The Lake Toueye Water Ski Club is proposed to provide a high quality lake site upon which
to practice tournament style slalom water skiing for a small group of club members. Lake
Toueye (which is a Ute Indian term for "good water") was formerly called the Anderson
Pond and has been used for slalom skiing for several years. The new owners of the property,
The Alleman, Nicholas, Campbell Limited Liability Corporation, purchased the site in
December of 1996. The owners desire to improve the skiing characteristics of the lake and to
make the site much more user friendly than it is today.
The proposed excavation and expansion of the lake requires special use review under the
floodplain provisions of the Garfield County Zoning Regulations. The entire lake area is
located within the 100 Year Flood Fringe of Helmer Gulch. The following descriptive text
and attachments are offered in evidence that the excavation and proposed improvements are
in compliance with Section 6.00, Floodplain Regulation of the Garfield County Zoning
Resolution of 1978 as amended.
LOCATION
The Lake Toueye site (formerly Anderson Pond) is located adjacent to and north of the Rifle
Village South subdivision and adjacent to and south of Interstate 70. The entry into the site
is approximately three miles from the I-70 Rifle Interchange via County Road 320 and
Village Drive and Browning Drive which are dedicated public roads within the Rifle Village
South subdivision. These roads are maintained by Garfield County. ( See ATTACHMENT
A, FIGURE 1, Lake Toueye General Location.)
THE SITE
The total property is approximately 79 acres with about 30 ^ores consumed by steep slopes
and wetlands in the southwestern portion of the site. The current lake provides approximately
14.4 acres of water surface and provides about 1,700 feet of length measured in the east/west
dimension of the lake.

An access easement, sixty feet in width extends from the northerly end of Browning Drive,
past the west end of the lake and then east along the north side of the lake to a 10 foot wide
underpass connecting the north and south sides of the Interstate. The easement was granted
to the Colorado Department of Transportation for the use and benefit of a group of property
owners located north of the Interstate, although the easement was recorded as an easement for
the use of the general public. There is also an unoccupied parcel (2.0 acres +/-) not owned
by the owner of the Lake Toueye Water Ski Club property located in the southeast corner of
the site as shown on (SHEET 1 OF ATTACHMENT B).
The City of Rifle wastewater treatment ponds are located immediately west of the lake site
and the sewer outfall line is located along the northern edge of the property from the easterly
end of the site to about 3/4 th of the length of the site where it turns ninety degrees and runs
southward into the site (just west of the current lake) then again turns ninety degrees and runs
west to the sewage lagoons. (See ATTACHMENT B).
Wetlands in proximity to the proposed improvement activities have been mapped and verified
by the Corps of Engineers (See ATTACHMENT B). Blocks of wetlands have been identified
southwest of the proposed lake expansion and east of the existing lake. Other wetlands may
occur south of the lake but no activities are proposed in that proximity. Also, a narrow
ribbon of wetland vegetation occurs at various locations along the shoreline of the lake.
Cottonwoods, small trees and brush also occur on the site in scattered clumps.
The lake is visible from I-70 being generally 10 to 20 feet below the Interstate elevation.
There is approximately 40 feet of grade change between the lake and the terrace to the south
where residences of the Rifle Village South subdivision are located. Most of this grade
change takes place in a very steep bank just inside the south property line.
A large part of the site is in the 100 Year Flood Fringe of Helmer Gulch. The site is not in
the floodway of either Helmer Gulch or the Colorado River. The floodplain in the area of the
proposed site improvements is described as shallow, overland sheet flow flooding, one foot
in depth.
THE PROPOSED USE AND FACILIl1 ES IMPROVEMENTS
Lake Toueye Water Ski Club will be a private membership club operated by the Owners of
the property. Fifteen "right to use" memberships are projected, each requiring annual renewal
at the option of the property Owner/Managers.
The following site and facility improvements are proposed by the Owners (See the proposed
Site Plan, ATTACHMENT B, Sheet 2):

