PROJECT INFORMATION
A. DESCRIPTION OF THE PROPOSAL: It is proposed to use a
nstruction for uP to three ( 3 )
commerciat uses on a 1.05 acre lot. The present
construcLion will not allow certain types of uses due to
fire waIl separation requirements; thus, welding shops, auto
body painting, and laundromats are not proposed as potential
tenants. AIl other uses will be uses allowed in the
Commercial/Limited zone district as uses by right. The
building will have a weII as the source of water and an
individual sewage disposal system. The main public access
will be from the Hwy 82 Frontage Road. There will be a
driveway off County Road 114 for access to a fenced vehicle
storage area.
MAJOR ISSUES AND CONCERNS
1. ZONING: Garfield County zoning Resolution only aIlows one
Fffi?fpal use on a ]ot. To have more than one use on a lot,
a Commercial Park Special Use Permit is required. This
proposal would allow three (3) principal uses on the 1ot.
ffre- C/i, zone disLrict aIlows a number of dif ferent uses that
may not be allowed on the property based on the present
aeiign of the building and the Individual Sewage Disposal
system (ISDS). The building code would not allow uses such
ai a dry cleaning establishment, auto body paint shop, or
welding shop, due to certain code requirements. Any use
exceeding tha design capacity of the ISDS also limiEs some
of the uses. These Limitations can change, based on
remodeling the structure and/or expanding the size of the
ISDS. Rither than specify the uses allowed ' a general
condition of approval stating that prior to any tenant
occupying a spale in the building, the owner of the building
sha11 notity the Building, Sanitation & Planning Department
of the proposed use, to determine whether or not the use

meets the building codeof the County.

The access off County Road 114 wiIl require an approved
driveway permit from the Road and Bridge Department prior to
issuance of a Certificate of Occupancy or Special Use
Permi t .
III.SUGGESTED FINDINGS
1. That proper publication and public notice was provided as
required by law for the hearing before the Board of County
commissioners.
2. That the hearing before the Board of County Commissioners
was extensive and complete, that all pertinent facts,
matters and issues were submitted and that aII interestedparties were heard at the hearing.
3. Eor the above stated and other reasons, the proposed use is
in the best. interest of the health, safety, morals,
convenience, order r prosperity and welfare of the ciEizens
of Garfield County.
IV. RECOMMENDATION
APPROVAL, with the following conditions:
I . A11 representation of the applicant, either within the
application or stated before the Board of County
Commissioners, shaII be considered conditions of approval
unless stated otherwise by the Board.
That the applicant submit proof of an approved driveway
permit for the access point onto County Road 114.
That the applicant or property owner shall notify the
Garfield County Building, Sanitation & Planning Department
prior to the installment of any new tenant or expansion of
existing tenants on the site, to allow for verification of
compliance with the Zoning Resolution, Building Code, and
Individual Sewage Disposal System Regulations.
That the applicant shall have L2O days from the date of the
Resolution of CondiEional Approval to meet alI conditions
set forth in the ResoluEion. The Special Use Permit shall
be issued when all conditions are met and shall expire L20
days after issuance unless use has commenced.
