SI'I'f, DATA: A parcel of approximately 110 acres WATER: Existing adjudicated water rights SEWER: Chemical Toilets / ISDS EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD, Ranch at Roaring Fork P/D, O/S RELATIONSHIP TO THE COMPREHENSIVE PLAN The subject property is located in the Resource Extraction District of the Garfield County Comprehensive Plan, Study Area I. 11 DESCRIPTION OF PROPOSAI. A. Site Description: The site, known as "The Blue Gravel Pit", has been operating under a Special Use Permit (81-384) since 1981. The pit is located in the southeaster portion of a working ranch operation. A vicinity map is attached onpage • s B. Requested Amendment: Resolution 81-384 (attached on pages i* ) included condition (#6), which restricted access to the pit via County Road 103 and 104. The applicants are requesting the addition of a permanent access directly to State Highway 82, in addition to the existing access onto County Roads 103 and 104. The new access road presently serves the ranch, but it will be improved to a two lane road with hard surfaced eleven (11) foot wide travel lanes. The State has approved an access permit for the road (see pgs. $31. Subsequent to the development of the plans, the applicants modified the Highway Access permit to include accel and decel lanes for both east and west bound traffic. ( See permit pgs./. ; A schematic showing the location and • profile of the access road and the proposed improvements to Highway 82 was also included in the application. In 1993, by Resolution No. 93-051 the County approved the temporary use of this access by the applicant to fulfill a contract with the Department of Transportation. Access to the SH 82 site using the proposed route was from June 1st, 1993 to November 1, 1993. A subsequent application to make the access permanent was withdrawn after the Planning Commission recommended denial due to a lack of specificity regarding the intersection with Highway 82 and the proposed access road improvements. M. MAJOR ISSUES AND CONCERNS 1. Impact Statement: Section 5.03.07 requires the submittal of an impact statement for all industrial uses within the County that require a Conditional or Special Use Permit. Section 5.03.07 requires the following: 1. The impact statement must show that the use shall be designed and operated in compliance with all applicable laws and regulations of the County, State and Federal governments, and will not have an adverse effect on: A.) Existing lawful use of water through depletion or pollution of surface runoff, stream flow or ground water; B.) Use of adjacent land through generation of vapor, dust, smoke, noise, glare or vibration, or other emanations; C.) Wildlife and domestic animals through creation of hazardous attractions, alteration of existing vegetation, blockade of migration routes, use patterns or other disruptions; 2. Truck and automobile traffic to and from such uses shall not create hazards or nuisances to areas elsewhere in the County; 3. Sufficient distances shall separate such use from abutting property which might otherwise be damaged by operations of the proposed uses; A copy of the impact study submitted with the application is attached on pages 2. Impacts on Aithictntt a,,s1: The impacts to adjacent lands by the amendment to the haul route are two -fold: the impact of removing traffic from the current CR 103/104 route; and the impact associated with the new haul route. Staff has noted during previous hearings on this project, that the current route creates an incompatible traffic mix between industrial, residential and school bus traffic on County Roads 103 and 104. Additionally, the physical composition of the road is not set up to handle the amount of heavy truck traffic, which has resulted in the need for some fairly significant road construction needs. The limited right- of-way width on the 103/104 route has been a problem for the County since the original permit was approved. The direct route proposed in the amendment will 2- reduce the amount of truck traffic on the existing County roads, resulting in a significant reduction in the truck and automobile conflicts and road damage. Residents from the Ranch at Roaring Fork are the most directly impacted adjacent property owners due to the potential for additional noise and potential conflicts with merging traffic. The applicants have proposed to mitigate the some of the noise impacts by widening and paving the road. Also included in the application is an analysis of the existing sound levels and an experts opinion that the noise impacts will be very minimal (See report in application) Additionally, the sound consultant has noted the nonuse of jake breaks coming into the Highway 82 access point and down the hill, except in an emergency, will eliminate the major so urce of noise. The use of this access for a temporary access by the applicant provided an opportunity to assess the long-term impacts of this access alternative. There were no complaints received by the County as a result of this use, which was very heavy. The homeowners have testified that they did not complain, because they understood that the access was needed for a one time project. An additional issue that came from the previous meeting on this issue is the arrival of trucks before the pit opens. The idling of diesel trucks can result in some unacceptable smell going off of the property. No trucks should be allowed to arrive any earlier than the opening of the pit and sit idling on the deceleration lane on the highway or the access road from the highway. 