Year One:
1. Relocate the City of Rifle sewer line.
Excavation of the lake expansion as shown on the Site Plan, (ATTACHMENT
B). This will expand the Surface area of the lake by 3 acres and extend the
operational length of the lake by 450 feet creating a more effective slalom
course. Gravel material excavated will be used to elevate the area of proposed
buildings and vehicular service to a level at least one foot above the flood
elevation provided by the FEMA Floodplain Maps. See the letter regarding the
floodplain from Zancanella & Associates, ATTACHMENT F. Additional
excavated material will be deposited between the lake and the Interstate -70
right-of-way. In some areas the fill may be mounded to create gentle berms.
Topsoil salvaged from the excavation areas will be spread on those fill areas
not used for drives and parking. All disturbed areas will be reseeded with
dryland grasses and wildflowers in October.
3. The access drive will be improved with grading, drainage and gravel surface.
4. Create membership parking including areas for storage of ski boats.
5. Initiate selective regrading of the shoreline to protect it from wave erosion.
6. Install boat ramp.
7. Install boat dock as needed to accommodate three boats.
8. Install picnic tables and BBQ grills.
9. Rest room facilities will be provided with porta-pottys during the initial years
of operation.
10. Install the slalom course buoys.
11. Seed lawn areas.
Year Two:
1. Construct a swim beach:
2. Initiate landscape plantings.
Future Improvements:
1. Construct a picnic shelter and/or shade.
Construct a clubhouse that includes rest rooms and showers, storage areas for
member's ski equipment, possibly a small kitchen facility and a covered porch.
The City of Rifle has confirmed they will sell sewer and water taps to the Club
for the clubhouse, ( See ATTACHMENT D). Water service lines are available
in Browning Drive in Rifle Village South and the sewer main line is accessible
on site. Electrical power is also available on site.
3. Continue landscape improvements.
4. Provide a facility to dispense gasoline to the members for use in their boats.
Tank provided by commercial bulk fuel supplier.
IMPACTS OF THE PROPOSED IMPROVEMENTS and ACTIVITIES
Sewer Line:
Engineering plans for the relocation of the sewer line have been submitted to the City of Rifle
for final review and approval. The City has previously given their preliminary approval of
the relocation of the line conditioned upon review of the engineering plans. The sewer line,
which is currently mounded to provide adequate soil cover will be incorporated in to the fill
areas such that there will be adequate fill over the line without a linear, elevated mound
disrupting the site.
Existing Access Easement:
The sixty foot wide public access easement will be relocated west of the proposed lake
expansion. The Colorado Department of Transportation has indicated they would be satisfied
with a relocated easement, but that the parties for which the easement was originally intended
to serve must also grant their approval. A formal request to approve the relocation has been
sent to the CDOT. Letters requesting written approval of the easement relocation have also
been sent to the other easement beneficiaries. Copies of these letters are included with this
application as ATTACHMENT E.
The relocated easement coincides with the new access drive to the clubhouse area. Fill that is
placed within the easement will be pit -run gravel which will create a stable roadway base
should the easement ever be used. It appears th't the only historic use of the easement may
have been to utilize the area north of the interstate as pasture for cattle.
Wetlands:
The two blocks of mapped wetlands on the site will not be disturbed or impacted by the

proposed excavations, fills, site improvements or recreation activities at the site. The
expansion of the lake will cause some of the shoreline wetlands vegetation to be temporarily
removed. This disruption has been authorized by the Corps of Engineers under General
Permit Number GP -045. See ATTACHMENT G for a copy of the authorization letter from
the Corps of Engineers. The authorized permit will be provided to the County as soon as it
is available from the Corps. The expansion of the total lineal footage of shoreline will create
greater opportunity for shoreline wetlands. The result of the lake expansion will be a net
increase of wetlands.
Flood Fringe:
As described in Zancanella and Associates letter (See ATTACHMENT F), the fill and.
improvements will not adversely effect the flood impacts on downstream properties. The fill
will also elevate the parking and building pads above the potential sheet flow flooding. The
lowest finish floor of any constructed clubhouse facility will be one foot above the existing
ground surface. This will assure the finish floor to be above the maximum one foot deep
shallow, overland sheet flow flooding identified in this area.

LAKE TOUEYE WATER-SKI CLUB
1 General Rules
1 Mission Statement
The Lake Toueye Water Ski Lake ("LTWSC") has been organized to provide a limited number of
members with a high quality, private site to participate in, and train for, tournament style slalom
skiing.

