PROPOSED USE AND DESIGN
The vision of the owners. Mitchell Creek Ltd Liability Company (50%) and Vertex,LLC
)-. (50%) and the occupants, Richard and Carolyn McKinley, due to the design of the
' g,r"stirouse and the studio apartment is to open the property to the public as a bed and
f,reakfast facility. The facility would be open seven (7) days a week' Our guests would
check-in between the hours of 1 p.m. and 6 p.m. and check out by I 1:00 a'm'
The design of the guesthouse (2645 s.f.) offers two wings with a central living area. The
north wing accommodates one master bedroom with a fireplace, sitting urea, private bath;
two bedrooms with sitting areas, sink basins with vanities and share a full bath. Each of
v these bedrooms would sleep up to two guests. The south wing, which will serve as the
A li,ring quarters for the occupants, accommodates the kitchen; one master bedroom with a
firepl-ace, sitting area, private bath; one bedroom and a full bath. The guests would have
access to the living area with a fireplace and small library; the large covered front porch
(330 s.f.), the kitchen for breakfast and the patio located next to Mitchell Creek with a
barbeque grill and fireplace. The linen house on the south side of the guesthouse will be
used for storage.

At full capacity,the property would facilitate ten (10) guests, which could require four (4)

The propirty has alway, u."o*rnodated a reasonable amount of traffic consisting of
standard forms of transportation on County Road 132 due to its occupants and that should
not change.
WATER AND WASTEWATER TREATMENT
The property has sufficient water that is supplied by the shared Cannafax Spring (alWa
Hubiard/Cascade Spring) and the Cannafax Mitchell Creek Pump and Pipeline. The
District court, water Division No. 5, colorado case No. 97CW291, Finds of Fact,
Conclusions of Law, Judgment and Decree is hereby attached (Attachment A) which
indicates the production and the distribution of the spring water. The treatment of
wastewater is done with a conventional 1,00O-gallon septic tank and leach field system
(Attachment B).
SITE PLAN
An Improvement Location Survey (Attachment C) is provided to portray the boundaries, all

IMPACT STATEMENT
Ttte are adequate utilities to the property to provide services for the proposed use.The City of Glenwood Springs provides "t..tii. services. ewest provides localtelephone service. The Cannafax Spring (alWaHubbard/CaJcade Spring; and theCannafax Mitchell Creek Pump and Pipeline provide ample water to tf,". p.op".ry(Attachment A). There is an adequate conventional 1,00b-gallon septic t*t *aleach field system in place and fully operational for the treatment of wastewater(Attachment B).
County Road 132 is a chip and seal road, which provides adequate access for thesubject property, local residents, and the many visitors to the State of Colorado FishHatchery. The road is maintained by the Garheld county Road Department.
The improvements have a setback of approxim ately 200 feet from County Road 132and are located on the northerly part of the 26-aui parcel creating a quiei secludedlocation. The improvements are located furthest from the closest residence, thex Dygrey's, which are directly rorth. The front of the property faces a steep hillside,which is the boundary of the storm King Ranch. Th; property has an existingwood fence with an abundance of mature landscaping t., ilr" ieriphery creating anatural buffer from neighboring properties. The actiiity on the piop".ty will remainthe same and would not create any impact on and to adjacent uses of land.
The access to the property will remain the same.

This matter came before the court upon the Amended Application of Joan DuPrey Trust,
Rudy steele, and Mitchell creek, LLC for surface water rights.
The Water Judge referred the Amended Applicationto the undersigned as Water Referee for
Water Division No. 5l State of Colorado, in ucciiaaoce with Article 92 of Chapter 37' Colorado
Revised Statutes 1973, known as the Water Rights Determination and Administration Act of 1969'
The undersigned Referee has made such investigations as are necessary to determine whether
or not the statements in the Amended Application are tnre, has become fully advised with respect
to the subject matter of the Amended epiiication andhas cgnsulted with the Division Engineer for
water Division No. 5. The Referee heieby makes the following determination and ruling as the
Referee in this matter.
I. FINDINGS OF F'ACT
1. Applicants filed an Application for surface water rights on December 37' 1997'
Applicant filed an Amended Application on August 31, 1998.
Z. The Amended Application was properly published in the resume for Water Division

Application and over all of the parties in this case'

(under the cannafax Spring and the cannafax Mitchell creek Purnp
and Pipeline described herein). Pursuant to the Applicants'
agreement with the Division of Wildlife (DOUD in connection with
Case No. 92CW73 (a copy of the agreement is Exhibit A hereto),
DuPrey will restrict its irrigation from the spring to no more than
5,000 square feet, and Steele and Mitchell Creek LLC will restrict
their irrigation from the spring to a total of 1,000 square feet; the
remainder of the 5 acres will be irrigated under the Cannafar Mitchell
Creek Pump and Pipeline water right described herein.

Engineer and the Division Engineer for water Division No. 5.

PETITION TO AMEND DECREE TO INCLIJDE EXHIBIT
Applicants hereby petition the Court to amend the Decree entered April12,1999, for the soie
purpose of including the attached Exhibit A to the Decree's Exhibit A. As grounds therefor,
Applicants would show the court:
1. Applicants submiued the proposed ruling and decree to the Water Court in March of
1999. Exhibit A to that ruling is a stipulation in Case No. 92CW73, and the attached Exhibit is
Exhibit A to that stipulation. The attached document was intended to be an attachment to the Decree
herein. Apparently, Applicants inadvertently failed to provide the Court with the attached.
Applicants' counsel was not aware that the oversight had occurred until there was reason to review
the Decree recently.
2. Under these circumstances, Applicant submits that the error is clerical and can be
corrected merely by an Amended Decree to attach the Exhibit A tendered herewith to Exhibit A to
the Decree entered April 12, 1999. See C.R.S. $ 37-92-304 (10).
