Please find attached with this memo additional information as prepared by
Cordilleran Compliance Services on behalf of Noble Energy for an Evaporation
Facility (July 2006). Those Commissioners involved with the original meeting hetd on
June14, 2006 will be the only members to act on this request and are as follows: Phil
Vaughn, cheryl chandler, Bruce Jenson, Bob Fuilerton, sean Martin. As the
Commissioners will remember, the meeting was continued to allow the Applicant
more time to submit additional information concerning the requested facility.
Cordilleran has been retained to represent Noble energy on this request. Attached in
the submittal materials is a letter authorizing Cordilteran to act as Noble's agent on
this matter.
Additional information has been submitted to assist the Commissioners in reviewing
this request and ultimately make a recommendation to the Board of County
Commissioners. Found in the additional submitted information, greater detail has
been given to lndustrial Operations and Standards, narrative, site design plans,
impact statement, and associated permits.
Staff would opine this application completes the original application and should give a
solid basis for making a recommendation to the BOCC.
Staff is recommending Planning Commission recommends approval to the Board of
County Commissioners for the Special Use Permit to allow and evaporative pond
with the following conditions of approval:
That all representations of the Applicant, either within the application or stated at
the hearing before the Board of County Commissioners, shall be considered
conditions of approval unless explicitly altered by the Board.
That the operation of the facility be done in accordance with all applicable federal,
state, and local regulations governing the operation of this type of facility. lncluding
but not limited to $5.03. 07, 55.03. 08 and 53.02 of the Garfield County Zoning
Resolution of 1978, as amended.

That the Applicant shall submit all local, state, and federal permits prior to issuance
of the Special Use Permit.
That the operation of the facility shall be for the use of produced waters only from
Noble Energy operations.
That the Applicant shall submit calculations veriffing anticipated flows of theexisting ephemeral drainage channel that will ne routeO around the evaporation
facilities.
That the lighting of the facility shall be inward and downward facing with fuil cutoff
fixtures and that no light shalltrespass off the property.

and skim. On a quarterly basis, the Monitoring wetts shall be comprehensivelytested for TDS, total petroreum hydrocarbons OpH), benzene, toluene,
ethylbenzene and xylene (BTEX). On a bi-yearly basis, Wailace Creek and SpringCreek both located_Utrylone quarter miie of-the proposed evaporation facil{shall be tested for TDS, TPH, and BTEX. All samples drawn shall be submitted toa third party, certffied laboratory for analysis. Within a reasonable time after arequest, these analyses shall be made available to Garfield County andsurounding area property owners.
As per 59.03.05 which allows Periodic Review, the Special Use permit shall bemade subject to a review at six (6) months from the date of lssuance of the Sp;.,r;Use Permit. The purpose of such review shall be to determine compliance ornoncompliance with any performance requirements associated with the granting ofthe Special Use Permit. Such review shall be conducted in such ,an,ie, and'bysuch persons as the County Commissioners deem appropriate to make the revieweffective and meaningful. Upon the completion of the review, the Commissionersmay determine that the permit operations are in compliance and continue thepermit, or determine the operations are not in compliance and either suspend thepemt or require the permittee to bring the operation into compliance by a certainspecified date. lf a determination is made that the Permit shall be modified orrevoked, a Public Hearing shall be scheduled as per the County regulations atsuch time to proceed with said action. Dear Mr. Wheeler:
Noble Energy, lnc. is seeking approval of a conditional use permit in Garlleld County, Colorado
for the sole
-purpose of permitting the construction and operation of the Hyrup Evaporation
Facility on a77- acre portion of a larger 480-acre parcel owned by John V. and Phyllis Hyrup'
As you are aware, a Special Use Permit Application packet for this project was submitted by
Wagon Wheel Consulting in April, 2006 and is currently under review by the Garfield County
Planning Commission.
Cordilleran Compliance Services lnc. has been retained by Noble Energy, lnc. to complete the
application process for the Hyrup Evaporation Facility. Review of the original submission, as
well as discussion with the Garfield County Planning Department, revealed the original
submission lacked pertinent information. Due to the insutficiency of the original submission, a
new, more complete application packet has been prepared for your consideration. Per your
request, one copy is being sent directly to you and 14 copies are being sent to the Garfield
County Building Department Office in Glenwood Springs.
The structure of this second permit application submission addresses the questions and
concerns raised in the Garfield County Building and Planning's Special Use Permit application
and pertinent sections of Resolution 5.03, This submission has also taken into account the
qresiions raised by the Garfield County Building Commission during the meeting that was held
on June 14,2006. All corresponding documents (i.e. Site Design Plans; Vicinity Maps, County
Assessor's Maps; Legal Description and Deed; Letter of Acting Agent; Stormwater Management
Plan; Spill Prevention, Control and Countermeasure Plan; Wildlife Assessment; lntegrated
Vegetation and Noxious Weed Management Plan; Geotechnical Survey; lmpact Statement;
Asiociated Permits; Site Photo Log; Public Notice; and Agreement to Pay Form) have been
included in this submission.
The Lease Agreement included in AppendixT of the permit application is an unsigned copy of