3. Traffic Impacts: At the Planning Commission meeting in February of 1995, the lack of detail regarding the Highway 82 intersection improvements for accel and decel lanes for the west bound lanes, that are not in place at this time. Included in the application are engineered improvements for the accel and decel lanes approved by the State Department of Transportation. The last application did not have any specifics on the Highway 82 improvements, which resulted in a number of questions that the Planning Commission felt were not answered in sufficient detail. The applicant has provided revised plans to staff for the additional accel lane for the eastbound traffic, which will be presented at the meeting. The removal of the majority of the truck traffic from CR 103 and 104, will also help to reduce the conflicts at the Highway 82 and CR 103 intersection due to combined acceleration and decel lane adjacent to Roaring Fork Sand and Gravel pit. The new construction will create accel and decel lanes in the directions not presently available, reducing the potential conflicts created by slowly accelerating or decelerating trucks. At a previous meeting on this issue, there was concern that the improved road would result in a number of people using the new access as a "shortcut". Staff suggests that access to the 103/104 access be gated during nonworking hours (7 a.m. to 5 p.m., daily). It is further suggested that the hauling hours be limited to 7 a.m. to 5 p.m. Monday thru Saturday, with no hauling allowed on Sunday. Road ��nd Brid4P The County Road and Bridge —�1�ar1171 n t innlmPnt<• Supervisor submitted a letter supporting the proposed new access to Highway 82, based on the potential for reducing the amount of heavy truck traffic on the OOP • 103/104 route and to need for a more immediate rebuilding of the roadways. (See letter pgs. 201141 IV_ SUGGESTED FINDINGS 1. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the hearing. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 3. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V_ REC)►MMEN DATION On April 10, 1996, the Planning Commission recommended APPROVAL by a 5-2 vote of the amendment based on the following condition: 1. That all verbal and written representations made by the applicants in the application and at the public hearing shall be considered conditions of approval unless specified otherwise by the Board of County Commissioners. 2. Jake brakes will not be used, except in an emergency. 3. Hauling hours for the Highway 82 access will be Limited to 7 a.m. to 5 p.m., Monday thru Saturday, and the access to County Road 104 will be gated before and after those hours. Additionally, no trucks will be allowed to stand idle on the highway or access road prior to the opening of the gate to the pit. 4. All other conditions ofapproval contained in Resolution 81-384 must becomplied with by the applicant. Violation of these conditions could result m revocation of the existing SUP. 5. That the application be subject to an annual review, with public notice as required by the regulations in place at the time of the review, to determine compliance with the conditions of approval. Without the Special Use Permit, Western Slope Aggregates, Inc., would not even be in business today. The stipulations attached to the Special Use Permit were very specific and based on conditions which were agreed to at that time by all parties involved. So now Western Slope Aggregates feels one of the stipulations to be an economic benefit if it can be eliminated, specifically, access to Highway 82 across from the Ranch at Roaring Fork. But nothing has really changed concerning the reasons behind the stipulation except Highway 82 is now a four -lane highway. With high speed traffic, it could pose an even greater safety hazard than when the stipulation was agreed to, even with the addition of the acceleration and deceleration lanes proposed to be paid for by Western Slope Aggregates. I was at the County Planning Commission Hearing on April 10, 1996. The application for removing the stipulation of access at Highway 82 across from the Ranch at Roaring Fork was represented by the Owner of Western Slope Aggregates, one of his employees, and a person who had made a simple traffic study for Western Slope Aggregates. The Owner of the property who leases it to Western Slope Aggregates was the only supporter of the application, but there were many in opposition to it. It was clearly a pre -determined vote to support the application without regard to what was said at the hearing. I can say that based on many of the answers which were marginal responses to objections, plus some questions were by-passed and never answered. Also, the motion as made changed the hauling hours which had never been discussed at this hearing and which were contrary to the hours shown in the staff recommendations on this request. 