Please submit this information in narrative form and be specific. 2] If you will be using water or will be treating wastewater in conjunction with the proposed use, please detail the amount of water that would be used and the type of wastewater treatment. If you will be utilizing well water. please attach a copy of the appropriate well permit and any other legal water supply information, including a water allotment contract or an approved water augmentation plan. 3] V A map drawn to scale portraying your property, all structures on the property, and the County or State roadways within one (1) mile of your property. The consideration of this proposed Special Use will require at least one (1) public hearing, for which public notice must be provided. The Planning Department will mail you information concerning this hearing(s), approximately 30 days prior to the scheduled hearing. You will then be required to notify, by certified return receipt mail. all adjacent landowners and publish the notice provided by the Planning Department, in a newspaper of general circulation. Both these notices must be mailed/published at least 15 days prior to the public hearing. The applicant shall bear the cost of mailing and publication and proof of mailing and publication must be submitted at the time of the public hearing. Box 2362 Glenwood Springs, Colorado 81602-2362 The Glenwood Springs Gun Club Inc. operates a multiple use shooting complex 2 miles South of Interstate Highway 70. Accessible by County Road 134. The 320 acres used for this complex is leased from the City of Glenwood Springs. This property is well situated, away from residential areas and has substantial topographic features providing a well contained, safe shooting environment. The facility includes the following: -3 trap ranges; -2 pistol ranges; -a target and silhouette range; -a sporting clays range; -a paintball range, including a combat enclosure; -a clubhouse, and several small structures for storage, and supplies; -5 portable toilets; The Glenwood Springs Gun Club provides a safe shooting environment for local residents, registered regional and national level shooting matches, hunting rifle sight -in clinics during the big game seasons, and numerous other firearm related activities and functions throughout the year. The Glenwood Springs Gun Club has also been featured on national TV in a segment about the joy of shooting by ESPN. The range has been open since 1972 and is used regularly by the members of the Glenwood Springs Gun Club, Garfield County Sheriff Department, Glenwood Springs Police Department, Colorado State Highway Patrol, Silt Police Department, Division of Wildlife, and others, for qualification and practice. In addition the Club is used by the general public for numerous other sponsored, and non -sponsored shooting events and competitions. Including registered American Trapshooting Association trap shoots, National Sporting Clays Association shoots, United States Practical Shooting Association of International Pistol Shooters Conference shoots. The range is also used by the Boy Scouts, 4H Clubs, Hunter Safety Programs, and other community groups. Each entity using the range sets their own hours and times with the approval of the Club. Use of the range varies from one to five individuals on off days. Larger groups for practice days, and other events, generally on weekends. The Club holds regular pistol practice on Monday evening throughout the summer months, trap and sporting clay practice Thursday evenings and all day Saturdays and some Sundays. Vehicle traffic generated by the range is limited. Daily traffic is only one to five vehicles per day, practice days will generate ten to fifteen vehicles, with up to fifty vehicles for special events, and registered shoots. Structures at the range are limited to a clubhouse, three trap houses, several small portable storage buildings. a paintball combat enclosure, and 5 portable toilets. P.O. No domestic water or waste disposal services are available to the site. 3) No lighting is available at the Club: 4) No alcoholic beverages on the range site: Use of alcoholic beverages on the ranges is prohibited. RANGE REPORT As a certified NRA instructor I have examined the Glenwood Springs Gun Clubs range's. Using the NRA's " The Range Manual " as a guide. I have found all ranges to be in compliance with the safety recommendations found in the NRA range manual. As further proof of the safety of these ranges and the people that supervise or use them. The Glenwood Springs Gun Club has an impeccable safety record. Over the last twenty eight years there has been well over one million rounds fired within this facility without an unsafe incident. With this record I consider these to be very safe shooting ranges. Providing all safety rules are followed, as in the past there should never be any concern that these ranges are unsafe. ("Lessee"), to be effective April 1, 1994, no matter what date actually signed by the parties. WITNESSETH: Lessor, for and in consideration of the rents herein reserved and of the benefits derived by the City of Glenwood Springs as a result of the keeping of the covenants, agreements, and conditions contained herein on the part of the Lessee, does hereby grant a non-exclusive Lease to Lessee for the following described property: A tract of land