1. BACKGROUND
The Building and Planning Department is in receipt of a Special Use Permit (SUP) application
for "storage, Processing, and Material Handling of Natural Resource" for an Evaporative
Pond that will take place on a 480 acre parcel, leased by Noble Energy. The property is
located approximately eight miles southwest of Parachute, Colorado, the south Yzporlion ol
Section 2, T 8 South, R 96 West. The proposal is to gather produced water from Nobel
Energy's natural gas well sites and for the evaporation and recycling of produced waters.
The applicant has submitted a COGCC permit Application for a Centralized E&P Waste
Management Facility. Also, a permit application for "Notice of lntent to Construct a Non-
Jurisdictional Water lmpoundment" has been submitted. As far County permit applications, a
grading application has been submitted. lt appears the disturbance of land will be great
enough to require the applicant submit a Storm Water Management Plan. lf approved, the
applicant shatl submit all required Federal and State Permits or Plans priorto issuance of this
Special Use Permit.

2. PROPOSAL
Hyrup Energy is proposing a phased Evaporative Pond system on a77 acre project site. The
ponds will be phased over time; total number of ponds for the project will be four (4). The
drilling, completion, and production of natural gas generate brackish water (produced water).
This water will be placed in ponds to be partially evaporated, stored, and re-used. The
applicant stated that by treating and reusing the water this facility will reduce the need for
fresh water for natural gas drilling operations.
Water wil! either be piped to the site or trucked on-site. Once there, the water will initially be
stored in skimming tanks to allow the removal of hydrocarbons. Once removed, the
hydrocarbons will be stored on site and eventuatlytrucked off the facility. Afterthe skimming
ponds, the water goes to settling ponds, allowing suspended solids to settle to the bottom of
the pond. After the settling ponds, the water will be routed through pipes that are equipped
with sprinklers. The water will then be sprinkled unto lined tiered pads. The lined pads will be
heated from passive solar energy and allow evaporation of water. After flowing across the
pads the treated water will be stored to be used again in drilling operations. The tanks and
ponds will be either aerated or treated with bio-sides to reduce the production of bacteria and
mitigate odors.
3. GENERAL REQUIREMENTS FOR ALL SPECIAL USE PERMITS
55.03 Conditional and Special Uses (Zoning Resolution of {978, as amended)

Staff Commenb: Once construction is complete, the facility will not require water or sewer
service. The system will be monitored on a daily basis by Nobel Energy.