Annual Membership
1 • This will be a "right to use" membership only, annually renewable at the option of management.
Club members shall also be active members of the USA Water Ski, formerly, known as,
American Water Ski Association. Their address and phone number:

• Payment shall be made to "Lake Toueye Water Ski Club".
Boats
1 • Restricted to USA Water Ski approved or similar towboats (i.e., approved towboat but with
open bow). It is possible that a Club boat may be added in the future.
1 • The use of jet skis, personal water craft, fishing boats or any other type of boat (except for boats
used for safety or site maintenance) shall be prohibited.
Sailboats
1• Sailing of small boats such as Sunfish and Lasers, as well as sail boards, will be permitted at
such times as the wind prevents anyone from skiing. Flotation devices (life vest, wet suit, dry
1 suit, etc. ) must be worn by sailors at all times. Sailing privileges are for members only.

Drivers
• •
• All boat operators must be 16 years of age, have knowledge and ability to safely drive and
maneuver the boat and obey all safety rules. They-shee}h be accompanied by an adult.
• There will be a process for training drivers and only trained drivers will be permitted to drive.
This is a requirement for insurance and safety purposes as well as protection of the slalom
course and other property.

• All members are responsible to see that their guests comply with the rules of the Club.
Insurance
• Each boat -owning member must show a $500,000 liability insurance governing the use of
his/her boat. Add "Additional Insured: Alleman/Nicholas/Campbell L.L.C. dba Lake Toueye
Water Ski Club".
Usage/Rules
• Usage shall be unlimited. However, turns will be taken on a membership rotation basis.
An example of how rotation works: Maximum of three boats on the water (i.e. two on the dock
and one in the course.) Boat "A" skis for a period of six passes or ten minutes. Boat "B" skis
for a period of six passes or ten minutes and so on. Please be conscientious of your time on the
water.
• Out of courtesy, you will be asked to limit your slalom passes to six per set, or ten minutes per
turn for any other type of skiing.
• Wakeboarding, kneeboarding and other non-traditional types of skiing will be permitted.
• Tubing or similar activities will not be permitted.
• Boating activities will not be permitted between sunset and sunrise.
• Dock your boat only in designated areas.
• Skiers must always swing to the right (drivers side) of the boat whenever stopping to rest,
shorten the rope, or ski into the dock.

Usage/Rules (Continued)
• No person shall sit on the side or back of a boat while it is moving.
• There shall always be an observer in the boat in addition to the driver while a skier is being
towed. A life vest for each occupant of the boat must be in the boat at all times.
✓ • Only one boat at a time may use the slalom course. All others must wait a turn at the designated
waiting area. Please be ready when it is your turn. This means dry suit, vest, gloves, etc.
Please wait on the dock or designated area for your boat to pick you up.
• Swimming shall be permitted only in designated areas. Small children must swim with life
vests and adult supervision. Lake Toueye has a sharp drop off, with no underwater visibility.
Drowning prevention is paramount.
• Pets: Please, leave them home. If you must bring them, they must be under your strict control.
You will be,responsiblp for their actions and will be expected to clean up after them. 41 Nt l 14c

• Each member is responsible for keeping his/her area clean by disposing of trash daily, as well as,
keeping weeds and water areas clean.
• Members are responsible for replacing slalom buoys when they are knocked off!
• No skiing, driving or riding in the boat if alcohol has been consumed! NO EXCEPTIONS TO
THIS RULE.
• Fishing is permitted by owners, members, families and guests anytime it does not interfere with
boats or water-skiers.
• Renewed membership is based on participation in site improvement, preparation, maintenance,
and working with owners to continually improve the Lake Toueye site.
Closing Statements
• Rules and regulations may be changed by the owners at any time for the safety and enjoyment of
the members.
• Lake Toueye has been created to provide a safe, family oriented tournament type ski site
that will provide a high quality environment for training and recreation.
Failure to comply with all lake rules stated above will result in termination of membership.

I contacted you a few months ago to ask the proper procedure for the realignment of
Easement E- 307 of Sheet 8 1 70-1(12) Sec 3. I was informed at that time that we
needed to provide a plan for the approval of Colorado Department of Transportation.
I was also informed that this easement was not used by CDOT but was provided by
them to provide access to the property owners on the North side of Interstate 70.
Enclosed is the plan that we discussed for the realignment of the road. We have sent
letters to these land owners asking for their approval. We would like at this time to ask
your approval on these plans so that our client may proceed with his lake expansion.
We have also attached copies of the letter to the landowners.

