Smith John Martin Larry McCown Don DeFord Absent Board of County Commissioners for Garfield County, , Garfield County Courthouse, in Glenwood Springs on A.D. 19 97 , there were present: Mildred Alsdorf Chuck Deschenes , Commissioner Chairman , Commissioner Chairman Pro -Tem , Commissioner ,County Attorney , Clerk of the Board , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 97-71 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT FOR JOHN LYONS WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from John Lyons for a two-family dwelling on the following described tract of land: 8711 County Road 300, Parachute (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 28th day of July 1997, upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. For the above stated and other reasons, the proposed Special Use Permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit be and hereby is authorized permitting the use of the above described tract of land for a two-family dwelling, upon the following specific conditions: 1. That all representations by the applicant made beforethe Board of County Commissioners shall be conditions of approval, unless otherwise stated. 2. That the two-family dwelling shall meet all applicable portions of the 1994 Uniform Building Code, as adopted by Garfield County and that the structure shall be required to receive a building permit and all required inspections. 3. The basement dwelling unit shall not receive a Certificate of Occupancy from the Garfield County Building Department until all inspections are conducted and passed. 4. The minimum defensible space distance for structures shall be 30 feet on level terrain, plus appropriate modification to recognize the increase rate of fire spread at sloped sites. The mehodology described in "Determining Safety Zone Dimensions, Wildfire Safety Guidelines for Rural Homeowners," (Colorado State Forest Service) shall be used to determine defensible space requirements for the required defensible space within building enveloped in areas exceeding five (5) percent grade. The lot owner shall be responsible for noxious weed control on the subject lot. Dated this 5th day of August , A.D. 19 97 .