the proposed use and to provide safe, convenienf access to the use shall
either be in place or shall be constructed in conjunction with the proposed
use,
Staff Gomments: Garfield County Road and Bridge Department has not issued a specific
access permit for this project. During construction, traffic on CR 306 will increase. After
completion of the project, the site will be monitored on a daily basis. The applicant has stated
the traffic to and from the site should be minimal and possibly limited to one truck to and from
the site daily for routine inspections.
2. Design of the proposed use r.s organized to minimize impact on and from
adjacent uses of land through installation of screen fences or landscape
materials on the periphery of the lot and by location of intensively utilized ateas,

access points, lighting and signs in such a manner as fo protect established
neighbo rhood character.
Staff Comments: The applicant is proposing berming along the evaporative ponds. The
sprinkling system is angled such that water will be sprayed in a more horizontal direction and
will be an automated system to shut down in the event of high winds. The wind speed at
which the system will shut down is not stated in the application. The site is located in an area
of trees that will help mitigate impacts. The applicant has stated that the site will be visible to
residents of the Spring Creek and Wallace Creek areas. Berming and naturalvegetation are
proposed as mitigation measures to surrounding properties.
55.03.07 lndustrial Operations
(1) The applicant for a permit for industrial operations shall prepare and
submit to the Planning Director ten (10) copies of an impact statement on
the proposeduse describing iE location, scope, design and construction
schedule, including an explanation of its operational characfer.sfics.
One (1) copy of the impact statement shall be filed with the County
Commissioners by the Planning Director. The impact statement shall
address the following:
(A) Existing lawful use of water through depletion or pollution of
sufiace run-off, stream flow or ground water.
Staff Gomments: The ponds will be lined. French drains and a monitoring wellare proposed
shouldtheliningofthepondsleak. ltisunclearifa45milor60millinerwillbeused. Staffis
recommending that the strictest of application be used in the lining of the ponds. The existing
ephemeral drainage channel is proposed to be routed around the evaporation facilities.
Calculations verifoing anticipated flows should be submitted. It is anticipated that the water
that is initially used for the drilling operations and eventually treated at the facility is of legal
acquisition and use. Additionally, staff is requesting that this facility be used only for Nobel
produced water.
(B)lmpact5 on adjacent land from the generation of vapor, dust,
smoke, noise, glare or vibration, or other emanations.
Staff Comments: The applicant is proposing to use pumps to power the sprinkler system.
These pumps will be housed and shall meet all sound regulations as set for by the State.
Glare will be produced by the ponds; the applicant has not addressed how this will be
mitigated
(C) lmpacts on wildlife and domestic animals through the creation of
hazardous altractions, alteration of existing native vegetation,
blockade of migration routes, use patterns or other disruptions.
Staff Comments: The applicant has submitted a wildlife inventory and study of the possible
impacts of the evaporative facility. The study states: "Construction and operations of the
Hyrup Evaporative Ponds and loss of this sagebrush meadow will displace direct use of the
site by many species. Wildlife identified to use the site is wintering mule deer, elk, wild
turkey, Brewer's 6parrows, and western bluebirds. Mitigation measures proposed in the study
are as follows:
a. lmprove the remaining sagebrush by mechanical removing of pinion pine or Utah
Juniper.
b. Chopping or mowing a portion of the older more senescent sagebrush to encourage
grov'rth of new sagebrush.Yrvlrrrr v! rrvrr esv
Removing all or a portion of domestic livestock grazing.
Park all construction vehicles on a previously disturbed lands during construction to
further red uce d isturbances.
Reseed disturbed areas with native grasses and shrubs as well has introduce short
lived but highly wildlife-desirable, non bloating Iegumes.
Removal of wildlife unfriendly fencing.
These suggestions are rather far reaching. Staff is recommending the applicant pursue these
measures within close proximity of the operation. lt is unclear how the bio-side treated water
will affect water fowl habitat within the area. Staff is requesting the applicant address this
issue prior to the item going before the BOCC. The site will be chain-link and barb wire
fenced at the top to protect wildlife.
(D) Affirmatively show the impacfs of truck and automobile traffic to
and from such uses and their impacb to areas in the County.
Staff Gomments: During the construction phase, vehicles and equipment will be parked on
the facility site and will not be allowed to block or hinder normaltraffic. Once construction is
complete the applicant has stated that traffic will minimal. The stated traffic to and from the
site after construction is completed will be one trip to and from the site for normal facility
inspection. The site is planned in phases. The timing of the phasing is not addressed in the
application materials. lt is unclear to staff the duration of construction for each phase and
how long it will take for complete construction of all four evaporation ponds.
(E) That sufficient distances shall separate such use from abutting
property which might othetwise be damaged by operations of the
proposed use(s).
Staff Commenb: The applicant has stated the site is near a County road and within sight
distance of local residents. Berming and natural vegetation are proposed as mitigation
measures.
(F) Mitigation measures proposed for all of theforegoing impacb
identified and for the standards identified in Section 5.03.08 of this
Resolution.
Staff Comments: Please see previous comments concerning mitigation measures.
(2) Permits may be granted for those uses with provisions that provide
adequate mitigation for the following:
(A) A plan for site rehabilitation must be approved by the County
Gommissioners before a permitforconditional orspecial usewill be
issued.