in Garfield County, Colorado, being a portion of Section 11, Township 6 S., Range 90 W. of the Sixth Principal Meridian, being more particularly described as follows: All that portion of the S 1/2 of t e S 1/2 of the NW 1/4 of said Section 11 lying easterly of County Road 134, and all portions of the SW 1/4 and the SE 1/4 of said Section 11, as shown on the map attached hereto and incorporated herein as Exhibit "A". Section 1. Use of Premises. The leased premises, as described herein, shall be used by Lessee for the following purposes only: A. Access over and maintenance of the access road which extends easterly from County Road 134, being in the SW 1/4 of Section 11, as designated on the attached Exhibit "A". B. Maintenance of a security gate on the road described in Paragraph A, said gate to be regulated according to rules and regulations promulgated pursuant to Section 2 of this Lease. C. Reconstruction, maintenance and operation of a target range and pistol silhouette range in the area designated as "C" on the attached Exhibit "A". D. Maintenance and operation of the existing trap shooting range in the area designed as "D" on the attached Exhibit "A", and maintenance and operation of a trap shooting range in the area designated as "E" on the attached Exhibit "A". E. Reconstruction, maintenance and operation of a sporting clays course in the areas designated as "A" and "E" on the attached Exhibit "A". F. Such other specific activities in specific locations upon the leased premises as shall be expressly approved in writing by the City Manager of the City of Glenwood Springs according to the procedures and conditions set forth herein. G. The pistol range and shotgun range (identified by the highlighted area on Exhibit A) shall be under the control of the Lessor. This portion of the leased premises shall be separated from the remainder of the leased premises by fencing or other median as soon as possible. In the event Lessee wishes to utilize this portion of the leased premises, a request shall be made with the Chief of Police. Under those circumstances when Lessee's member(s) utilize these ranges, Lessee shall be responsible for providing insurance and indemnifying Lessor. Section 2. Promulgation of Rules. Regulations. and Schedules for Use of Leased Premises. Lessee shall maintain with the City Manager of the City of Glenwood Springs a current list of rules and regulations for use of the leased premises. Such rules and regulations shall provide generally for the preservation of the public health, safety and welfare and shall provide for public access to the leased premises at times to be agreed upon between the Lessee and the City Manager. Any amendment to such rules and regulations shall be subject to the prior approval in writing of the City Manager. Furthermore, on or before May 1st of each year, Lessee shall submit to the City Manager of the City of Glenwood Springs an annual schedule of organized shooting events to occur on the leased premises. Said schedule shall be expressly approved in writing by the City Manager prior to the commencement of any organized shooting events. A copy of said rules and regulations and schedules will be maintained on file in the office of the City Clerk of the City of Glenwood Springs. Section 3. Term. This lease shall be for a term of six (6) years commencing on April 1, 1994 and terminating .on April 1, 2000. Lessee agrees to pay Lessor as rental for the leased premises an annual rent of $10.00, due and payable on or prior to April 1st of each year during the lease term commencing on the 1st day of April, 1994. Section 4. Renewal and Extension A. This lease may be renewed at the option of the City Council of the City of Glenwood Springs. Lessee shall notify the City Manager of the City of Glenwood Springs, Colorado, its desire to renew this Lease at least six (6) months prior to the termination date of the Lease. Within two (2) months of the receipt of said notice, the City Council shall expressly determine either to renew or not to renew this Lease. Lessor reserves the right to amend the terms of this Lease pursuant to any renewal. B. If, at any time, Lessee proposes to install major improvements upon the leased premises, including by way of example permanent buildings, Lessor agrees to consider an extension of this Lease and enter into good faith negotiations for said extension. 2 Section 5. Non -exclusivity. This lease is non-exclusive and Lessee acknowledges the existence of two pre-existing City Leases for all or part of the leased premises as follows: Twenty (20) year coal Lease to Alan D. Gray dated July 20, 1978, subsequently assigned to New Castle Energy Corporation, providing for exploration and development of coal resources; and Both of said Leases contain the following language: "The City may use the surface of the subject lands so long as such use does not interfere with the safety of the City's licenses, the Lessee's employees and the Lessee's operations." Lessee further acknowledges that the Lessor may, in the future, use or enter into agreements for the use of the premises for any and all lawful purposes, including but not limited to municipal facilities and other recreational purposes which are compatible with Lessee's activities; however, it is mutually understood and agreed by the parties hereto that the use