County of Garfield At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held at the Court House in Glenwood Sprin s on Mon day the 12th day of July A. D. 19 2 , there were present: F l aven Cerise , Commissioner Chairman Eugene Drinkhouse Commissioner Larry Velasquez , Commissioner Earl Rhodes , County Attorney Leanne Cleland, Deputy , Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 82-155 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY ALBERT FREI AND SONS, INC. WHEREAS, the Board of County Commissioners of Garfield County has received an application from Albert Frei and Sons, Inc. for a special use permit for processing of natural resources, specifically, an asphalt batch plant on the following described tract of land: A tract or parcel of land No. 4-R of the State Department of Highways, Division of Highways, State of Colorado, Project No. I 70-1(12)89 Section 1, containing 6.56 acres, more or less, in Lot 2 of Section 11, Township 6 South, Range 92 West of the Sixth Principal Meridian, in Garfield County, Colorado, said tract or parcel being more particularly described as follows: Beginning at a point on the east line of Lot 2, Section 11, T6S, R92W of the 6th Principal Meridian, from which point the NE corner of Section 11 bears N.41°06'E. a distance of 1,985.2 feet; 1. Thence S.00°30'E., along the east line of Lot 2, a distance of 500 feet to the center of the Colorado River; 2. Thence N.70°00'W., along the center of the Colorado River, a distance of 821.6 feet; 3. Thence S.81°12'W., continuing along the center of the Colorado River, a distance of 553.3 feet to the west line of Lot 2; 4. Thence N.00°31'30"W., along the west line of Lot 2 of Section 11, a distance of 100.0 feet; 5. Thence N.81°12'E. a distance of 1,331.1 feet, more ordess to the point of beginning. The above described parcel contains 6.56 acres, more or less. WHEREAS, pursuant to required public notice, the Board conducted a public hearing on the 6th day of July, 1982, upon the question of whether the above described special use permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said special use permit; and WHEREAS, the Board on the basis of the evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. The proposed use is compatible with the uses existing and permitted in the district in which it is to be located, provided that certain hereinafter contained conditions be complied with. 2. That neither the impact on traffic volume and safety or on utilities, or any other impact of the special use will be injurious to the established neighborhood or zone district in which the special use is to be located. NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield County, Colorado, that a special use permit be and hereby is authorized permitting the use of the above described tract of land for processing of natural resources, specifically, an asphalt batch plant upon the following specific conditions: 4 • • 1. That the use of the tract of land comply with all present regulations of Garfield County relating to an asphalt batch plant in the zone district in which the property is now located: 2. All proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board; 3. The request for operation of the batch plant on the south side of the river shall be denied. The batch plant shall be located only on the north side of the river for 15 working days, to be removed within one month of the issuance of the special use permit; 4. The hours of operation of the plant shall be restricted to 7:00 a.m. to 5:30 p.m., 5 days per week; 5. The applicant shall submit a copy of the State Highway access permit to the Planning Department prior to issuance of the Special Use Permit; 6. The site of the plant shall be reclaimed to an acceptable condition upon termination of this Special Use Permit; 7. All existing operations shall be brought into compliance with the conditions of the previous Special Use Permit, issued in October, 1981.
