After extensive litigation with the City of Glenwood Springs, Glen Park Ranch was able to enter into a new easement agreement that provided it with unimpaired access to its property on top of Red Mountain. This easement road is the same road utilized by Mountain States Communication, Inc., to obtain access to its 40-acre parcel adjacent to the Glen Park Ranch. Unlike Glen Park Ranch, LLC, Mountain States Communications, Inc., did nothing to our knowledge to protect or to reassert its easement right that was severed by the City of Glenwood Springs when it constructed the water treatrnent plant. A portion of the original roadway in which Mountain States Communication, Inc., had an easement right was destroyed and the road was reconstructed in a different location. In light of this, Mountain States Communications, Inc., may no longer have a connected access easement from West 9m Steet to its property on top of the mountain because the lower portion of that easement near the Water Treatment irlart *ar severed and the new access road "onrr"ited to West 9s Street may not be the same road described in Mountain States' title documents. Additionally, * the titled owner of the existing roadway easement, Glen Park Ranch has the right and obligation to maintain the roadway and to take appropriate steps to preserve its easement rights and to insure that the access road is not unreasonably burdened in a way that interferes with its use of the easement. The applicant and you should be aware that in the near future, Glen Park Ranch, LLC may be compelled to install an additional gate on the easement road as allowed by their easement agreement with the City of Glenwood Springs in order to preserve and protect its access road. You did a great job of explaining the technical aspects of the proposal so the Commissioners could focus on the essential parts. We still think the original proposal for a 102 foot tower pulled back from the ridgeline has a lot of merits: 1. lt is unequivocally in compliance with the radio emission requirements of the FCC, which is required by section 5.03.13 of the review standards. 2. Should the environmental requirements become stricter, fencing can be added to maintain compliance. We have no indication that the requirements will change, but they have in the past, and like all regulations, we think they would only become more strict. 3, lt uses terrain shielding for a neutral visual impact to the great majority of persons who would view the site. We believe this also complies with 5.03.13. 4. This has been a communication site for over thirty years. The impact of this proposal should be juclged against the historical use, rather than a false vision of an unspoiled, pristine habitat. While no one likes change, it's unreasonable for anyone to think that no changes would be needed at a technical facility after thirty years. At the commissioners direction, we are trying to exhaust other options. We are convinced that co- location options at Lookout Mountain, lron Mountain, and Sunlight are not practical. Some of the supporting documents were submitted just in time for the meeting yesterday, and I know you hadn't had a chance to review them. Would you please let me know if you agree that the co- location issue has been exhausted. lf we didnl have to consider the road next to the tower, then fencing can be a part of the solution. We are in contad with the developers of the neighboring parcels to see if the road can be moved. After reviewing the technical data, we won't propose a tower shorter than 60 feet (19 feet taller than the existing tower). That is the minimum height required to comply with the occupational exposure limits; that is, with the antenna at 60 feet, no location on the ground exceeds the occupational level. We believe that's a prudent approach to an important safety issue for our own personnel and others who might do work at the site. We believe that a 60 foot tower could be located slightly behind the efsting tower, but not as far back as the original proposal ... the shorter tower would lose line of sight. Perhaps twenty five feet of pull back is possible before the building would interfere with the guy wire locations. There is little cost difference in the installation of a sixty foot tower and a 102 foot tower, since the labor costs dont change. Only the materials, two twenty foot tower sections, would be saved. This Easement shall be construed to allow Glen Park to take a1l reasonable and necessary action in order to construct, utilize, and maintain a roadway the width of which shall be no greater than phpically necessary to reasonably accommodate two lanes of passenger vehicle traffic. Any such utility shall be installed underground. The centerline of the Easement shall coincide with the existing roadway and the reconstructed roadway described below to the greatest extent feasible. 