PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: Two -Family Dwelling Special Use Permit
APPLICANT: John Lyons

I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The subject property is located in the City/Subdivision (Parachute/Battlement Mesa) District,
according to the Garfield County Comprehensive Plan's Management Districts Map (1981;
1984).
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The subject tract is 10.7 acres in size, located east of the Colorado
River, north and west of Battlement Mesa PUD, at 8711 County Road 300. The
proposed, two-family dwelling is currently under construction near the base • a slope
and a small pond is located west of the structure. See site map, page •
B. Adjacent Land Uses: Land uses adjacent to the subject property are largely
resential, with limited agricultural uses in the vicinity. See vicinity map, page

C. Development Proposal: The original building permit was approved for construction
of a single family dwelling, which was converted into a two-family dwelling without
Board of County Commissioner review or approval. The applicant is now seeking a
Special Use Permit for a two-family dwelling that would bring the existing structure
into compliance with zoning regulations. See building permit information, pages
(4 . Subject to conditional approval of the proposed two-family dwelling, the
applicant would proceed with legitimizing the structure with Building Department
approvals.
III. MAJOR ISSUES AND CONCERNS
A. Zoning: The property is zoned A/R/RD, which allows a two-family dwelling, upon
review and issuance of a special use permit. All special uses are required to meet
certain criteria regarding infrastructure such as adequate roads, water and sewer
service and the use of landscaping to minimize impacts and protect the established
neighborhood character. The Town of Parachute will supply water to the structure;
wastewater will be treated by an approved ISDS; County Road 300 appears to be
adequate for the residential traffic associated with the proposed two- family dwelling
and the use of customary landscaping should be sufficient in maintaining the
established character of the neighborhood.
B. Water Supply: The structure is currently served by the Town of Parachute, municipal
water supply system, which is an adequate legal supply. The Town has submitted a
letter noting that the supply "is adequate for domestic purposes." See letter, page

C. Wastewater Treatment: The original building permit and ISDS permit were approved
for the construction of a four bedroom dwelling, pursuant to a geotechnical analysis
of the site. The existing structure has been constructed with four (4) bedrooms and
two kitchens and utility rooms. Staff has discussed the design of the ISDS with the
County Building Official, who confirms that the existing facilities are capable of
treating he wastewater generated by the two-family dwelling. See ISDS information,
pages '11 .
IV. SUGGESTED FINDINGS
1. That proper publication and public notice was provided as required by law for the
hearing before the Board of County Commissioners.
2. That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that hearing.
3. That the application is in compliance with the Garfield County Zoning Resolution of
1978, as amended.

4. For the above stated and other reasons, the proposed use is in the best interest of the
health, safety, morals, convenience, order, prosperity and welfare of the citizens of
Garfield County.
V. RECOMMENDATION
Staff recommends APPROVAL of the Two -Family Dwelling Special Use Permit, pursuant
to the following conditions:
1. That all representations by the applicant made before the Board of County
Commissioners shall be conditions of approval, unless otherwise stated.
That the two-family dwelling shall meet all applicable portions of the 1994 Uniform
Building Code, as adopted by Garfield County and that the structure shall be required
to receive a building permit and all required inspections.
3. The basement dwelling unit shall not receive a Certificate of Occupancy from the
Garfield County Building Department until all inspections are conducted and passed.
4. The minimum defensible space distance for structures shall be 30 feet on level terrain,
plus appropriate modification to recognize the increased rate of fire spread at sloped
sites. The methodology described in "Determining Safety Zone Dimensions, Wildfire
Safety Guidelines for Rural Homeowners," (Colorado State Forest Service) shall be
used to determine defensible space requirements for the required defensible space
within building envelopes in areas exceeding five (5) percent grade.
The lot owner shall be responsible for noxious weed control on the subject lot.

25, Article 10 C.R.S. 1973, Revised 1984.
2. This permit is valid only for connection to structures which have fully complied with County zoning and building requirements. Con-
nection to or use with any dwelling or structures not approved by the Building and Zoning office shall automatically be a violation or a
requirement of the permit and cause for both legal action and revocation of the permit.