of the property for other recreational purposes shall be subject to the prior approval of both parties. Lessee further acknowledges that the Lessor may require the modification or relocation of Lessee's facilities and activities for the safety and convenience of existing and prospective users of the leased premises. In the event a modification or relocation of facilities is deemed necessary by the Lessor, the City Manager of the City of Glenwood Springs shall provide Lessee with ninety (90) days advance written notice to modify or relocate said facilities. In the event an activity of the Lessee is deemed to pose an imminent danger to persons or property on or off the leased premises, the City Manager of the City of Glenwood Springs may order an immediate halt to said activity and Lessee shall comply with said order forthwith. Section 6. Other Uses of Premises by Lessee. Upon request by the Lessee, the City Manager of the City of Glenwood Springs may approve uses of the leased premises over and above the permitted uses set forth in Section 1 of this Lease. Such approval shall be in writing and shall set forth specifically the activity to be permitted, its location within the leased premises, and any and all additional conditions necessary to protect the public safety and welfare. Section 7. Revocability. The Lessor may revoke this Lease upon three (3) months written notice if the Lessor determines the Lessee's activities have become incompatible with any other lawful use of the leased premises or if any provision of this Lease is breached by the Lessee. 3 Section 8. Grace Period_for Inaccessibility. In the event Lessee is required to remove, relocate or modify any of its facilities according to the terms of this Lease and the leased premises are inaccessible due to snow, ice, flooding, mudslides, or any other natural cause. Lessee shall be allowed a reasonable grace period for the removal, relocation, or modification of said facilities until the leased premises become accessible. Section 9. Indemnity and Insurance. Lessee hereby agrees to hold harmless and indemnify Lessor from any loss, claim, demand, injury, obligation, or liability of whatever nature (including attorney's fees) resulting from or arising out of or in connection with the occupation, use, or operation of the leased premises by Lessee. Lessee shall obtain and maintain in effect at all times during the term of this Lease a policy or policies of liability insurance wherein Lessor is named as an additional insured with coverage of not less than $1,000,000 per occurrence. Lessee shall provide Lessor with a Certificate of Insurance or duplicate original policy evidencing such coverages to be in effect as of the commencement of the Lease and each time either the insurance policy or the Lease is renewed. Lessee further agrees to make provision for the immediate notification of the Lessor in the event said policy is cancelled. Section 10 Ownership of Improvements. Any and all improvements to the leased premises including road and drainage improvements, permanent buildings, fences and gates, or other structures shall remain as property of the Lessor upon the termination of this Lease. Notwithstanding the foregoing, any and all mechanical appurtenances, target and trap equipment, or other portable equipment or structures owned by Lessee shall be removable at the option of Lessee, so long as waste to the leased premises does not occur due to said removal. Section 11. Notice. Every notice, approval, consent or other communication authorized or required by this Lease shall be directed to the following addresses unless a change of address is provided by written notice: Lessee: Lessor: Glenwood Springs Gun Club, Inc. If any of the terms, covenants, conditions, or provisions of this Lease shall, for any reason, be invalid or unenforceable, the remainder of the Lease shall not be affected thereby, and each remaining term, covenant, condition and provision of this Lease shall be valid and be enforced to the fullest extent permitted by law unless the invalidity of a provision defeats the purpose of this Lease. Section 14. Binding Upon Successors. All of the covenants, conditions, and agreements contained in this Lease shall be binding and inure to the benefit of the respective parties hereto as well as their respective successor in interest of any kind. Section 15. Assignment. This Lease shall not be assigned nor sublet by the Lessee. Section 16. Section Titles. The section titles used in this Lease are for convenience only and are not to be used to construe or interpret this Lease. Box 2267 Glenwood Springs, CO 81602 RE: Gun Club Lease and Special Use Permit Dear Mr. Burnsworth: At its regular meeting on March 16, 2000, City Council approved a 120 -day extension of the Lease Agreement executed between the City and the Glenwood Springs Gun Club. Inc. on April 1. 1989. for use of a portion of the City's property in South Canyon as a firearms range. The original lease is scheduled to expire on April 1, 2000. With this extension. the new termination date of the lease would be August 1. 