WHEREAS' the Board on the basis ofsubstantial compeJent evidence produced at theaforemenlioned hearing, has rnade,lr" rrilGe;;;,Iofrrt"ri'fr*, as listcd betow:

1.Proper posting and public notice was provided as required for the meeting before the
Board of County Commissioners.
The meeting before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that aU interested purties
were heard at that meeting.
The above stated and other reasons, the proposed special use permit has been
determined to be in the best interest of the heahh, safety, morals, convenience, order,prosperity and welfare ofthe citizens ofGarfield Couniy.
The application has met tJre requirenrents of Special use (sections 5:03, 5:03:07,
5:03-08 and 9:03) the Garfield county Zoning-Resolution of 197g.

NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners ofGarfield County, Colorado, that Special Use Permit is irereby approved subject to compliancewith all ofthe following specific conditions:
l' Additionally, the applicant has obtained (purchased and paid) all yearly (2004)oversize/overweight permits and permits for the oversize/ov"r*.ight equipment alreadyhauled to the location. The applicant will need to continualry *ui"iuintt"Jp"rmits
"veryyear as a condition of approval.
2' The Applicant shall remove all unused materials fromthe property at the time the crusheris removed as part of the use of the current special Use irermit iequest.
3' Dernonstrate that sound levels of noise radiating from a property line at a distance of 25feet or more there from in excess of the dB(A)

4' A new driveway access shall be constructed that is a minimum of g0-feet wide to allowfor trucks to turn in and out ofthe location without damaging the shoulder of the road.
5' At the time of that improvements are made to county Roacl 300the Applicant shallcorstruct an asphalt mat the width ofthe driveway oxtenaing into the loeatili for 20-fedand a depth of 4-inches attached to the paved Lage or the existing road. There is apossibility that CR 300 will be under reconstruJtion and coordinatio, b.;;;;r-uucompanies will be needed.
