HomeMy WebLinkAbout3.0 Resolution 2003-91tffill llill llllllllll llll lllil llllll lll llll llll llll 640195 ll/O5/2O03 03:35P 81535 P765 l'l RLSO0RF 1 of 4 R O.OO O O,OO GRRFIELD COUilTY C0 STATE OF COLORADO County of Garfield At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in Glenwood Springs on Monday, the 8th day of Septernber, 2003, there were present: John Martin , Commissioner Chairman Larry McCown , Commissioner Tresi Houpt ) )ss ) Don DeFord , Commissioner , County Attorney Mildred Alsdorf , Clerk of the Board Ed Green County Manager when the following proceedings, among others were had and done, to-wit: RESOLUTION NO. 2OO3-91 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT FoR A cAMpER PARK FoR sr ilJsIhffirrilf,f;rNspRopERrrEs, LLC /GRETCHEN WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Sunlight Mountain Properties, LLC (Gretchen and Pierre DuBois) for a Special Use Permit for a "camper park" designation at the 1.8 acre site located at 10252 County Road 1 17 which contains the Sunlight Mountain Inn at the base of Sunlight Ski area; and WHEREAS, the Special Use Permit request for a "camper park" specifically will allow the placement of four cabins (approximately 400 sq. ft. each) on their property as described in the site plan submitted in the application to expand the guest lodging capacity of the Sunlight Mountain Inn; and WHEREAS, the subject property is located in the Commercial / Limited (CIL) zone district which contemplates a "camper park" as a Special Use within that district; and WHEREAS, the a "camper park" is defined in Section 2.02.11 of the Garfield County Zorung Resolution of 1978, as amended, as any lot which has been designed, improved or used for the parking of two (2) or more camper vehicles and/or tent campers for human habitation; and WHEREAS, the Board held a public hearing on the 8th day of May, 2003, upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their aq;' L9l opinions regarding the issuance of said Special Use permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination olfact: 1' That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested pu.ti"t were heard at that hearing. 3' That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit be and hereby is approved to allow for the designation of camper park at the site identified in the application, ,fon the following specific conditions: l. All representations of the applicant, eithEr within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval Further, this permit granted is for this specific use only as presently described. In the event any representations made in the application for which this permit is granted change and are no longer consistent with the representations in this applicationl the applicant shall be required to submit a new permit application to the county addressing the changes. 2. Pursuant to Section 5.02.13(2) of the Zoning Resolution of 1978, as amended, : All sewer lines shall be located in trenches of sufficient depth to be free of breakage fromtraffic or other movements and shall maintain a minimum horizontal separation of ten(10) feet from all domestic water lines. Sewers shall be at a grade whicir will insure avelocity of two (2) feet per second when flowing full. All ,"*". lines shall be constructed of materials accepted by state or local laws and shall meet design criteria of the Colorado Department of Health. 3. The Applicant shall comply with Section 5.02.15 of the Zoning Resolution of 197g, as amended for individual sewer connections. All joints shall be watertight; c) All materials used for sewer connections shall be corrosive resistant, nonabsorbent and durable. The inner surface shail be smooth; d) Provision shall be made for plugging the sewer riser pipe when a trailer does not occupy the space. Surface drainage shall be diverted away from the riser; e) Sink Wastes: No liquid wastes from sinks shall be discharged onto or allowed to accumulate on the ground surface. 4' All new lighting associated with the cabins such as walkway lighting and exterior lighting shall be directed inward and shali be down cast. 5' The Applicant shall obtain all necessary electrical permits from the appropriate utility company (ies) for any required specific utility plans for the installation of tne four cabins.These approvals shall be provided to the Building and Planning Department demonstrating compliance this condition prior to the issuanle of a Special Ose permit. 6' All utility service lines that serve the cabins shall be located underground. 7 ' The cabins are to be designated as short term guest accommodations and no cabin shallbe inhabited by the same individual for more than one hundred twenty (120) days per year in any one (l) cabin. 8' The Applicant shall provide each cabin with smoke detectors, appropriate fireextinguishers, and telephone services for detecting, fighting, and reporting u ni.. Garden hoses shall be available for use for each cabin. Existin! tnn-rules reiarding open fires and candles, shall apply to the new cabins. Stafffinds this standard to be-met. 9' Prior to any improvements associated with this proposal at the property, the Applicantshall have the 30-foot live stream setback from thi high water rn*k *"urured and stakedby a licensed surveyor to ensure the cabin placement and all other development complywith this distance. l0' The Applicant shall provide an adjusted site plan to the Building and planning Staff forreview prior to the issuance of a Special use Fermit that correct{ shoe$the re[uired on-center distance between the cabins to be 20 feet. I l ' The Applicant shall obtain the appropriate and necessary well permits from the ColoradoDivision of water Resources for the Main well and the Ranch well that will effectivelyfunction in conjunction with the water contract (#FM030612sMp(a)) with west DivideWater Conservancy District for 2 acre feet which will include the four cabins. These new J pennits and associated / supporting documentation shall be presented to Planning and Building Staff prior to the issuance of a Special Use Permit.