We are writing in regards to your properties located in Township 6 South Range 93
West located in the SEY4 of the SW' and the Northern'% of the SW%4 of Section 17,
near Rifle Colorado, see attached USGS map. Mr. Alleman owns the property to the
south of your property and wishes to enlarge the lake on his property. The enlargement
of the lake would by necessity require the relocation of your access to the proposed
new road.
On behalf of our client Lee Alleman, Zancanella and Associates, Inc. was asked to
contact you regarding the proposed realignment of an easement on the Alleman
property that provides access to your property. The proposed new alignment should
allow for year round access to your property. The enclosed map shows both the
existing and the proposed easements. Prior to making the lake improvements we would
like your approval. If the proposed changes are acceptable, please sign and return a
copy of the following page to our office. We will then develop a legal description and
prepare documents abandoning the existing easement and replacing them'with new
easements with the same basic dimensions as the existing. No physical work will be
performed until you have had an opportunity to review and sign the final document,
however your cooperation in this matter would be appreciated.

This letter has been prepared to discuss the effects to the flood plain from proposed
construction activities and improvements related to the enlargement of Lake Toueye and
the relocation of an existing sewer line. Lake Toueye (formerly known' as Anderson Pond)
is located in Garfield County, Sections 17 & 20, Township 6 South, Range 93 West of the
6th P.M. The approximate location of the lake is shown on the attached General Location
Map Figure 1. The lake is generally located southwest of the City of Rifle, is bordered on
the north by Interstate 70, and on the south by the Rifle Village South subdivision. Lake
Toueye is the result of gravel mining excavation activities and is below the original ground
surface on the property. The lake has been utilized for water skiing activities over the last
several years.
The proposed expansion of the lake involves increasing the surface area by approximately
3 acres to improve water skiing accessibility. The expansion of the ski lake will involve
excavation below the existing ground surface to a maximum depth of between 6 to 8 feet.
The future development of the property could also include the construction of a club house
facility, boat docks, and skier facilities on the northern shoreline. The proposed expansion
of the lake and the development of the water ski facility is shown on the attached Sheet
No. 1.
Review of the flood insurance rate map for Garfield County Panel No. 0802051353-B (see
attached map) indicates that the area for the proposed lake expansion is within the
designated 100 year flood plain. The proposed areas of activity are within Zone AO which
is classified as having a water depth of one foot (above existing ground surface elevations)

and a velocity of four feet per second. We believe this area is classified as "floodway
fringe" and not floodway. Review of the mapping indicates the floodplain is a result of
bank overtopping of Helmer Gulch. Some shallow flooding from the Colorado River is, also
possible.
The analysis for Helmer Gulch in the Flood Insurance Study did not involve standard
hydraulic modeling efforts, but rather was analyzed based on alluvial fan flooding
techniques applied to the area below the mouth of the canyon at Rifle Village South. We
believe the large blanket coverage of Area AO in the mapping was conservatively
overestimated. This includes areas in the Rifle Village South development. Nonetheless,
the proposed improvements at the lake must not increase flood levels to both upstream
and downstream properties. Due to the nature of the improvements at the lake, the
proposed activities will not increase any backwater conditions that will affect upgradient
landowners.
We believe excavation for the new lake area would provide additional detention storage
capability above the normal water line and therefore improve existing flood plain
conditions. Excavated material from the lake will either be hauled from the site, deposited
in the deeper portions of the existing lake, or be placed as fill on the property. Material
placed in the lake or hauled from the site will have no effect on the flood plain
characteristics. Material placed on site could potentially increase water levels locally at
the site but should not increase the timing or magnitude of flows to downstream locations.
It is our opinion that other than local effects to the site the proposed activities do not
present any increased flooding hazards to downstream locations.
To protect on site improvements at the lake we recommend that the club house facility
have the lowest floor elevation be constructed a minimum of two feet above the existing
ground elevation. This elevation for the proposed clubhouse would be approximately
5274' which would also place the structure above the adjacent Colorado River 100 -year
flood elevation of 5272' which was extrapolated to the property from the flood insurance
maps.

We have reviewed your plan for expanding Lake Toueye and
stabilizing a bankline segment of the lake. The project site is
located in Sections 17 and 20, Township 6 South, Range 93 West,
Garfield County, Colorado.
This project will have minimal individual and cumulative
effects on the aquatic environment. We have also made a "no
effects" determination on endangered species.
The Corps of Engineers, Sacramento District, has issued
Regional General Permit Number GP45 to authorize certain limited
discharges of dredged material associated with minor excavation
projects. Based on our review of the information submitted, the
excavation aspect (less than 250 cubic yards) of the project is
authorized by this regional permit subject to the enclosed permit
conditions. All of the dredged material, excluding the amount
for the bank stabilization work, will be placed in an upland
disposal site.
The Chief of Engineers has also issued nationwide general
permit number 13 for bank stabilization. Your limited bank
stabilization project (less than 500 feet and less than an
average of one cubic yard per running foot) can be constructed
under this authority provided the work meets the enclosed terms
and conditions of the permit. We note that you will be sprigging
willow cuttings along the reconstructed bankline to create a
vegetated shoreline and to promote added stability.