The applicant has submitted a weed inventory and mitigation plan. This plan willbe reviewed
by the.County Vegetation Department prior to this iteh going before the Board of County
Commissioners.
(B)!he County Commissioners may require securityr before a permit
for spe-cial or conditional use r.s r.ssued, if required. The ap'pricant
shall furnish evidence of a bank commitment of credtt, bond,
ceftified check or other security deemed acceptable by the county
Commissioners in the amount calculated by -the Counfir
Commissioners to secure the execution of the sile rehabititationplan in workmanlike manner and in accordance with the
1pegific_ations and construction schedule established or approved
by the Goun$ Commr.ssioners. Such commitmenf,s, bonds orch*k
shall be payable to and held by the County Commissioners.
Staff Comments: The applicant has submitted a "Performance Bond" in the amount of
$50,000.

55.03.08 lndustrial Performance Standards

(1) Volume of sound generated shall comply with the standards sef forth in
the Colorado Revised Sfafufes atthe time any new application is made.(4. e3-061)
Staff Gomments: The applicant provided information stating the pumps to be used for the
sprinkling system will be housed. This should mitigate some of the sound produced.
Regardless, the applicant shall be aware of all sound iolume standards and medt all State
requirements.
(2) Vibration generated: every use shall be so operated that the ground
vibration inherently and recurrently generated is not perceptible, without
instruments, at any point of any boundary line of the property on which
the use is located;.
Staff Gomments: The applicant has not submitted any information concerning ground
vibration. lt appears that once construction is complete vibration should be negligible.
(3) Emisslons of smoke and pafticulate malter: every use shall be
operated so as to comply with all Federal, Sfate and CounU air quality
laws, regulations and standards.
Staff Comments: lf the facility creates smoke or particulate matter, the applicant shall be
aware of and meet all Federal and State air quality standards.
(4) Emission of heat, glare, radiation and fumes: every use shall be so
operated that it does not emit heat, glare, radiation or fumes which
substantially inbrtere with the existing use of adjoining propefi or
which constitutes a public nuisance or hazard. Flaring of gases,
aircraft waming signals, reflective painting of storage tanks, or other
such operations which may be required by law as safety or air
pollution control measures shall be exempted from this provision.
Staff Comments: Bio-sides and aeration will be used to reduce the production bacteria
and control some of the fumes or odors that will be produced from the treatment of the
produced waters. The ponds wil! create glare, it is not clear how the glare from the facility
will be mitigated.
(5) Storage area, salvage yard, sanitary lanfrill and mineral waste
dLsposal areas: (A97-1 1 2).
(A) Storage of flammable or explosive solids orgases shall be in
accordance with accepted standards and laws and shall comply
with the national, sfafe and local fire codes and wrilten
reco mmendations/com ments- fro m the app ro priate local
protection district regarding compliance with the appropriate

Staff Gomments: Hydrocarbons will be removed from the produced waters. The
hydrocarbons will be stored on site and then eventfully removed.
(B) Atthe discretion of the County Commissioners, all outdoor
storage facilities may be required to be enclosed by fence,
landscaping or wall adequate to conceal such facilities from
adjacent propefi ; (A97-l I 2)
Staff Comments: A chain-link fence with barb wire at the top is being proposed for the site
to mitigate wildlife safety issues and prevent trespass.
(C) No materials or wasfes shall be deposited upon a property in
such form or manner that they may be transferred off the property
by any reasonably foreseeable natural causes or forces; (497-

