APPLICANT — PROPERTY OWNER Circle B Land Company, LLC (Bill Barrett Corp. — Operator) ASSESSORS PARCEL # 2179-233-00-203 PROPERTY SIZE The Site will be approximately 5 acres on an overall tract of approximately 40 acres. LOCATION The property is located approximately 5 miles south of the Town of Silt, in Section 23, T6S, R92W . ACCESS The facility is accessed by County Road 326 (Chipperfield Lane) via County Road 331 and a 1.6 mile section of private gravel roadway. EXISTING ZONING The property is zoned Rural I. GENERAL PROJECT DESCRIPTION The Applicant is requesting a Limited Impact Review for a 5 acre Storage area (laydown yard) and Welding within a 40 acre parcel owned by Circle B Land Company. The facility is to be operated by Bill Barrett Corporation. The property is currently developed with a single family residence and barn, both of which are currently unused and vacant. In addition, all storage will occur on already graded and disturbed land. As a result, no additional grading or site disturbance will occur. The facility will be located about 5 miles south of the Town of Silt and surrounded by primarily oil and gas development, agriculture as well as limited residential. The main item represented to be stored onsite are natural gas separators that do not contain any fluids. Hazardous materials will not be stored at this location. Welding is proposed to take place from mobile welding trucks and is to occur infrequently. As employees will only be onsite to pick up and drop off equipment or for limited welding activities, no permanent water or wastewater facilities are proposed. 1 The traffic study as submitted states that the site will generate 8 to 16 light vehicle trips per day (4 to 8 round trips) as well as 2 medium weight truck trips per week (1 round trip) and 10 heavy truck trips per month for material deliveries (5 round trips). Total trip volume is expected to be between 16 and 20 trips daily (8 to 10 round trips). As the site is centrally located within the Bill Barrett Corporation (BBC) production field, this site is expected to result in an overall decline in vehicle miles travelled (VMT). LOCATION - SITE DESCRIPTION The site was previously graded and is currently developed with a barn and single family home. The home is outside the 5 acre subject site area while the barn is within this area. The barn is not proposed to be used for any storage or welding activities. The surrounding area is primarily native vegetation and developed for oil and gas and/or agriculture. There is limited residential development in the surrounding area. The surrounding zoning is Rural with some public land nearby. III. PUBLIC COMMENTS AND REFFERAL AGENCY COMMENTS Public Notice was provided for the Board's public hearing in accordance with the Garfield County Land Use and Development Code as amended. No public comments have been received at this time. Comments from referral agencies and County Departments are summarized below and attached as Exhibits. 1. Garfield County Consulting Engineer, Chris Hale, Mountain Cross Engineering: (See Exhibits 12) • The Applicant should identify the measures taken to ensure the barn will not be used for storage or welding. • Welding activities need to be reviewed by the Fire District. • The Applicant should identify the fire suppression methods to be used considering there will be no water onsite. • The application materials state that a reclamation plan has not been established. The Applicant should explain why this is or provide a timeline and plan for reclamation. 2. Garfield County Road and Bridge Department: (See Exhibit 11) • Indicated that Road and Bridge has no issues or comments regarding the proposed development. 3. Garfield County Vegetation Manager: (See Exhibit 10) • Indicated that the Integrated Vegetation and Noxious Weed Management Plan is acceptable. • Suggested that the Applicant treat all noted infestations of Russian knapweed and Musk Thistle prior to construction and no later than October 31, 2014. 4. Garfield County Oil and Gas Liaison: (See Exhibit 13) • Noted that the Liaison office has no additional comments on the application. 5. Colorado River Fire and Rescue: (See Exhibit 14) • Noted that the District has no additional comments on the application. 6. Garfield County Environmental Health: (See Exhibit 15) • Applicant needs to control fugitive dust. 6 • Operator should consider protections for the home should it not become occupied. • Site should have a no idling policy. 7. Other agencies that did not submit comments include: (a) Garfield County Environmental Health, (b) CDPHE APCD, (c) CDPHE WQCD, and (d) Colorado Parks and Wildlife. IV. STAFF COMMENTS AND ANALYSIS In accordance with the Land Use and Development Code, the Applicant has provided detailed responses to the Submittal Requirements and applicable sections of Article 7, Divisions 1, 2, and 3, including Section 7-1001 Industrial Use Standards. The Application materials include an Impact Analysis and related consultant reports, technical studies, and plans. 