Mitchell Creek Ltd Liability Company (50%) and Vertex,LLC )-. (50%) and the occupants, Richard and Carolyn McKinley, due to the design of the ' g,r"stirouse and the studio apartment is to open the property to the public as a bed and f,reakfast facility. The facility would be open seven (7) days a week' Our guests would check-in between the hours of 1 p.m. and 6 p.m. and check out by I 1:00 a'm' The design of the guesthouse (2645 s.f.) offers two wings with a central living area. The north wing accommodates one master bedroom with a fireplace, sitting urea, private bath; two bedrooms with sitting areas, sink basins with vanities and share a full bath. Each of v these bedrooms would sleep up to two guests. The south wing, which will serve as the A li,ring quarters for the occupants, accommodates the kitchen; one master bedroom with a firepl-ace, sitting area, private bath; one bedroom and a full bath. The guests would have access to the living area with a fireplace and small library; the large covered front porch (330 s.f.), the kitchen for breakfast and the patio located next to Mitchell Creek with a barbeque grill and fireplace. WATER AND WASTEWATER TREATMENT The property has sufficient water that is supplied by the shared Cannafax Spring (alWa Hubiard/Cascade Spring) and the Cannafax Mitchell Creek Pump and Pipeline. The improvements have a setback of approxim ately 200 feet from County Road 132and are located on the northerly part of the 26-aui parcel creating a quiei secludedlocation. The Water Judge referred the Amended Applicationto the undersigned as Water Referee for Water Division No. 5l State of Colorado, in ucciiaaoce with Article 92 of Chapter 37' Colorado Revised Statutes 1973, known as the Water Rights Determination and Administration Act of 1969' The undersigned Referee has made such investigations as are necessary to determine whether or not the statements in the Amended Application are tnre, has become fully advised with respect to the subject matter of the Amended epiiication andhas cgnsulted with the Division Engineer for water Division No. 5. The Referee heieby makes the following determination and ruling as the Referee in this matter. I. FINDINGS OF F'ACT 1.
