The posting must take place at least thirty (30) but not more than sixty (60) days
prior to the hearing date and is the sole responsibility of the applicant to post the

4. The Applicant is required to appear before the Board of County Commissioners at the time
and date of the pubiic hearing at which time the Board will consider the request. ln addition,
the Applicant shall provide proof, at the hearing, that proper notice was provided.
5. Once the Board makes a decision regarding the Special Use request, Staff will provide the
Applicant with a signed resolution memorializing the action taken by the Board. Following
the Board's approval, this office will issue the Special Use Permit to the applicant. lf the
Board's approval includes specific conditions of approval to be met, this office will not issue
the Official Special Use Perrnit certificate until the applicant has satisfied all conditions of
approval. The Special Use Permit approval is not finalized until this office has issued the
Om"irt Special Use Permit certificate signed by the Chairman of the Board of County
Commissioners.

AGREEMENT FOR PAYMENT FORM
(Shall be submitted with application)
GARFIELD COLINTY (hereinafter COLINTY) and
(hereinafter APPLICANT) agree as follows:
1. APPLICANT has submitted to COTINTY an application for
(hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended,
establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for
the administration of the {'ee structure.
3. APPLICANT and COLNTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
apptication. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to
thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional
payments upon notification by the COUNTY when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the consideration of an
application or additional COTINTY staff time or expense not covered by the Base Fee. If acfual recorded costs
exteed the initial Base Fee, APPLICANT shall pay additional billings to COTINTY to reimburse the COLINTY
tbr the processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid
prior to the final consideration by the COUNTY of any land use permit, zoning amendment, or subdivision
plan.

I, Jason Jabs, am requesting a special use perrnit for my property'
The use permit will be for repairing vehicles and to store some plumbing
supplies for work of which I perform. When I purchased my property,
my lntentions were to build a house for residence and with the acreage to
be able to erect a metal building, both of which were permitted and
issued certificates of occupancies from Garfield County building
department. The shop was built to be able to work on farm equipment
(tractors, swathers, stack wagons etc.) for my field work , stack inside ,
have friends and family be able to change oils or fix things on there
automobiles and to store my plumbing supplies under a covered
environment. My Brother and sister in law (Hank and Kamron Kracht)
have a water hauling business in the gas and oil industry in our
surrounding area, they also live next door to me so I allow them to use
my facility to change oils and perform minor repairs to their trucks, their
laiger repairs are performed at the Mesa Mack truck repair facility and
Hanson International in Grand Junction Colorado. My shop has concrete
floors, so I have a flat surface to work from as well as it is a heated shop.
I have a certified Clean Burn waste oil furnace, thus said all who change
oils here have a place to dispose of there waste oil. There are Several
other Residentiai shops and Agricultural buildings in our area with the
same type of heating system. There are no paid employees; the work
perfbrmed in my shop is done by myself, Hank or other family members
only.
Usage of my shop varies, my friends call to use my shop, I give them
permission and tell them they may use it when convenient for them'
Hank Kracht will bring his trucks in periodically to perform oil changes
or to perform minor repairs. There is never a set schedule for anyone
that uses my shop, I may not see any vehicles for 3 ot 4 weeks atatime'
However there aie times I may have 2 or 3 friends or family members
call me for use of my shop. My 10 acre parcel is located at the end of a
private drive off of 337 toad in which myself and Hank Kracht have to
maintain. I have purchased a backhoe, hauled in gravel, Hank also has
tractors to hetp maintain our private road all of which is paid out of our
pockets. We also on many occasions have performed snow removal as a
courtesy to our neighbors as the county does not service our private
road.

Re: Special Use Permit for the Contractors Yard (Jason and Kelli Jabs)
In regards to my special use permit application, there is a requirement as to the
amount of water and waste being rrt"d. I would like to let you know there is no
running water nor is there a bathroom in the shop facility. With no water available
there is no washing of any equipment or vehicles'
where the access to the property is (from a county Road)
See attached site Plan.
In regards to the parking and truck storage:
The trucks and equipment currently stored on my property is as follows,
farming equipment tp: swather, plow, backhoe, baler, stack wagon and horse
trailer. The vehicles on my property ate my personal vehicles, any and al1 work or
repairs on friends and family's-vehicles are either inside the shop or depart the very
same day they arrive for the repair work'
The north side of my shop has a 60'x20' enclosed section in which I store
hay and my plumbing materials and supplies'
The proposed uses screened from view:
My application will not affect any sulrounding properties views of any sort.
My propertyis on a down slope and from 337 rdto my residence, my shop or
vehicles in question will not have any visual impact on any of my surrounding
neighbors.

Condition #5 Screening of plumbing materials in lean-to structure:
I constructed shelves in the lean-to to store my plumbing supplies.
From my neighbors view is the back side of the shelves which is a
solid plywood surface. I have also built a 30x80 pole shed to the west
Side of my shop for screening purposes.
I will also be planting 4 spruce trees to obstruct view from the north
west residence. (See attached drawing).
Condition #10 Containment for waste oil: I poured a concrete slab
with 4' concrete walls to contain my waste oil for my oil burn furnace.
On the exterior of the concrete wall I have labeled what is contained
within. "Waste oil, Flammable, no smoking"
Condition #11 Initial & Annual Fire Inspection:
Attached letter from Deputy Fire Chief-operations, Rob Ferguson of
Grand Valley Fire Protection District.

Subject: Initial & Annual Fire Inspection
Mr. Jabs,
On September 9, 2208 at l745}rs I came out to your property to do a fire inspection and
to set up an annual inspection plan with you. We discussed fire extinguisher requirements and
drain on your containment area for the waste oil storage. The building was clean and in good
order. The only concern was the containment area being close to the building however the way it
is constructed flames probably wouldn't be higher than the walls of the containment unit. The
concrete construction would protect the building from most of the flames. I want to advise you in
the event this area was to catch on fire this would not 100% protect the building. I will approve
this unit but I want you to realize the potential if a problem was to occur. For future inspections I
will place your property on my annual fire inspection list. You can expect me to contact you prior
to coming out each year in the month of September. I would like to add that this project on your
property was a nice improvement and thank you for contacting me to come out. If you have any
questions please feel free to contact me.
