that start-up time. One of the problems is that the Highway Dept.'s
specifications were for the asphalt to be 280 degrees and it starts
smoking at 270 degrees. They suggested the State Highway Dept and the
State Health Dept need to get together on this problem. Utah and
Arizona state departments have the same problem. They had told Mark
Bean, when he called, that changes were being made to alleviate the
problem. The burner fuel was changed to #2 Diesel a few days after the
State citation, the start-up procedure has been altered, the asphalt
temperature has been lowered, modifications on the asphalt line have
been made and vermiculite has been used to seal anything in the bag
house. The state hearing is June 13, 1990 and there will be some
alternatives suggested at that hearing which they will apply.
The Board decided to give Corn Construction a warning only and directed
Mark to write a letter to the two State Departments regarding the
problem with the asphalt temperatures.
There was a discussion regarding the illegally stored asphalt plant and
Mr. Frei stated that it has been decommissioned. Mark stated he could
change the permit to allow for multiple plants and although the Board
did not have any problem with the storage, they decided that the plant
may be allowed to remain stored since there appeared to be a
misunderstanding of the terms of the permit, and should they decide to
have two on site prior to Corn Construction's completion, they should
have the resolution amended to allow for it.
There was also a discussion regarding the cattle chutes being located
so that the cattle loading trucks get in the road and the Board
directed Mr. Frei to turn the cattle chutes to alleviate that
obstruction.
PAT GROOM SPECIAL USE PERMIT HEARING CANCELLED BY APPLICANT
PUBLIC HEARING FOR 4 SPECIAL USE PERMITS FOR 4 NATURAL GAS WELLS
LOCATED NORTH, NORTHEAST AND SOUTHWEST OF PARACHUTE; APPLICANT, BARRETT
RESOURCES CORP.
Sworn in were Shirley Chavez, of Barrett Resources Corp., and County
Planner Andy McGregor. Persons desiring to discuss the permit were
sworn in en masse and instructed to. give name and address when they
spoke. Don discussed the legal notice requirements and the Board found
them to be adequate. The following exhibits were admitted into the
record: Exhibit "A", proof of publication; "B", mail receipts, "C",
staff comments; "D", a letter from Nancy & Clarence Muller; "E", a
letter from Dorothy Dolier; "F", a letter from Gary Morris at UNOCAL.
Andy reviewed the staff comments.
Alta Rayfelt, 143 So Fork, Montrose, CO, presented her deed and asked
Shirley Chavez to locate the wells on the map in accordance with her
property. Shirley described where each well was located and explained
that Barrett Energy was required to notify adjoining property owners
and that getting a notification of this hearing did not mean that the
wells would be on their property. She further explained that the wells
would not be in the subdivision but north of the interstate. She also
assured Ring Lloyd, Road & Bridge Supervisor, that Barrett would have
to use the State Highways and not county roads.
Robert Gregory, 1120 Lowell Ct., Grand Junction, CO, asked if access is
made from old highway 6 & 24 would be damaging to surface right of
property owners in Travelers Highlands and Shirley stated they were
going to use the I-70 underpass west of Travelers Highlands and will
not use any part of Travelers Highlands.
Commissioner Arbaney made a motion that the Public Hearing be closed.
Commissioner Mackley seconded the motion; carried. Commissioner
Mackley made a motion that the Board approve 4 Special Use Permit
applications by Barrett Energy Corp. for 4 natural gas wells, well GV
70-33, GV 65-3, GV 62-6 and GV 36-28, - one well located 3 miles north
of Parachute just off Co Rd 215, two wells 1-2 miles northeast of
Parachute and the 4th well just north of I-70 at Una, 5 miles west of
Parachute - with the conditions of approval as stated in the staff
comments dated May 21, 1990 adding that access to GV 36-28 will be over