7-101 — 103: Zone District Regulations, Comprehensive Plan & Compatibility The proposed use demonstrates general conformance with applicable Zone District provisions contained in the Land Use and Development Code and in particular Article III standards for the Rural zone district. The Comprehensive Plan 2030 designates the site as RMH (Residential Medium/High Density). Excerpts from the Land Use Description Section Chapter 2 and Section 8, Natural Resources are provided below. Chapter 2 — Land Use Designations Residential Medium High (RMH): Small farms, estates, and clustered residential subdivisions; density determined by degree of clustering and land preserved in open condition: 0% open land = 1 du per —6 acres 50% open land = 1 du per 4 acres 70% open land = 1 du per 2 acres Section 8 — Natural Resources Issues *The county maintains high air quality standards, however there may be a propensity for air pollutants to exist in the western part of the county Goals 1. Ensure that natural, scenic, ecological, and critical wildlife habitat resources are protected and /or impacts mitigated. 7 4. Ensure the appropriate reclamation of land after extraction processes. Policies 1. The County will encourage and cooperate with the protection of critical habitat including state and federally protected, threatened, or endangered species. The location and design of the proposed facility is in general conformance with the Comprehensive Plan Policies subject to proper mitigation of impacts. The Application has also provided information indicating the character of the area and adjacent land uses. The request demonstrates general compatibility with adjoining uses that are primarily oil and gas exploration/production and agricultural associated with cattle grazing. 7-104 & 105: Source of Water & Waste Water Systems The Application represents that the facilities will be operated with minimal staff activities. The proposal demonstrates that the uses will be adequately served by bottled water and a portable toilet on-site. 7-106: Public Utilities No public utilities are required for operation of the facility. 7-107: Access & Roadways The Applicant's access their property from County Road 326 via a 1.6 mile long access road maintained by Bill Barrett Corporation. The submittals include detailed descriptions of the roadway as currently in use and a signed engineered study that identifies deviations in specific sections of the road design from those identified in Section 7-107, specifically the requirements for Right -of -Way (ROW), lane width, shoulder width, ditch width, cross slope, shoulder slope, and maximum grade. Despite these deviations, the study, conducted by Olsson and Associates and signed by a Professional Engineer, states that "The road functions adequately for its intended use and is typical of existing roads providing access to natural gas production in Garfield County." Section 4-118 allows for waivers from the Standards in the LUDC provided the waivers achieves the intent of the Code and impose no greater impact on adjacent property owners. The Olsson and Associates study, as noted previously, does indicate that the road is adequate and as a result, Staff believes the intent of the Code is satisfied. In addition, no further impacts on adjacent property owners as a result of this waiver is expected. To this end, as a professional engineer has indicated that the roadway as it exists is adequate to serve the proposed use, Staff recommends granting the waiver. 8 The Applicant submitted a Basic Traffic Analysis that indicates that the total traffic demand volume is expected to be between 16 and 20 trips daily (8 to 10 round trips). The study anticipates traffic utilizing the preferred haul routes to the site, which is approximately 14 travel miles from the Town of Silt. Based on the traffic counts on nearby County Roads, the study expects that no greater than a 9.5% increase and more likely closer to 7.6% on CR 326 as a result of the project. The study notes as well, that many of the trips will occur within the nearby field, in which case actual traffic impact should be less than predicted. As a result, the study concludes that: Based on the expected trip generation rates discussed above, the increase in average daily traffic is not expected to be significant on roads generally used by the public. The County roads discussed will see only a minor increase in traffic. The total traffic volumes will remain very low and can be accommodated by the existing roadway. Additionally, the majority of existing traffic on this road is associated with the natural gas industry. The addition of traffic generated by the proposed updated site use does not increase existing volumes to levels required for State or County Permits. 7-108: Natural Hazards The Application provides information on natural hazards including information on soils, geology, and slopes associated with the site. The information supports a determination that the proposed use is not subject to significant natural hazard risks. 