TiHEREAS, the Board of County Commissioners of Garfield CountyColorado, has received application from Thomas & Mary Beth Joiner for a Guest House on the I'ollowing described tract of land: (in the State of Colorado and the County of Garfield); and See attached legal description WHEREAS, the Board held a public hearing on the 7th day of May,1990, uPon the question of whether the above-described Special Usepermit should be granted or denied, at which hearing the public andinterested persons were given the opportunity to express their opinionsregarding the issuance of said Special Use permit; and WHEREAS, the board on the basis of substantial competent evidenceproduced at the aforementioned hearing, has made the followingdetermination of fact: 1. That Proper publication and public notice was provided asrequired by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners wasextensive and complete, that all pertinent facts, matters andissues were submitted and that aII interested parties wereheard at that hearing. 3. That the proposed use consistent with the intent of theGarfield County Zoning Resolution. 4. Eor the above stated and other reasons, the proposed use is inthe best interest of the health, safety, morals, convenience,order, Prosperity and welfare of the citizens of GarfieldCounty. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissionersof Garfield County, Colorado that the Speciat Use permit be and herebyis authorized permitting the use of the above desdribed tract of landfor a Guest House upon the forlowing specific conditions: O 1. 2. 3. 4. The applicant shall cease commercial activity on the subjectproperty within thirty (30) days. AII representations of the applicant, either within theapplication or stated at the hearing before the Board ofCounty Commissioners, shall be considered conditions ofapproval, unless other*rise stated by the Board. The use of the guest house shall conform with Section 5.03.025of the Garfield County Zoning Resolution of 1978, as amended. The wastewater system shall conform with all ISDS regulationsand Section 5:Floodplain Regulation.The design,installation and elevation shall be certified by a profes-sional engineer. The proposed residence shall conform with the requirements ofSection 5: Floodplain Regulation. Design, installation andelevation shall be certified by a professional engineer. The installation of underground utilities shall be conductedin confonnance with Federal and County regulations. The applicants shall submit copies of both permits from the Army Corps of Engineers prior to initiating construction. The applicant shall have 180 days from the date of theResolution of Approval to meet aII conditions set forth in theResolution. The Special Use Permit shall be issued when allconditions are met and shall expire 180 days after issuanceunless construction has commenced. 5. ATTESTZ' t,' 5. 7. 8. Dated this lst day of.