Staff Comments: The applicant shall be aware of this standard a clearly address how all of

(6) Water pollution: in a case in which potential hazards exist, it shall be
necessary to install safeguards designed to comply with the
Regulations of the Environmental Protection Agency before operation of
the facilities may begin.
All percolation fesfs or ground water resource fesfs as may be
required by local or Stafe Health Offrcers must be met before operation of
the facilities may begin.
Statr Gomments: Staff is recommending that a ground water test be conducted and those
findings be submitted to the County for review prior to issuance of the Special Use Permit and
that once the operation begins that the findings of the westerly monitoring well be submit to
the county on an annual basis for review.
4. SUGGESTED FINDINGS
That the meeting before the Planning Commission was extensive and all pertinent
facts, matters and issues were submitted.
That for the above stated and other reasons, the proposed Special Use Permit is in
the best interest of the health, safety, convenience, order, prosperity and welfare of
the citizens of Garfield County.
That the application is in conformance with the Garfield County Zoning Resolution
of 1978, as amended.
5. STAFF RECOMMENDATION: Staff is recommending Planning Commission recommends
approval to the Board of County Commissioners for the Special Use Permit to allow and
evaporative pond with the following conditions of approval:

As per 59.03.05 which allows Periodic Review, the Special Use Permit shall be
made suOlect to a review at six (6) months from the date of lssuance of the Special
Use Permit. The purpose of such review shall be to determine compliance or
noncompliance with any performance requirements associated with the granting of
the Special Use Permit. Such review shall be conducted in such manner and by
such persons as the County Commissioners deem appropriate to makethe review
effective and meaningful. Upon the completion of the review, the Commissioners
may determine that the permit operations are in compliance and continue the
permit, or determine the operations are not in compliance and either suspend the
permit or require the permittee to bring the operation into compliance by a certain
specified date. lf a determination is made that the Permit shall be modified or
revoked, a Public Hearing shallbe scheduled as perthe County regulations atsuch
time to proceed with said action. Such periodic review shall be limited to those
performance requirements and conditions imposed at the time of the original
issuance of the Specia! Use Permit.

Thc SWir.lP shall be prepared in accordarce with goo<l engineering, hidrologic and pollurton control practices. (Thc SWIvIP
need nor be prcpared by a registered engiileer.) The main objective of the plan shall be to identify Bcst Managemcnt PrBclices
(BlvlPs) rvhich rvhen irnpiemenrcd will meet the terms and condnions of this permit (see Part I'C., below).

1. A driveway approach is understood to be that portion of the-county road right-of way between the pavernent edge
and the property line that is designed and used for the interchangcof traffic between the roadway and abutting
propertY.
z. At any intersection, a driveway shall be reshicted for a sufficient distance from the intersection to preserve the
normal and safe movement of traffic. (It is recommended for rural residence entrances that a minimum
intersection clearance of 50 feet be provided and for rural commercial entrances a minimum of 100 feet be
provided-)
3. All entrances and erdts shall be so located and constructed that vehicles approaching or using them will be able to
obtain adequate sight distance in both directions along the county road in order to maneuver safely and without
interfering with county road traffic.
4. The Applicant shall not be permitted to erect any sign or display material either fued or movablg on or
extending over any portion of the coutrty road right-of-way'
5. Generally, no more than one approach shall be allowed any parcel or property the frontage of which is less than
one hundied (100) feet. Additi&al entances or exits for parcels having a frontage in excess of one hundred 100)
feet shall be perrnitted only after showing of actual convenience and necessity.
6. All driveways shall be so located that the flared portion adjacent to the traveled way will not encroach upon
adjoining proPefi.
7. No commercial driveway shall have a width greater than thirty (30) feet measured at right angles to the centerline
of the driveway except as increased by permissible radii. No noncommercial driveway shall have a,lvrdth greater
than twenty 1Zb1 feeimeasured at right angles to the centerline of the driveway, orcept as increased by
permissible radii.
g. The axis of an approach to the road rnay be at a right angle to the cemterline of the county road and 9f any angle