7-109: Fire Protection The Application includes the Emergency Response Plan for the site. The Application was referred to Colorado River Fire Rescue who indicated that there are no additional fire codes that address this kind of use. As a result, the District has no additional comments. As the site is to have welding and is not proposed to have water on site, Mr. Hale noted that the Applicant should more fully address the fire protection measures that will be implemented. Staff recommends a condition of approval that the Applicant more fully discuss the fire protection measures that will be in place. This should specifically address how the Applicant will prevent the barn, which is a significant fire hazard if utilized for welding or storage purposes, will be prevented from being used for such purposes. 7-201: Agricultural Lands With little to no new disturbed areas for the storage area, minimal if any impact on agricultural land is anticipated. There are no irrigation ditches located within the perimeter of the site. 9 7-202: Wildlife Habitat Areas The Applicant has provided a wildlife habitat study completed by WestWater Engineering (dated September 2013). The study concluded "The development of the project is not expected to significantly affect any critical wildlife habitat for any wildlife species." No other threatened, endangered, proposed, candidate or other sensitive species were noted to occur in the project area. However, several noxious weeds were found on the site. A review by the Garfield County Vegetation Manager noted two species of noxious weed, Russian Knapweed and Musk Thistle, which should be treated prior to construction with verification of treatment no later than October 31, 2014. Staff suggests a Condition of Approval that requires the identified noxious weeds be treated in accordance with the Vegetation Manager's recommendation and prior to issuance of the Land Use Change Permit. 7-203: Protection of Water Bodies The site location is not in close proximity of an active water body. The nearest water feature is approximately 1,000 feet from the subject area. Due to this distance, impacts to water bodies are not anticipated. 7-204: Drainage and Erosion (Stormwater) The Applicant has provided a copy of the Storm Water Management Plan (SWMP). The Applicant has also provided a Grading and Drainage Plan. These documents were referred to the Garfield County contract engineer for review. It appears that the documents are satisfactory and conform to the standards found in the Code. 7-205 Environmental Quality The storage facilities will not have hazardous materials onsite, emanate fumes or odor and as a result, the stored materials should not impact air or water quality. In addition, the facility will not generate air emissions except for those typical of motor vehicles accessing the site. To this end, the facility is not expected to impact air quality and does not require a permit from the CDPHE. 7-206: Wildfire Hazards No structures are proposed and no comments were received from the Fire Protection District. The barn on the site is not to be used for storage or welding. The facility is not located within a "very high" wildland fire susceptibility designation according to the Community Wildfire Protection Plan and is designated as low fire danger according to the County GIS 30 -meter fire analysis. In addition, no fuels or other combustible material will be stored onsite. To this end, it is Staff's opinion that with additional 10 materials on fire suppression measures and prevention of the barn for use with welding and storing activities, the fire danger is within manageable levels. 7-207 Natural and Geologic Hazards See Section 7-108, above. 7-208: Reclamation The Applicant has included a reclamation plan that addresses re -vegetation and reclamation. This plan was included as a part of the Weed Management Plan and was reviewed by the Garfield County Vegetation Manager. The facility has an expected life of 30 years. At this time, the site will be reclaimed in accordance with the submitted plan. As no additional grading or site disturbance is expected, no security will be necessary. 7-301 & 302: Compatible Design, Parking, and Loading The proposed use is consistent with and compatible with typical oil and gas exploration and production activities. Large areas of the site plan are available for parking, circulation, and loading activities. As there will not be any gas or electric powered permanent equipment on the site, it is anticipated that compliance with the C.R.S. and COGCC noise limitations will be achieved and maintained. 7-303: Landscaping As an industrial use, landscaping submittals and standards are not applicable to the proposal. 7-304: Lighting No lighting is proposed at the site. However, any lighting that is considered in the future shall be limited to down directed, shielded and internally oriented fixtures in accordance with the County's lighting standards. 7-305 Snow Storage Adequate portions of the site plan including areas adjacent to the proposed storage area are available for snow storage. 