Commissioner Chairman Larrv McCown , Commissioner Trdsi Hount , Commissioner Don DeFor4 , County AttomeY Mildred Alsdorf Clerk of the Board County Manager ) )ss ) Ed Green when the following proceedings, among others were had and done, to-wit: RESOLUTION NO. 2oo4-sz CONCERNED WITH THE SPECIAL USE PERMIT TO ALLOW THE APPLICANT, TODD GRESSETT, TO CONVERT A SINGLE FAMILY DWELLING UNIT INTO A TWO FAMILY DWELLING UNIT WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received an application from Todd Gressett for a Special Use Permit which would allow the conversiirn of a single family dwelling unit to a two family dwelling unit at a 2.004 acre site located east of the Town of Carbondale at Lot 56, Cerise Ranch Subdivision, Phase I, to Garfield County, also in the NW% of the NE% of Section 32, Township 7 S, Range 87 W., West of the Sixth Principal Meridian in Garfield County, Colorado. WHEREAS, the Special Use Permit request for a "Two Family Dwelling Unit" specifically will allow a portion of an existing single family dwelling unit to be modified, used and observed as a two family dwelling unit. WHEREAS, the subject property is located in the Agricultural./Residential/Rural Density (A/R/RD) zone district which conteinplates a "Two Family Dwelling Unit" as a Special Use within that district; and WHEREAS, the Board held a public hearing on the 10fi day of May, 2004, upon the Todd Gressett, Special Use Permit Lllllull!|Ultlll llllll llt lffilt ilt ilillll]lllt6601s6 0s /?2/20s4 t2 :27p Br6zdF3o8-il n-uiobnF2 of 3 R g.OO D @.OO GRRFIELD COUNTY CO question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2- That the hearing before the Board of County Commissioners was extensive and complete and that all intsrested parties were heard at that meeting; and all pertinent facts, naatters and issues were subrnitted prior at the meeting. 3. That for the above stated and other reasons, the proposed permit is in the best interest of the health, safety, morals, convenience, order, prosperity and weifare of the citizens of Garheld County, 4. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended. NOW, THEREFORE, BE iT RESOLVED by the Board of County CommisSioners of Garfield County, Colorado, that the Special Use Permit be and hereby is approved to allow for a two family dwelling unit at the site identified in the application, upon the following specific conditions: 1, Al1 representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shali be considered conditions of approval. 2. This second dwelling unit shall not be occupied for the proposed use until a final certificate of occupancy) has been issued by the Building Department. A Building Permit for second dwelling unit shall be applied for and construction and/or improvements of said structure shall cortmence within 180 days of the issuance of the Special Use Permit which itself is only valid for 1 20 days from the date of issuance as per Section 9.01 .05. If the Appticant does not finish construction, the Building Permit is revoked, and the Applicant does not eventually receive a Certificate of Occupancy for the Primary Dwelling Unit, then this Special Use Permit shall became null and void. This condition has been satisfied as a building permit has been issued and completed under permit #9206, finaled 81912004. 3. All lighting associated with this structure shall be the minimum amount necessary and all exterior lighting will be directed inward and downward, towards the interior of the lot.