RE Noble Energy Evaporation Pit and Ponds proposed on Hyrup's Ranch
We respectfully ask for the relocation of Noble Energy's Amine Gas Processing Plant
and Evaporation Ponds proposed on the north end of Hyrups' Ranch in Garfield County.
This massive installation, of approximately 70 acres, at full capacity will hold I .17
million barrels of waste product in five ponds.
The proposed location will contaminate the quality of our air with noxious odors and
potentially damage the quality of our water supplies. Monitoring equipment will only let
us know we have a problem, but will not solve the problem; then it is too late.
There is an alternative site, known as "Little Alkali", on the south/west end of Hyrups'
Ranch. This site will reduce the impacts by the very nature of its isolated location. We
strongly urge you not to approve the proposed location that negatively impacts so many
people, but consider "Little Alkali" as a more responsible site. We appreciate your help
in protecting our homes. Thank you.

support of our operations approximately eight miles southwest of Parachute.

SUBJECT: Proposed Noble Hyrup Evaporation Facility Evaluation of 100 Year
Runoffand Diversion
In accordance with Colorado Oil and Gas Conservation Commission (COGCC) 900
series rules (908 b 5 E) centralized exploration and production @&P) facilities must have
surface water diversions that will accommodate the 100 yeay 24 hour storm event.
Facility latitude and longitude were used to determine the precipitation depth from this
100 year stom event. The National Oceanic and Aunospheric Administation (NOAA)
prepared the Atlas 2 precipitation frequency maps for the westem U.S. in 1973. This
information is available on-line and the 100 year, 24 hour storm depth for the Hyrup
locati on i s 2. 6 8 inches (http ://www. nws. noaa. goy{p_h/"hdB"g,,/Jro aaatl a s. ht m).
The proposed facility lies on a mesa between Wallace and Spring Creek. Soil in the
project area is primarily Potts loam (SCS, 1985). Potts loam is a hydrologic soil group B
soil and vegetation is primary Pinyon-Juniper, sagebrush, and grasses. The outline of the
proposed Hyrup facility was mapped and the upstream watershed delineated (see
attachment 1), The upstream basin has two primary drainages; the north drainage is near
the center of the proposed facility and the south drainage lies just to the southwest of the
facility, Two conesponding drainages were outlined. Basin characteristics were
measured off the map and include area, slope, and drainage length and are listed in the
following table.

The hydrology model TR-55 developed by the United States Department of Agriculture,
Natural Resources Conservation Service was selected to model the watershed hydrology,
The hydrologic soil group and vegetation types were entered into land use details to
determine a runoff curve number of 51. Basin drainage chamcteristics were entered and
a time of conoentration of 0.34 hours was determined for both basins.
The TR-55 model calculates peak runoff volume based on storm and basin
characteristics. Calculated 100 year, 24 hour peak flows include: nofth area 0.35 cubic
feet per second (cfs), south srea0,22 cfs, and combined flow 0.58 cfs.
A spreadsheet form of Manning's equation was utilized to size a diversion berm that
would collect run-on water along the southeast side of the facility and direct it southwest

toward the existing south drainage. Spreadsheet inputs included flow (0.6 cfs), n value of
0.035, left side slope of 20h:lv (slope of 5%), r'ight side slope of 3h:1v (diversion berm),
and cirannel slope of 0.5 percent (expected minimum value along natural ground). The
calculated depttLof flow ii O.: feet and velocity of flow of 1 feet per second.
Given the relatively small contributory arca, it is recornmended that the diversion berm
be constructed to a height of at least two feet with 3:1 (horizontal:vertical) slopes.
During construction, ground slope along the diversion berm should be cheeked to ensure
a minimum slope of-one percent exists or is constructed. After constuction, both the
upstream and downstrearn berm slopes should be revegetated. Additionally, the lower
one foot (vertical) of the upstream ler* face should be enhanced by installation of a
double-netted rnulch blanket or other suitable erosion conttol material.