2000. All other terms and provisions of the original agreement shall remain in full force and effect during this period. The extension of the lease was approved by City Council on the understanding that this additional 120 days would be used by the Gun Club to obtain the necessary permits from Garfield County to allow the range to operate legally. In addition. this time would provide an opportunity for the City and the Gun Club to negotiate a new lease. At the same meeting. City Council also approved the Gun Club acting as a legal representative of the City in applying for and proceeding with the County's procedures for obtaining the necessary permits for legal operation. This letter is intended to be used as the City's memorialization of that approval and. as such, may be provided to Garfield County as evidence of the Gun Club's designation by City Council for purposes of obtaining the requisite permits. If the terms of this letter fairly and accurately represent your understanding. please sign a copy of this letter and return it to the City Attorney for the City's files. Because of the many different shooting sports, and groups using the Glenwood Springs Gun Club, the management have set perimeters to allow shooting Sunday through Saturday from 8:00 AM to 9:OOPM, or dusk which ever may come first. The exception to this rule would be law enforcement, which conducts some night training courses in the dark. Obviously these training sessions commence after dark and run till the end of the session. These are rules, not just suggestions. Club Bylaws provide for severe penalties for violations of these rules. Rifle/Pistol Area Range Rules 1. Ranges are for use by members and escorted guests ONLY, except for participation in events open to the general public. Members are responsible for the actions and close control of family and guests. 2. No cross shooting. Your bench must be in line with your target. Shoot only proper targets attached to the club's target holders. Bullets should not hit the wooden target supports or target numbers. Bullets must impact the BERM below midline. Do not shoot glass, tin cans, trash, or the ground. 3. Coming to or from the firing line guns are to be unloaded and completely clear of ammunition. Unless shooters on the line are firing guns must be racked or the action open (i.e., unloaded, magazine out) or as ordered by the Range Master during a sanctioned event. 4. Call for a cease fire, and verify this with every other shooter at the firing line before going down range. Do not handle guns on the firing line while anyone is down range. 5. No fully automatic firing is permitted. Tracer, explosive, or incendiary ammunition or targets are prohibited. 6. When more than one member is on the range, those present appoint a Range Officer to give "commence fire" and "cease fire". All members are always responsible for safe facility use and must take immediate action to stop an unsafe situation. 7. No alcohol is permitted on the firing line. No one impaired by alcohol or medications is permitted to use the ranges. Do not smoke at the shooting benches. 8. Always control your muzzle. Point your gun at the back berm during loading, unloading, or when making adjustments or repairs. 9. Proper containers are required for powder, primers, and the like. 10. Damage to club property or unsafe use of guns is never permitted. Members must correct an observed unsafe situation and must report damage/unsafe conditions to D-23 A Father's Advice To His Son If a Sportsman true you'd be, listen carefully to me. Never, never let your gun pointed be at anyone; that it may unloaded be matters not the least to me. When a hedge or fence you cross, though of time it causes a loss, from your gun the cartridge take, for the greater safety's sake. If `twixt you and neighbouring gun birds may fly or beasts may run, let this maxim e'er be thine: Follow Not Across The Line. Stops and beaters oft unseen lurk behind some leafy screen; calm and steady always be: Never Shoot Where You Can. Not See. Keep your place and silent be: game can hear and game can see; don't be greedy, better spared is a pheasant than one shared. You may kill or you may miss, but at all times think of this: all the pheasants ever bred won't repay for one man dead. Shotguns loaded with birdshot or buckshot may not be fored at the club's target holders at any time. Slugs may be fired at the 25 and 50 yard target holders. 2. Specific range rules for the 100z200 yard rifle range (General range rules also apply) 1. Targets must be posted only on the club's target holders at 100 yards and 200 yards. Special club -provided target holders may be posted during special events. For casual member use, the club will provide special target holders to be used at specific distances. 2. No pistol or revolver with barrel length less than 2" may be used on this range. 3. Shooters on the range must ensure that everyone is back from down range before the "commence fire" command is given. 4. Target numbers MUST NOT be used as targets. Gun Club Grate Leahy/Davis agree to continue to close and lock the Gun Club Gate located on South Carryon Road if the Gun Club is the Lessee of the City's property. In the event Leahy/Davis fail to close and lock the gate, Leahy/Davis shall be subject to liability for all damages incurred as a result of their failure to lock and close gate. 1Kcisma,tion. In the event the City desires to relocate the easement, such relocation shall occur upon the mutual consent of both parries, which consent will not be unreasonably withheld. 6. Compensation.
