by area
identified on the attached Exhibit B and that the traffic study areas, road costs and road capacity may

RESOLUTION CONCERNED WT[I{ TIIE AMENDING TIM ADOMON OF A PORTION OF
TIIE GARFIELD COTINTY CAPMAL IMPROVEMENTS PROGRAM ESTABLISHJNG ROAD
IMPACT DISTRICTS AND T}IE ASSOCIATED COST OF ROAD IMPROVEMEI'.ITS.
WHEREAS, Title 30, Article 28, Section 133, C.R.S., as.meadcd" provides forlhe approval
of all subdivision plans and plats, and the adoption of regulations goveming such plans :rnd plats by
the Board of County Commissioners for the unincorporated areas of Garfield Cormty, Colorado;
$HEREAS, by Resolution No. 97-04, adopted a road impact fee requlement for
suMivisions and a formula for the calculation of road impact fees;
WHEREAS, the Board is required to establish a road cost based oo a Capital Improvements
Plan adopted by the Board, to establish a road impact fee for a suMivision;
WHEREAS, the Board has held public meetings to corcider the adoption of a Capital
Improvements Program , which for the purposes of this resolution shall be known as ilre Garfield
County Capital lmprovements Plan;
WHEREAS, the Board did establish a road impact fees for arcas of the Couoty, identified
in Resolution No. 97-l I l;

WHEREAS, &e Board bas determined that it is appropriate to ameod said resolution to
redefine the impact fee areas.
NOW, THEREFORE, BE m RESOLYED by the Board of County Commissrioners of
Garfietd County, Colorado, at its meeting held ou the 18th &y of May, 1998, that the County will
be amended to divide the County into the traffic shrdy areas shown ou the attached Exhibit A;
NOW, THEREFORE, BE IT zuRTmR RESOLVED by the Board that the aforernentioned
amended traffic study op65 shell have road impact fecs based on the road costs and roarl capacity
by area identified on the attached Exhibit B and that the Uaffic study areas, road costs and road

is proposed to be locate{ i.e. , if you live in Area 8c, the cost/ADT is the srrrn of 8a + 8b + 8c or
$31+S104+568: $203/ADT. Each arca cost/ADT is based on a calculation using the formula
adopted as a part of the Subdivision Regulations to establish Road Irnpact fees. Also for the
purposes ofthe calculation, Areas 8a and 8b are included in all calculatioos since they are areas
conrmon to the City and Courty related to Midland Avenue and a bridge crossing to Highway