11. The Anderson Well No. 1 was awarded 3.46 c.f.s., conditional
in Water Court Case No. W1310 with an appropriation date of August
31, 1960 for irrigation, domestic and all other beneficial uses.
In Case No. 85CW219, the point of diversion of said well was
changed to the NE'NW' of Section 20, T. 6 S., R. 93 W. of the 6th
P.M., at a point whence the NW Corner of said Section 20 bears N.
85°40'38" W. 2146.09 feet.
12. Applicant requests that the Anderson Pond No. 1, East-West
Enlargement be established as an alternate point of use and
diversion for the Anderson Well No. 1 as decreed in case No. W-1310
to compensate the Colorado River for evaporation losses as
described above.
13. At those times when the Anderson Well No. 1 is not in priority
or cannot otherwise be utilized as a replacement source for the
above described evaporation losses, releases will be made from
Ruedi Reservoir or Green Mountain Reservoir.

Applicant may contract from the West Divide Water Conservancy
District for up to twenty (20) acre feet of water from Ruedi
Reservoir whose source is the Fryingpan River and it's tributaries.
Ruedi Reservoir is an on channel reservoir located in the NW;NE of
Sec. 18, T 8 S., R 84 W., of the 6th P.M. Ruedi Reservoir was
originally decreed for 140,697.3 AF in Civil Action No. 4613,
Garfield County District Court on June 20, 1958, with an
appropriation date of July 29, 1957, for hydroelectric power
generation, irrigation, municipal, domestic, industrial,
piscatorial, and stock watering uses. Subsequently, in Case no. W-
789-76, Water Division No. 5, the amount of water decreed to Ruedi
Reservoir was reduced from 140,697.3 AF to 101,369 AF. An
expected transit loss from Ruedi Reservoir to Rifle, Colorado of
one (2) acre foot (10%).
Applicant may contract for up to twenty (20) acre feet of
water from Green Mountain Reservoir to -cover the evaporation losses
of eighteen (18) acre feet and an expected transit loss from Green
Mountain Reservoir to Rifle, Colorado of two (2) acre foot (10%).
Green Mountain Reservoir is located on the Blue River in
Summit County, Colorado, tributary to the Colorado River. Said
Reservoir was decreed 154,645 acre feet of water with an
appropriation date of August 1, 1935, in U.S. District Court for
Colorado in Consolidated Case Nos. 2782, 5016, and 5017.
14. The Referee, having examined the information submitted by the
Applicant, and having completed the investigations necessary to
make a determination in this matter, does therefore conclude that
the above entitled Amended Application should be granted and that
the above-described claims should be and hereby are approved as
requested; SUBJECT, HOWEVER TO ALL EARLIER PRIORITY RIGHTS OF
OTHERS, and to the integration and tabulation by the Division
Engineer of such priorities and changes of rights in accordance
with law.
15. Application for a Finding of Reasonable Diligence shall be
filed in the same month as the decree herein is entered every six
years after the entry of the Decree herein so long as Applicant
desires to maintain the conditional water rights herein awarded, or
until a determination has been made that such conditional right has
been made absolute by reason of the completion of the
appropriation, or is otherwise disposed of.
16. The Change of Water Right and Plan for Augmentation will not
injuriously affect the owner of or person entitled to use water
under a vested water right or a decreed conditional water right,
and the Plan for Augmentation is hereby granted and approved in
accordance with C.R.S. 1973, 37-92-305(3) and subject to the
Court's retained jurisdiction.

17. Applicant shall install, such measuring devices as deemed
necessary by the Division Engineer to administer this plan.
18. Pursuant to C.R.S. 37-92-305(8), The state Engineer and the
Division Engineer may lawfully be required under the terms of this
Ruling to curtail out -of -priority diversions from Applicants'
pond/well at any time when the consumptive use associated with
Applicant8' uiversion exceed the net amount of replacement water
available, if necessary, under this Plan for Augmentation.
19. Applicant shall develop a monthly accounting form satisfactory
to the Division Engineer.
20. The State Engineer shall issue a well permit for the subject
well/pond enlargement as described above and subject to the
provisions of this Ruling.
It is accordingly ORDERED that this Ruling shall be filed with
the water Clerk subject to Judicial review.

