ACKNOWLEDGEMENT OF PARTIAL SATISFACTION
SUBDryISION IMPROVEMENTS AGREEMENT
KNOWALL MEN BYTHESE PRESENTthat:
WHEREAS, Anneliese K. Allen (hereinafter Owner/Subdivider), entered into a Subdivision
lmprovements Agreernent with the Board of County Commissioners of Garfield County, Colorado
(hereinafter "Board") dated December 18, 1998, recorded inBook I105, at Page272 as Reception
No. 537532 of the Garfield County records on December 18, 1998, for the improvements of
Mountain Meadows at Prince Creek subdivision; and
WHEREAS, the obligations ofthe Owner/SuMivider have been partially satisfied, as verified
in a statement from David M. Kotz, P.E. ,Schmueser Gordon Meyer, Inc. dated February 4, 1999,
and Owner/SuMivider agrees that the Board shall retain and hold the sum of $l1,533.80, which sum
shall be security for performance for work remaining to be completed consistent with various
unaompleted improvements described in the Subdivision Improvements Agreement.
NOW THEREFORE, at the request of Owner/Subdivider and in consideration ofthe
premises and prior agreements, the Board Qe partial satisfaction of the
Subdivision Improvements Agreement entered into
Mountain Meadows at Prince Creek, and releases

RE: Mountain Meadows at Prince Creek
Partial Comoletion of Drainaqe lmorovements
Dear Mark:
On February 2, I conducted a site visit to Mountain Meadows at Prince Creek for the purpose
of observing the drainage modification work performed by M & M Construction The various
work itemsire detaited on SGM's 1Ol22lg1 revision to the Mountain Meadows Drainage and
Utitity Plan, Sheet 3 of 5, and was summarized in John Schenk's November 19, 1998, to Rick
McClellan. I transmitted an engineer's cost estimate to John Schenk in a December 7, 1998
letter. Copies of both these documents are attached.
The M & M Construction December 18, 1998, invoice (attached) requests payment associated
with materials on hand and the completion of item Nos. 2. 4, 5, 6, 7, 10 and 11. A field
check of each of these items revealed that the work completed was commensurate with this
billing and in accordance with the approved plans and specifications' The remaining work will
be cJmpleted in the spring when the snow cover has left and the ground has thawed' I would
recommend pafiial paymlnt in theamount ol t6,22O.2O to M & M Construction.