2. Reconstruction of a Portion of Roadway and Relocation of Easement. As a result of constructing its water treatment facilities over a portion of the easement roadway, the City has constructed an alternate roadway at its sole cost, which roadway is southerly of such facilities and is generally shown as preceding from Point A to Point B on Exhibit nl" ennsasd hereto. Such alternate roadway has been constructed in accordance with specifications supplied by the City to Glen Park and which construction is in a manner equivalent to the access roadway to the Ciry facilities and include, without limitation, the same width of driving surface, depth of base and tlpe of materials. No portion of the grade of the alternative roadway exceeds approximately t0Vo. The City hereby warrants the physical construction of the alternate roadway against any construction defects. 3. Survey. The parties shall forthwith obtain a cetrterline survey of the entire easement roadway, from the Glen Park property to its connection with 9th Street in the City and the parties shall share equally in the cost of the survey. For reference purposes, the survey sha[ utilize, to the gteatest extent possible, the existing roadway platform. The survey will be performed by a licensed Colorado surveyor reasonably acceptable to both parties. The survey description will be included in an Addendum to this Agreement, shall be executed by both parties and recorded in the records of Garfreld County, Colorado. 4. Ouitclaim of Prior Interest. Upon relocation of the roadway and completion of the survey described above, Glen Park shall release and quit claim any claim or interest in the City Property arising out of or by virtue of that certain instrument dated August 31, L967, and recorded October 19,1971, as Reception No. 251439 in Book 423 at Page 52 in the records of the Clerk and Recorder of Garfield County. 5. Maintenance of Roadway. The City at its sole cost and expense shall maintain and repair the roadway from the 9th Street location on the eastern boundary of the City property to the southwestern terminus of the relocated roadway at and to a standard generally equivalent to the phpical condition as exists as of the date of this Agreement and shall preserve the use of the Easement as a vehicular roadway. Glen Park shall maintain and repair the roadway in the Easement at its sole cost and expeose from the southwestern terminus of the relocated roadway to the Glen Park properry. NoMthstanding the foregoing, if the City shall significatrtly use the portion of the Easement lying beyond the southwestern terminus of the relocated roadway, then Ciry shail share in the expense of such maintenance and repair. I know of four stations locally that have faced similar problems. Across the country, in areas whse broadcasters commonly use towers hundreds of feet tell, these problems are lesa co,ilnon. One station in Pitkin County meets the higher occupational o(posure levels, but no{ the general public levels. fhey are located on BLM tand and the site is about a mite beyond a locked gate. Despite that, I have seen hunters near the site dudng rifle season, and since the area isn't resticted, I doubt that it fuly qualifies as 'not accessible to tho general public'. I know they have considered fencing the area around the tower baee where the radio energy levels are excessive. This is a practical solulion for them; thelr tower Is already 100 feet tall, and the area to be ferued is only about 40 feot square. Another statlon is Eagla County exceeds the public exposure standard aubstantially. Thcir facility is located on private land six miles beyond a locked gate. The site is lnaccesslble six months ot the year without a snowcat. While there are other communication sltes nearby that are visited by communications tochnicians who qualify for the occupational level, I think lts reasonable to say that the publb is excluded. lf this facility meets the occupational levelq they should be OK. Another site in Pitkin County that exceeded the public exposure standard is not accessible by vehlcle, but is located on Forest Service land near a popular hiking trail. The licensee claims that the site is remote and difficult lo access, but as the sita is only about 100 feet away and visible from the trail, I thlnk lts likely that hlkers might approach it out of curbsity, and I think the public expoeure standards would apply. The station replaced their antenna with one of an advanced design that has reduced dowrnvard radiation. This may be an appropriate solutlon, as their tower is taller than KMTS's, and thair transmifter power is only a third of KMTSls. The existing KMTS tower is too short for this approach to work, Another station in Routt County operates with sornewhat higher porver than KMTS, from a much taller antenna. They appear to exceed the public exposure standard- Thek facility is located on private propefi, but it is used by the public as a recrestion area. I do not know if the station has taken steps to bring tho facillty into compliance.