1830 West University Drive, Suite 110 • Tempe, Arizona 85281 • (602) 967-8199 FAX (602) 967-8671 • Az. No.'s B-01 071518 A-11 071517 . • Board of County Commissioners May 14, 1996 Page 2 Two of the reasons for removing the access stipulation to Highway 82 across from the Ranch at Roaring Fork were because of excessive costs for the County to repair Highway 103, and exposure of children waiting for school buses to danger from sand and gravel trucks. On the point of cost on repairing the County Road, I checked it out and except for a few pot holes, it was in pretty good shape. The County Planning Commission was concerned about its condition, yet Western Slope Aggregates would have to commit substantially more dollars to add acceleration and deceleration lanes at the requested point of access to Highway 82 per the application than it would cost to improve County Road 103. The sand and gravel trucks will still be using the 103 exit on hauls toward Glenwood Springs, as well as for their trucks which will arrive in the early morning hours before the hauling hour of 7:00 A.M. So the problem with the County road still exists, but it does not seem to be of concern to the County Planning Commission with Western Slope Aggregates' continued use of the road. The point of the safety for the children with the new access to Highway 82 was a smoke screen and not a true reason to support this application because sand and gravel trucks will continue to use 103. Slow-moving and heavy sand and gravel trucks present a hazard to moving traffic at any speed, much less high speed. They also have a hard time slowing down in emergencies. The attached article is a recent one on the above points. I might add, this is only one of many such accidents that have happened this year in our area, and in cities all over the country. Where safety was a concern with the original stipulation limiting Highway 82 access in 1978, it is even more so today. And contrary to your non -lawyer representative who attended the planning commission meeting, I think the County would have a liability in creating an unsafe condition, even though the Colorado Department of Transportation would have to give final approval on this point of highway access. The Planning Commission said that an application had been approved by CDOT for this new access road to Highway 82 for sand and gravel trucks. But I have to doubt this. Also, the County Planning Commission has no position on creating access to a state highway. CDOT should have been represented at the Planning Commission Hearing. The reason given for not attending was "they were too busy to attend", which again I have to disbelieve based on the lack of credibility of things I heard at the hearing quoting others who were not in attendance. A big point which was brought up by Caloia on behalf of the Ranch at Roaring Fork Owners was that the application did not even meet the minimum standards for a Special Use Permit consideration. This was never answered at the hearing. • • Board of County Commissioners May 14, 1996 Page 3 In closing, I would just like to repeat that a "Special Use Permit" is an agreement which has been approved by all of the legal property owners in the area of jurisdiction. Without this approval, the Special Use Permit for the sand and gravel operation would never have been granted in the first place. So for the Planning Commission to even consider a unilateral, one applicant request against all of the opposition is beyond its authority to change the Use Permit as approved. It also goes without saying that the County has no jurisdiction to create an access road to a State highway. But in this case, the application should have been set aside by the Planning Commission as being beyond their authority for revising an existing Special Use Permit strictly for the benefit of the sand and gravel operation in question. The real solution for the sand and gravel truck highway access is not to set up a second sand and gravel truck access to Highway 82, but it is to provide the two sand and gravel operations a common entrance at 103 onto Highway 82 with a stop light. This could be more easily accomplished over what has been proposed, and at a significantly lower total over-all cost for the proposal as submitted to the County Planning Commission. I look forward to hearing from your office as to whether in fact the recommendation by the County Planning Commission was in order to even recommend a revision for an existing Special Use Permit which was not supported by all of the parties to the original agreement for its issuance. I would also like to think that the County Planning Commission would work a little more closely with CDOT on such situations where CDOT is really the primary area of responsibility for such an application - even if it were in order, as well as having the support of all of the parties who agreed to the original "Special Use Permit"?
