D. there were present: John Martin , Commissioner Chairman Larry McCown , Commissioner Tresi Houpt , Commissioner Don DeFord , County Attorney Mildred Alsdorf , Clerk of the Board Ed Green , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2006 - 01 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT FOR A TWO-FAMILY DWELLING FOR A PROPERTY LOCATED AT 0329 CORYELL ROAD (CR 167), GARFIELD COUNTY, COLORADO AND OWNED BY THE DORIS M. HUNT FAMILY TRUST Parcel ID: 2395-014-00-086 WHEREAS, the Board of County Commissioners of Garfield County, Colorado (the Board), received an application for a Special Use Permit (SUP) for a Two -Family Dwelling on a property (Property) located at 0329 CR 167; WHEREAS, the Property is owned by the Doris M. Hunt Family Trust which is located within the A/R/RD zone district where a Two -Family Dwelling is contemplated as a Special Use; WHEREAS, the Board held a public hearing on the 19th day of December, 2005, upon the question of whether the above described SUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said SUP; and WHEREAS, the Board, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. That the hearing before the Board of County Commissioners was extensive and complete, that sufficient pertinent facts, matters and issues were submitted and that all interested parties present were heard at that meeting; 3. That for the above stated and other reasons, the proposed Special Use Permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with Sections 2.02.21, 5.03, and 9.02 of the Garfield County Zoning Resolution of 1978, as amended; NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Conditional Use Permit is hereby approved subject to compliance with all of the following specific conditions: 1. That all representations made by the Applicant in the application, and at the public hearing before the Board of County Commissioners, shall be conditions of approval, unless specifically altered by the Board of County Commissioners. The Two -Family Dwelling shall be allowed no more than a total of 4 bedrooms in total for both units combined so that the presently designed / engineered septic system can be sure to accommodate the usage. However, prior to the issuance of the Special Use Permit, the Applicant may provide proof to the County Planning Department that the existing septic system serving the Two -Family Dwelling can accommodate more than 4 bedrooms. This proof shall be in the form of a letter, signed and stamped, from an engineer licensed to practice in the State of Colorado. In no case, shall the number of bedrooms in the Two -Family Dwelling exceed the design capacity of the Septic System. 3. The two dwelling units configured in the Two -Family Dwelling shall be the only residential units on the property. The single -wide modular structure shall not be used for residential occupancy. 4. Any physical changes to the Two -Family Dwelling may require a building permit from the Garfield County Building Department. 5. All lighting associated with the property shall be directed inward and downward towards the interior of the property. 6. In the event any representations made in the application for which this permit is granted, change and are no longer consistent with the representations in this application, the applicant shall be required to submit a new permit application to the county addressing 2 i uiiii uiii 1111111 111 ii0iiii iiim iii 1111 ilii uii 689834 01/04/2006 11:09A B1761 P260 M ALSDORF 3 of 4 R 0.00 D 0.00 GARFIELD COUNTY CO the changes. 1 7. That only leasehold interests shall be held in either unit and that if the owner of the property wishes to sell one unit, that unit shall be required to comply with the County's Subdivision regulations in effect at the time. 8. Prior to issuance of a Special Use Permit, the Applicant shall provide proof to the County Planning Department that the existing septic system serving the two-family dwelling can accommodate the number of bedrooms in the two-family dwelling. If the system cannot presently serve the number of bedrooms, the Applicant shall either reduce the number of bedrooms to comply with the existing design capacity of the septic system or have the system reengineered to accommodate the number of bedrooms. This system shall be engineered by a registered engineer licensed to practice in the State of Colorado.
