This letter is in response to Chris Halandras' application for a
Special Use Permit for a logging operation.
The Bureau of Land Management does not object to the harvest of
timber from Mr. Halandras' private lands. The bureau is an
adjacent landowner, and the public lands contain significant
timber resources. We are concerned about the possibility of
encroachment of harvest onto the public lands.
When the bureau conducts a timber sale adjacent to private lands,
the boundaries are surveyed and marked. We make every effort to
prevent trespass problems with our neighbors. We believe we
should be afforded the same consideration. If the County
Commissioners have the authority to require the boundaries be
surveyed and marked, prior to harvest, we would appreciate this
requirement be included in the permit.

Dear Mark:
This letter is in reference to a public notice we received from Chris Halandras
regarding a special use permit to log private lands. Proposed logging in
Sections 29 and 32 will border National Forest lands on the eastern boundary in
both sections. Prior to the logging operation beginning along this boundary we
strongly urge that a survey be completed so that there is no cutting on
National Forest lands. Cutting National Forest timber is a serious trespass
and could result in fines and/or prison sentences.
The applicant has not applied to the U.S. Forest Service for a right-of-way
across National Forest so no log hauling or access across Forest Road 837
(located in Section 33), should occur.
Finally although we have no jurisdiction in this matter, there may be some
heritage resources along the old Ute Stock Driveway which are worth recording
and protecting. A quick survey of the area should indicate if this is the
case.

We have received your letter of January 28, 1997 regarding the
Special Use Permit Aprroval for logging operations on the Chris
Halandras property located near Rio Blanco. Due to matters out of
our control, namely weather, we have been unable to complete this
timber sale with Mr. Halandras under the original termination date
of March 15th, 1997. We will be extending this timber sale
agreement with Mr. Halandras through March 15, 1998. Enclosed
you'll find copies of this amendment and a cover letter recently
sent to Mr. Halandras by our office. All the original terms and
conditions of the timber sale agreement stay in effect with this
extension.
In looking at the terms and conditions of the permit with Garfield
County, we believe that all items covered under this document have
completed with the exception of the completion of the harvesting of
the original 150 acres. We tentatively plan to complete all
logging operations by hunting season, 1997. Final burning of the
brush piles will take place in the Fall and Winter of 1997.
Please go ahead and extend the permit through March 15, 1998 under
the terms and conditions you have stated in this document. Should
you require us to formally extend the road bond termination date,
please feel free to contact us and we will do so.

Enclosed you'll find two copies of an Amendment to Contract form we
need you to sign to extend the Stumpage Purchase Agreement through
1997. This will allow us to complete all harvesting and cleanup
operations on your Rio Blanco property as we discussed this past
Fall. Please sign both copies and return them to me at the
following address:

Once I receive the signed copies I'll forward them on to Hayden
Lake, Idaho for final signature by the company. We'll send you a
signed original copy when we get everything back from our Division
office.
Our plans are to start logging operations as soon as weather and
ground conditions permit. My guess is this will be in mid-June if
your sheep operation allows. We plan to use Harvey Gray again to
complete the sale and we'll hopefully wrap things up by hunting
season. We'd like to do some burning of the brush piles this
Spring. We couldn't get up on the property this Winter to do any
burning of brush piles due to the heavy snowfall but it doesn't
hurt to let the piles dry out even more. It'll simply mean a
better burn.
Also, you'll find enclosed in this package a copy of Garfield
County's Special Use Permit Approval form for the harvesting of
timber from your property. You recall we had to file for special
permission to log your place. This is simply a document that asks
us if we have completed all contractual requirements on the permit
and the timber sale. Since we are extending your contract, we'll
have to extend this permit as well. We'll take care of this issue
but we thought you'd like to have a copy.

THIS AMENDMENT TO CONTRACT is made and entered into the 31st
day of January , 1997 , by and between LOUISIANA-PACIFIC
CORPORATION, a Delaware Corporation, hereinafter referred to as
"Company", and Chris Halandras

RECITALS:
The parties hereto entered into a contract dated May
2nd, 1995 , ("Contract"), and now desire to amend Contract as
follows:
- Amend contract to extend termination date to March 15, 1998
Except as provided by this and any previous amendment, each
and all of the terms and provisions of Contract shall be and remain
in full force and effect.

It was our understandinq that your hauling contractors would not
use our North Cut Off Road, County Road 247. The Forest Service
specified a haul route based on ourJ-,tibulations but For some
unfortunate reason your hauler chose to ignore this directive.
Both ourselves, and the Forest Servide stopped your contractind
agents hauling on this road.
