REFEREE
The above entitled matter having been referred to the
undersigned as Water Referee for Wa::er Division No. 5, State
of Colorado, by the Water Judge of said Court on the 2nd day
of September, 1970, in accordance with Article 21 of Chapter
148, Colorado Revised Statutes 1963, as amended (Chapter 373
S.L. Colo. 1969), known as The Water Rights Determination and
Administration Act of 1969.
And the undersigned Referee having made such investiga-
tions as are necessary to determine whether or not the
statements in the application are true and having become fully
advised with respect to the subject matter of the application
does hereby make the following determination and ruling as the
Referee in than matter, to wit:
a. The statements in the application are true except as
to the location of the headgate of the Patch Spring Pipeline
Ditch. The correct location is described below.
b. The name of the Structure iq thP. Patch Spring Pipeline_
c. The names of the claimants are William G. Patch and
Mildred M. Patch.
d. The source of the water is a spring which has been
developed and improved. Saiz spring is located in the W SW ,
Section 4, Township 6 South, Range 91 West of the 6th P.M.

e. The location and legal description of the point of
diversion is at a point whence the Wk corner of section 4 bears
North 17°53'41" West 837(.99 feet. Said spring is in the NWkSW3
of said section 4.
f. The type of use and the proposed use is for domestic,
lawn sprinkling and incidental purposes.
g. The date of initiation of the appropriation is October
14, 1947.
h. The total carrying capacity of said pipeline is 50
gallons per minute or .1115 cubic feet of water per second of'
time.
j.. The amount of water claimed and diverted by and under
said Patch Spring Pipeline is .1115 cubic feet of water per
second of time,
j. The water from sat spring is diverted by means of a
pump which raises the water approximately 30 feet. The water
so raised is diverted by two pipelines , each one inch in
diameter, one of which leads to the residence of the applicants
and the other to other improvements on said property. The
length of said pipeline from the spring to the residence is
about 35 feet and from the house to the shop the length is
approximately 200 feet making an overall distance or length of
230 feet in length of the pipeline.

with due diligence and the water has been applied to a beneficial
use ever since October 14, 1947.

The Referee does therefore conclude that the above en-
titled application should be granted and that .1115 cubic feet of
water per second of time hereby is awarded to the Patch Spring
Pipeline, for domestic, lawn sprinkling and other incidental uses,

with appropriation date of the=14th day of October, 1947, absolutely
and unconditionally; subject, however, to all earlier priority rights
of others and to the integration and tabulation by the Division
Engineer of such priorities and changes of rights in accordance with
law as may be determined in pending supplemental general adjudication
proceedings.
It is accordingly ORDERED that this ruling shall be
entered by the Referee in his records and shall become effective
upon such entry, subject to judicial review as provided by law.
It is further ORDERED that this ruling shall be filed
with the appropriate Division Engineer and the Water Clerk of
said Court.
No rights or claims of the United States to use and ,
ayt...vate water shall be affected or impaired by this Decree.
Such rights and claims shall be subject to a future consideration
and determination by this Court if it is so decided by the Supreme
Court of the United States in cases now pending in that Court.
This provision is in compliance with the Order of the Supreme Court
of the United States entered November 13, 1970, in Nos. 87 and 812,
October Term, 1970, respectively entitled United States, Petitioner,
v. District Court in and for the County of Eagle and State of
Colorado, et al.; and United States, Petiltioner, v. The District

Dear Sirs:
We ere submitting information for special use permits on
a metal building and relocation of an existing mobile
h)me space.

One 30x60x20 three sided metal covered structure leer -ted
next to our existing shop. No wditer, no electricity,arid
no sewer included. This is to be used as a cover for
metal fabrication and shelter for equipment.
We also want to move a mobile house location a pproxi;;iately
75 feet from it's ~resent location. We would use the
existing water, sewer and electrical hook up. We then
wish to move an elderly couple on the new location ,rent
free, in exchange for helping take care of the property.

meter are aliready in existence.

Impact Statement:
We can see no significant impact on anything by expanding
this business. There has been a repair, welding «, machine
shop here for over thirty years.
There is no pollution to any stream, there is some smoke,
some noise, and some glare that is cou,non to this type
of business.

This business is joined by another business very similar
to it on the ;.est, on the North , it is bounded by the
state highway. On the South 6c Last, it is bounded by
the Colorado river.
The native v:ildlife has never been effected from this
operation here. The bald eagles sit in the trees in the
winter and fish in the river beside us. The ducks and
wild geese winter and nest on our property.
We have a state highway permit to build a seper=te read
from shop area 1:lith access onto the frontage road.
There is a ,]udiceted siring on our property, and two
separate sewer systems which are functional and have been
without fault since we bought the property in 1972.
