Site Description: The parcel is predominately flat lying
adjacent to the Roaring Fork River. The property is
vegetated with extensively riparian/wetland vegetation.
Existing improvements on the property include a single
family residence and a three (3) bay garage.
Development Proposal: The applicants are Proposing to
get authorization to allow the existing home to become a
g"uesthouse. The applicants will then construct a newprimary residence and a new wastewater systemr dD
engineered mound system, to serve the residence. The
residence will be located approximately 100 feet from
existing residence.
II. I,IAJOR ISSUES AIID CONCERNS
A. Zoning: The Garfield County Zoning Resolution requires
a Special Use Permit for aII development within a 100year floodplain.
Evidence indicates that the applicants may be operatinga concrete contractor's yard from their residence. Acontractor's yard is not allowed in the A/R/RD zonedistrict and should be disconti-nued.
Guesthouse: The existing residence conforms to the
requirements of Section 5.03.025 for the development ofa guesthouse. The residence has less than 100 squarefeet of livable area (908) and exceeds the minimum parcelsize required by zoning requirements (2 acres) by morefifty (50) percent.

The applicants are Proposing to provide domestic water
for both the primary residence and the guesthouse from an
existing well. The existing weII permit does not
specifically authorize this use.

OnIy minor amounts of fiII will be required for the
building pad and wastewater system. No increases in
flood elevation should result and consequently no
negative impacts on upstreclm or downstream residents
should be experienced.
Army Corps of Engineers has conducted an on-site
inspection of the property. The proposed development
will not require a Section 404 permit and can be
conducted under two (2) separate nationwide permits. No
negative impacts on wetlands wiII be experienced.
Water: The applicants are proposing to serve the primary
residence and the guesthouse from an existing weII. The
applicants have an "exempt domestic we}l" permitted in
L958 to allow for up to 3 residences.
III. SUGGESTED FINDINGS
1. That an application was submitted as required by the
Garfield County Zoning Resolution of 1978r €IS amended.
That proper pubtication and public notice was Providedas required by law for the hearing before the Board of
County Conunissioners .
That the hearing before the Board of County Commissioners
was extensive and complete, that aII pertinent facts,
matters, and issues were submitted and that all
interested parties were heard at that hearing.
For the above stated and other reasons, the proposed use
is in the best interest of the health, safety, welfare,
morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
IV. RECOMMENDATION
APPROVAL, subject to the following conditions:
The applicant shall cease commercial activity on the
subject property within thirty (30) days.
AII representations of the applicant, either within the
application or stated at the hearing before the Board
County Commissioners, shall be considered conditions
approval, unless othenrrise stated by the Board.
The use of the guesthouse shall conform with Section
5.03.025 of the Garfield County Zoning Resolution of
1978r ES amended.
The wastewater system shall conform with all ISDS
regrulations and Section 5: Floodplain Regulation. Thedesign, installation and elevation shall be certified bya professional engineer.
The proposed residence shall conform with the

The installation of underground utilities shall be
conducted in conformance with federal and County
regulations.
The applicants shal} submit copies of both permits from
the Army Corps of Engineers prior to initiating
construction.
The applicant shall have 1,80 days from the date of the
Resolution of Approval to meet all conditions set forthin the Resolution. The Special Use Permit shall be
issued when aII conditions are met and shall expire 180
days after issuance unless construction has commenced.