7-306 Trails Trails standards are generally not applicable based on the industrial nature of the proposal and surrounding uses. 11 7-1001 INDUSTRIAL USE STANDARDS The Applicant represents that the facility will comply with all the Industrial Use Standards contained in Section 1001. The following summary addresses the applicable provisions. A. Residential Subdivisions The facility is located on a 40 -acre tract of property in a remote area of Garfield County and is not within a platted subdivision. B. Setbacks The proposed facility is over 100 feet from the property lines and will meet the applicable setbacks. C. Concealing and Screening The site is effectively screened by topography and geographical features. In addition, the site cannot be easily viewed from any public right of way. D. Storing The materials to be stored on the site will be large industrial equipment that will not be transferred off the property by any foreseeable natural causes. No hazardous materials will be stored on the site, however, all industrial products and wastes will be transported and stored in accordance with all applicable state and federal regulations. See the above discussion in Section B regarding setbacks. E. Industrial Wastes No hazardous wastes will be stored in the facility. F. Noise The Applicant represents that state noise limitations will be adhered to. This facility is not anticipated to generate any noise outside that generated by vehicles. Topography, geographical features and distance provide for any loading and unloading noise mitigation. G. Ground Vibration No ground vibrations are expected from the site. 12 H. Hours of Operation The facility will operate during daylight hours between 7AM and 5PM Monday through Friday and in compliance with the LUDC. I. Interference, Nuisance, or Hazard No other nuisance or ground vibration hazards are anticipated based on type of use, existing operation, COGCC compliance, and the remote location. V. SUPPLEMENTAL AND ADDITIONAL STAFF ANALYSIS No supplemental materials were submitted after the application was determined Technically Complete. VI. SUGGESTED FINDINGS 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. The hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons the proposed Land Use Change Permit for a Storage and Welding facility is in the best interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. 5. That with the adoption of waiver from the roadway standards, the application has , adequately met the requirements of the Garfield County Land Use and Development Code, Section 7-107. 6. That with the adoption of the Conditions of Approval the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. VII. RECOMMENDATION The following recommended conditions of approval are provided for the Board of County Commissioners consideration. 13 Conditions Prior to Issuance 1. The Applicant shall treat the identified Russian Knapweed and Musk Thistle prior to construction with satisfactory verification of treatment provided to the Vegetation Manager no later than October 31, 2014. Treatment and verification of treatment shall be completed prior to issuance of the Land Use Change Permit. 2. The Applicant shall more fully discuss the fire protection measures that will be in place on the site. This should specifically address how the Applicant will prevent the barn, which is a significant fire hazard if utilized for welding or storage purposes, will be prevented from being used for such purposes. This documentation shall be reviewed and accepted by the Garfield County contract engineer prior to issuance of the Land Use Change Permit. Other Conditions 3. That all representations made by the Applicant in the application shall be conditions of approval, unless specifically altered by the Board of County Commissioners. 4. That the operation of the Storage and Welding facility shall be done in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. 5. The facility shall maintain compliance with Storm Water Management Plan, Drainage and Grading Plans and Reclamation for the site. 6. The Applicant shall control fugitive dust during the operation of the site. 7. The facility shall maintain compliance with Section 7-306 Lighting, with all lighting to be directed inward and downward toward the interior of the site. Facilities shall be painted a non -glare neutral color to lessen any visual impacts. 8. The Applicant shall comply with the submitted Noxious Weed Management Plan including the best management practices. 9. To protect air quality, vehicles should not be permitted to remain idling. 10. A portable toilet and bottled water shall be provided onsite. 11. Section 2.8, "Nuisance", of the Impact Analysis does not address the potential impacts to air quality from fugitive dust that may result from the construction and operation of the Laydown Yard. The applicant should include and reference their plans to mitigate dust both on the operation of the site and on the access road. I did see mention of this in the Roadway Maintenance tab, but believe this should also include the site itself. 2. Should the residence on the property become occupied, the operator should consider further BMPs to reduce environmental health impacts such as noise and dust. 3.
