Ann M Gianinetti (Milchetl Creek L.L.C.) received a Special tJs Permit approval from the Boad of C-ounty Commissiorprs for the sarne'Ilesort" designation descriH above on the 7th day of September 2}04-;atld ) )ss ) ilulll llllllilllll lll llltl lillllllill llllltilllll'a[iitis llrldizooc o3fioP Bt64o P861 ?'l ALSDoRF Z- "t q R @.OO D o'Oo GRRFIELD COUNTY C0 WHEREAS, the Board held a public hearing on the 7th day of Septembcr 2004, upon the question of whether the above-d.r..ib.d Special Use Permit shoutd be granted or denied, at which hearing the public antl interested persons were given- the opportunity to express their opiniorrs r"g*ding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the public hearurg before the Board of County Commissioners was extensive and complete, that all pertiient facts, matters and issues were submitted and that all interested parties were heard at that meeting- 3. That for the above stated and other reasons, the proposed Special Use Permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield CountY. 4. That the application is in conformance with the Garfield County Znrnrrg Resolution of 1978, as amended. 5. That the application is in conforrwmce with the Garfield County Comprehensive Plan of 2000. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield Copnty, Colorado, that the Special Use Permit be and hereby is approved to allow for the designationof resort at the site identified in the applicatiorr, upon the following specific conditiorls: 1. That all representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. Tbat the applicant shall obtain all required and necessary building permits, sign permits and inspeitions, among others, consistent with the adopted rules and regulations of Garfield County for all development within the resort area. 3. If any further expansion of the use is attempted, the applicant shall readdress the proposal by obtaining the necessary approvals from the Board of County Commissioners. 4. The Applicant shall apply for a septic permit and receive a frnal inspection prior to issuance of the Special Use Permit, The existing septic system capacity shall be elevated and expanded requiring Garfield County standards of performance for a 7 bedrooms ISDS of the separate dwelling unit and single-family dwelling unit which shall also rneet Mitchell Creek Resort- SUP llll5lu ilililr llill lmll lll ilil llilillllr lll llilllll llll 663705 |L/LE/?O@4 O3:2AP 81640 P862 !1 0LSDORF 3 of 4 R o.OA D A.OO GRRFIELD COUNTY C0 Colorado Department of Health and Environment ISDS setback standards. The Applicant shall be limited to a maximum of 14 overnight guests within the SUP at any given time. 5. The applicant shall make application to the Garfield County Building and Planning Oepartment for a building p"r*it for the detached dwelling unit, allow inspections, and ultimately gain a Certificate of Occupancy consistent with the adopted rules and regulations of C*n"tO County prior to the issuance of the Special Use Permit' Also, a RJgistered Colorado Engineei oi Ar.hite"t shall certiff all of the construction within the detached dwelling unit complies with Garfield County Building Code Requirements. 6. All exterior lighting shall be the minimum amount necessary and that all exterior lighting be directed inward, downward anrl towards the interior of designated cabin sites, except that provisions may be made to allow for safety lighting that goes beyond the property boundaries. 7. The Applicant shall demonstrate how wildfire hazard fuels have been mitigated around structuris and adequacy of vehicle access for emergency services to the Glenwood Springs Fire Department prior to issuance of the Special Use Permit. 8. The Applicant shall comply with two (2) requests required by Garfield County Road and Bridge Department, which require the Applicant to; L either remove the vegetation which impairs visibility or place a convex mirror at the ingresVegress point of the Resort, and ii. improve the surface of the driveway apron from the current %inch base to a chip and scal, asphalt or concrete material surface The Applicant shall make these improvements and request an inspection from the Garfieli-County Road and Bridge Department to veriff compliance prior to issuance of the Special Use Permit. 10. The Applicant shall create a water sharing agreement to include all the users of the water source available to the Applicants property and submit said document to the Garfield Counfy Building and Planning Department for review and approval prior to issuance of the Special Use Permit.
