Thomas Joiner is requesting a Special Use Permit for the construction of a
residence, sewage disposal (moundj system and an access driveway within the
floodplain of the Roaring Fork Rivei, ut rt o*n on the enclosed map' The subject
property is located ,outt"ot Highway'82, 1.0 mile east of the Carbondale (Highway
133) exit. The proposed construction of the residence and the sewage disposal
system will not ,".oi, in the placement of fill material in any streams or wetland

Enclosed is a revised map of the Thomas Joiner property located south of Highway 82, 1
mile east of the Carbondale (Highway 133) exit. This revised map shows the correct
location of the proposed residence and sewage disposal system, and also delineates the
limits of the fill to be placed for the construction of the house and sewage disposal system.
This area, which is shaded on the enclosed map, corresponds with the non-wetland area
that we discussed during our on-site meeting with Tom Joiner on April 2nd. Tom has
asked if you would provide him with a letter documenting our meeting so he can proceecl
with this project.
The enclosed map also shows the approximate location of proposed underground utilities,
(water, electric, phone, etc.) that will serve the new residence. These utilities will cross two
small streams and adjacent wetland areas. We request authorization to construct the
underground utilities in accordance with the applicable Nationwide General Permit.

lowest floor of the proposed residence has raised to 6130.3 feet. This change is
necessary because the original map showed the incorrect location of the proposed
residence; my apologies for any inconvenience this may have caused.

S 60.3 Flood plain management criteriafor flood-prone areas.
The Arlministrator will provide thedata upon whlch flood plain manage-rnent regrrlations shalf bi based. If theAdministrqtor has not providea sufii-cient datato furnish a i:asi" i;; ihes;reg:ulations in a particular community,the- com'nunity shall obtain, reviewand reasonably utilize data availablefrom other Federal, State or othei
sources pending receipt of data fromthe Administrator. IIowever, when
special flood hazard area designationsand water surface elevations have
b_een funished by the Administrator,they shall appiy. The symbols definingsuch special flood hazard designations
are set forth ln $ 64.3 of this subchap-ter. In all cases the minimrrm lsqsi;g-ments governing the adequacy of theflood plain management regulailonsfor flood-prone arezts adopted by eparticular community depend on theemount of technical data formallyprorrided to the community by the Ad-ministrator. Minimum standards forcommunities are as follows:(a) When the Administrator has notdefined l;he special flood hazard areaswithin a community, has not provided
water surface elevation data, and hasnot provided suJficient data to identifythe floodway or coastal high hazardarea, but the comm ,ntty has indicatedthe presence of such hazards by sub-mitting an application to parilcipatein the ProgTarn, the communjlty shall:(1) Require permits for all proposed
construction or other development Lr[,hs semrnunity, lnciuding the piace-
ment of m.anuJactured horc.es, so thatit may determine whether such con-structiofr or other development is pro-
posed vrithin flood-prone areas;(2) Review proposed development toassure that all necessary permits havebeen received from those goverrunen-
tal agencies from whlch approval Is re-quired by Federal or State law, includ-ing section 404 of the Federal WaterPollution Control Act Amenrtments of
1972, 33 U.S.C. 1334;
(3) Review all permit applicatiorx todetermine whether proposed buildingsites will be reasonably safe fromflooding. If a proposed buitding site Isin a flood-prone area, all new construc-tion and substantlal lmprovements
sha.ll (t) be designed (or modlfled) andadequately anchored to prevent flota-tion, collapse, or lateral movement ofthe structure resulting from hydrody-namis and hydrostatic loads, lncludingthe effects of buoyancy, (U) be con-structed with materials resistaut toflood damage, (iii) be constructed bymethods a.nd practices that mlnimizlflood damages, and (lv) be constructedw-tth electrical, heath!, ventilailon,

posals shall be reviewed to assure that(i) all such proposals are consistentvdth the need to minimize flood
damage within the flood-prone area,(1i) all public utitities and facilities,such as sewer, gas, electrical, andwater systems are located and con-structed to minimize or eliminate
flood damage, and (iii) adequate dra-in-
age ls provided to reduce exposure to
flood hazards;
(5) Require wittrin flood-prone areasne\tr and replacement water supply
systems to be designed to minimize orslimlnsls lnJiltration of flood watersL:to the systems; and
(6) Require within flood-prone areas(i) new and replacement sanitary
sewage systern.s to be designed to mini-mizg s1 eliminafs infiltration of flood

(b) When the Arlministrator has des-lgnated areas of special flood hazards(A zones) by the publication of a com-munity's FEIBM or FIRM, but has nei-ther broduced water surface elevationdata nor ldentified a floodway orcoastal hlgh hazard area, the commu-nlty shall:
(1) Require permits for all proposed
construction and other developmentslnclurrng the placement of ma.nufac-tured homes, wlthin Zone A on thecomrnu:rity's FTBM or I'IRM;(2) Requlre the application of the