In accordance with the Grady McNure letter dated January 23, 1997, Zancanella and
Associates, Inc., is requesting that a Regional General Permit Number GP -045 or Nation
Wide Permit #13 be issued for the work proposed at Lake Toueye in Rifle, Colorado. The
permit applicants would be:

2. The proposed work would be to enlarge the existing Lake Toueye by approximately
3.0 surface acres. The material to be excavated is comprised mostly of pit run
gravel 6 inches to 18 inches in diameter. We estimate that there will be
approximately 9" of top soil or approximately 3,600 yards. In addition, there will
also be approximately 17,000 yards of pit run gravel material. The material will be
excavated from the area shown on the attached map and will be deposited on the
upland areas designated for fill. (See Figure 1)
The Lake Toueye Ski Club would also like to place some of the fill along the bank
of the existing lake to flatten the slope of the lake bottom and improve bank
stabilization. This lake was originally constructed as a gravel mine. The existing
lake banks are steep and slough into the lake on a regular basis. This prevents the
establishment of vegetation which would provide wetland type habitat. We believe
this fill could be authorized under a Nation Wide Permit #13. If this is not possible,
then we are prepared to place the material excavated from the proposed lake
expansion in the upland areas shown in Figure 1.

The proposed lake expansion will divert water from groundwater sources for
evaporation. An augmentation plan approved by the Division 5 water court in Case
95CW147 has been obtained to replace these evaporative losses. The evaporative

Dear Mark:
The purpose of this letter is to summarize the status of the tide, water supply and access
rights for the Alleman property. Attached is a copy of the General Warrantee Deed, dated
December 18, 1996, which conveyed the subject property from Francesca Real. Estate
Corporation to Alleman. Nicholas, Campbell Group, LLC, and a copy of the Quit Claim Deed
for the water rights.
The Applicant's predecessor in interest to the property adjudicated an augmentation plan
for the Anderson Pond No.1, and its East-West Enlargements, in Case No, 95CW147, Water
Division 5. A copy of the decree, entered September 17, 1996, is attached. The plan utilizes
Anderson Well No. 1 as a source of water to augment the evaporation losses from the Pond,
Further, at times when Anderson Well No.1 is out of priority, the Applicant is authorized to use
water from either Green Mountain Reservoir or Ruedi Reservoir as a replacement source for the
evaporation losses.
Allenzan has a right of access to the property via a dedicated public right-of-way through
Rifle Village South. Yet to be determined is whether the right-of-way is County or privately
maintained. If it is maintained by the homeowners, the Applicant will negotiate a plan for
contribution to its maintenance with the homeowners. I do not anticipate that this will be
difficult and I believe that the Applicant's right of access is secure

THIS EASEMENT DEED made this day of , 1997, between ALLEMAN,

"Grantor") and the ESTATE OF LOLA MARIE ANDERSON, whose address is 3036 East Hindale

That the Grantor, for and in consideration of Ten Dollars and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, has remised, released, sold,
conveyed and quit claimed, and by these presents does remise, release, sell, convey and quit claim unto
the Grantee, his successors and assigns, forever, all the right, title, interest, claim and demand which
the Grantor has in and to the real property, together with improvements, if any, situate, lying and being
in the County. of Garfield, and State of Colorado, described as follows:
A non-exclusive easement, described on Exhibit A, for the purpose of access to Grantee's
property, which is described on Figure 1; both Exhibit A and Figure 1 are attached hereto and
incorporated herein by this reference. Grantee's property is described as a two acre -parcel for one
single-family homesite, shown on Figure 1, labeled "Grantee's 2 Acre Parcel."
Except as granted in the first paragraph above, any and all easements whether of record or
adverse or prescriptive in nature for access to the property of Grantee, as it is shown on Figure 1,
labeled "Grantee's 2 Acre Parcel," traversing across the property of Grantor, as it is shown on Figure
1, are herein vacated, abandoned and relinquished to Grantor.
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and
privileges thereunto belonging or in anywise thereunto appertaining, and all the estate, right, title,
interest and claim whatsoever, of the Grantor, either in law or equity, to the only proper use, benefit
