Your request for a Special Use Permit for a kennel, as identified on the enclosed public notice form,
has been scheduled for a public hearing before the Board of County Commissioners on September
9.lgg6,at 3:30 p.m.. in the Commissioners Meeting Room, Suite 301, Garfield County Courthouse,
109 8th Street, Glenwood Springs, CO 81601 . It is suggested that you be present at the time of the
meeting.
A copy of the enclosed public notice should be submitted to a newspaper of general circulation, for
publication one time at least 15 days prior to the hearing. You will also need to contact the
newspaper directly regarding obtaining the proof of publication and billing. In addition, copies of the
public notice form must be mailed by iertified return-receipt to all adjacent property owners no less
in- tS days prior to the hearing. The proof of publication from the newspaper of general circulation
and the return-receipts from the mailings must be submitted by the applicant at, or prior to, the public
hearing. Please examine all enclosures to veriry their accuracy.

PUBLIC NOTICE
TAKE NOTICE that MONTE & LINDA O'NEAL have applied to the Board of County
Commissioners, Garfield County, State of Colorado, to grant a Special Use Permit for a Kennel in
connection with the following described property situated in the County of Garfielci, State of
Colorado, to-wit:
Legal Description: A tract of land located in a portion of Section 11, T7S, R95W of the 6th P.M.
Practical Description. Located approximately four (4) miles east of Battlement Mesa on County
Road 301.
Said Special Use Permit is to allow the petitioners a kennel on the above described tract of land.
All persons affected by the proposed Special Use Permit are invited to appear and state their views,
protests or objections. If you cannot appear personally at such meeting, then you are urged to state
your views by letter, particularly if you have objections to such subdivision exemption request, as the
Board of County Commissioners will give consideration to the comments of surrounding property
o'l"ners and others aff[ected in deciding whethcr to grant or deny't1-.; request for the Special Use
Permit. This Special Use Permit application may be reviewed at the office of the Planning
Department located at 109 Sth Street, Suite 303, Garfield County Courthouse, Glenwood Springs,
Colorado. between the hours of 9:00 a.m. and l2 noon and 1:00 p.m. and 4:00 p.m.. Monday through
Friday.
That public meeting on the application for the above Special Use Permit request has been set for the
9th day of September, 1996, at the hour of 3:30 p.m., at the office of the Board of County
Commissioners, Garfield County Courthouse. Suite 301, 109 8th Street. Glenwood Springs,
Colorado.

The subject tract is aprox. 45 acres in size, located approx. 4 miles east of Parachute, north of CR
301. Th topography slopes at an average of 20o/o and there is an existing single family dwelling and
agricultural buildings on the tract.
Adjacent land uses are largely agricultural and residential on generally large tracts of land. BLM
owns land southeast and northwest of the subject tract.
The applicants are proposing a kennel that would house up to l7 dogs and 6 cats rn a 1575 square
foot building. The kennel would be a separate structure, located approx. 100 feet north of the
existing home.
The tract is within the a/rlrd zone district, which does allow a kennel upon the issuance of a SUP.
The proposal does fall within the definition of a kennel as defined in section 2.02.311 of the zorung
resolutioq therefore, it is subject to the criteria of section 5 . 03 . 1 5 of the resolution, essentially, that.
1] All kennels be completely enclosed within a building that prevents any sounds from emanating
from the property boundary in all agricultural and residential zone districts.
2) No dust, noise, odors or source of filth shall emanate from the property.
3] An individual sewage disposal system capable of handling all waste for the kennel shall be
installed
4l No outdoor dog runs will be allowed.
Section 5.03 (1) of the resolution further states that all special uses shall have utilities adequate to
provide water and sanitiation service based on accepted engineering standards and shall either be in
place or be constructed in conjunction with the proposed use.
In respect to water, the proposal suggests the use of the existing well as the water supply for the
kennel. The applicants have indicated they have a domestic well permit; however, the actual permit
has not been submitted and attempts to recover the permit from the division of water resources has
been unsuccessful. Discussions with DWR indicates that a domestic permit would not allow for a
legal water supply for the proposed kennel and that it would probably be necessary to receive a water
allotment contract. Staffwould recommend that all water supply information be completed prior to
any issuance of a SUP.
In regard to waste water treatment, the application suggests that either the existing system be used
or that a new ISD system be installed. According to staff calculations and provision of Colorado
Dept. of health's guidelines on individual sewage disposal systems, 1994 edition, dog kennels can be
expected to generate 30 gallons of waste water per day. No information for cats is provided. Using
thesefigures staffhas estimated that it would be necessary to install a new and separtae isd system.
According to ths SCS, soils on-site are considered to have severe limitations to isd use, generally due
to slope and large stones. Therefore, it may be necessary to engineer the system.
Access would be via CR 301 and an existing driveway. Aside from impacts caused by additional
traffic" staffdoes not contemplate significant impacts by the proposd activity
Gven the size of the applicants property and location of the proposed kennel and that it be operated
consistent with the zonng resolution provisions, staffdoes not contemplate significant impacts to
adjacent lands.
To date, staffhas not received any comments from adjacent or affected land owners.

This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeklng relief in a civil court action'
The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless
approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump
lnstallation Contractors in accordance with Rule 18.
Approved pursuant to CRS 37-92-602(3)(b)(ll)(A) as the onty well on a tract of land of 40+ acres described as that

County Road 301.
The use of ground water from this well is limited to fire protection, ordinary household purposes inside up to 3
single family dwellings, the irrigation of not more than one acre of home gardens and lawns, and the watering of
domestic animals.
The maximum pumping rate shall not exceed 15 GPM.
The return flow from the use of the well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located'
This well shall be constructed not more than 200 feet from the location specified on this permit.

Requirements:
l. Plans for proposed use is to burld a dog kennel with 17 separate
kennels for dogs and 6 for cats. Hours of operation would be 7:00 AM to
7:00 PM when people could drop offor pick up their pets. The number of
vehicles would vary on time of year and holidays, etc. I would think the
weekend traffic would be heavier than during the week. The location of the
structure would be about 100' behind the house. The size of the structure will
be approximately 50'x 35'.
2. Sewage - We will use the existing septic if it is large enough and if not
we will install another one according the counties specifications. We have a
domestic well. Road access is a driveway that leads to the house from
County Rd. 301.

solution wourd be to instau a cistern and purcrrase water and rrave it delivered. we
are wilhng to do this and need the counties approval before we start'
