The enclosed materials are presented in response to your request for clarification to thePinkham special use Permit Application submitted on Septemb.. i0, 2002. ln your telephoneconversation with me on September 26,2002 you asked for the following:

SOLID WASTE:
2. The applicant has proactively complied with the intent of the Board of County
Commissioners discussion and decision held on August 5,2002 concerning proper collection and
disposal of solid waste generated by the dogs. The adopted Text Amenamint reads as follows:
5.03.15 (3) Kennel
"An individual sewage disposal system capable of handling all feces and urine
waste from the kennel or the feces and urine waste shall be stored in a sealed
container, capable of being pumped to allow a commercial hauler to dispose of
the feces and urine waste at an approved solid waste disposal site."
5.03.15 (7) Kennet
"Animal andfood wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards and nuisances are
minimized. Such wastes shall be removed at least weekly, or more frequently,
from the facility and hauled by commercial hauler to an approved solid waste
disposal site."
Mr. Pinkham has contracted with Waste Management to pick up the dog waste and other waste
associated with a kennel operation. Confirmation of the agreement can be found in the attached
Waste Management "Customer biographical Information" sheet. Note that the contract is dated
September L6,2002. Initiation of this agreement by Mr. Pinkham prior to a formal request by
Garfield County was done to show good faith to the County towards compliance with standardsin the Text Amendment.
The actual waste handling process includes placing the solid waste in a metai dumpster (with a
closing lid) on a daily basis. Waste Management empties the dumpster on a weekly basis and
hauls it to a designated landfill. This practice achieves full compliince with language in the Text
Amendment, and with the BOCC discussion held on August 5th.
You may recall that during my August 5th presentation to the BOCC I relayed concerns of the
State of Colorado Solid and Hazardous Waste Division. Glen Mallory of ihat Division stated
that we would be "asking for trouble" if we tried to dispose of the dog waste by liquefying it and
disposing of it subsurface. He was in complete agreement that the prop". method io dlspise of
the waste would be to leave it in a solid form and dispose of it in a designated landfill.

Referencing the BOCC minutes of August 5th, the discussion between Commissioners Stowe and
McCown prior to taking action on this item is as follows:
Commissioner McCown: "I'm comforrable with the way itis [Text Amendment
language allowing for ISDS disposal or allowing a commercial hauler to dispose
of the waste] because it allows for an ISDS or it shall be in a sealed contaiier
capable of being pumped to allow a commercial hauler to dispose of it. What
they're [the applicantf saying is, tf they don't pump it they dtp it would with a
backhoe, but the sealed container needs to stay.,, [sic]
commissioner stowe: "decided to keep it in a seared container"
Commissioner McCowan: "I think it's an either/or, tf they want to do anlSDS... "
There is more to the dialogue in the minutes, but the gist of the conversation is the applicant can
select the most effective method of solid waste disposal based on advice from the Coiorado
Department of Public Health and Environment, and to meet standards set by the County. Ilk.
Pinl*tam's instituted method of managing the dog waste is driven by the 6d bullet under
WHEREAS 7 in the Text Amendment
"WHEREAS, That the proposed text amendments are in the best interest of the
health, safety, morals, convenience, order, prosperity and welfare of the iitirrrs
of Garfield County."
If the interpretation is made that proper solid waste handling involves burial of a sealed container
in the ground, frtted with gauges, and periodically pumped in a slurry consistency, the
opportunity for ganerating a public health hazardis great. For example, if the container fractures
due to shifting soil or freezing temperatures, or if wild animals and vermin access the tank an
acute environmental event may happen.
By containing the waste above ground in a steel dumpster with closing lid, access from unwanted
intruders (mice, chipmunls, pack rats, etc.) can be denied. If the dumpster should crack for any
reason, it can be readily replaced by Waste Management. By leaving the waste material solid ii
can be easily and safely handled by Waste Management staff.
Making sure the health, safety and welfare of the neighborhood are met, and protecting ground
and surface water from contamination are of the highest concern in this application. The-
applicant's chosen option of solid waste handling meets these criteria.
STRAW BALE BERMS:
3. I\4r. Pinkham proposes to abide by his commitment made in the September lO, ZOO2
Special Use Permit Application. As can be seen in Exhibit 18 of the application, two straw bale
berms will be constructed above the upper dog holding area right away.

Sound readings taken by Sundesigns Architects staff as support for earlier submittals to the
County for a kennel, and testimony given by me at the August 5th BOCC meeting, clearly show
that compliance with the County noise standard is being met without addition of straw bale
berrns. In fact, sound measurements reflect most readings in the mid-40s dB(A) range. One
reading peaked at 50 dB(A) for a moment. The nighttime standard is 50 dB(A). The major
determinant as to whether or not the additional berms are constructed is totally dependent on
measured sound. There is no documentation that indicates a violation wiil occur as the result of
approval of this Special Use Permit.
Should there be a noisy dog identified that violates the noise standard, August 5ft BOCC minutes
reflect the intent of the Commissioners discussion.
Commissioner Stowe: '!...and strike the portion where it says 'dogs are not
allowed outside from sunset to sunrise". That would allow you to keep your dogs
healthy; at the same time if you exceed that 50-db noise levels at night, it does
also require you to build a kennel so you have a place to put them. If you have a
particularly noise dog or something, in deference to what Bob Noone testified,
you don't have to keep themfor hours on end and create that problem. But, tf yo,
have a nuisance dog or some control problems, you need a place to keep them
quiet." [sic]
If there is a particular dog(s) that violates the noise standard, that dog(s) will be isolated from the
rest and held indoors until the animal(s) is fit to return outside. If it is necessary to construct the
remaining berms based on exceedence of the standard, the applicant has committed to do so in a
timely manner.
SOUND LEYEL READINGS:
4. On page 2,1ast paragraph of the Noise Section of the Special Use Permit Application
received by the County on September 10, 2002, a ciaim is made rhat the voluntarily constructed
straw bale berms will be built to "...further dampen the dog barking that has been shown to be in
compliance with the County noise standard." Find attached four pages of noise readings that
were taken by Sundesigns Architects staff. This is the documentation used to make the statement
in the submittal.
As you can see, these are field worksheets and not a polished report. When providing scientific
documentation to support a position, it is customary to provide information in this format
without removing extraneous marks and scribbles.
Sundesigns Architect staff.are available to meet with you to discuss these worksheets if you so
desire. They will also be available at the public hearing on this application to testify to the
validity of their work.
I can verify, after reviewing this work with Sundesigns Architect staff, that they used best
management practices and followed proper scientific protocol when taking the sound
measurements reflected in the documents. The sound level meter used was in.proper workjng
order and was calibrated against a meter and field calibrator of similar design.

NARRATIVE DESCRIPTION OF THE PROPOSAL:
I am requesting a Special Use Permit for the purpose of allowing a Kerurel in conjunction
with and pursuant to the anticipated approval of a Zone Text Amendment request dated
March 7, 2000 proposing standards for kennel noise abatement and sanitary waste
disposal issues. My property currently has a log house (my primary residence) and a 30' x
50' steel building. The property is accessed frorn Dry Park Road via a thirty foot (30')
recorded "non-exclusive" access easement.
I am proposing a dog kennel on-site to house, raise and breed husky dogs for personal dog
sledding/racing and a future tour (dog sledding) business to be mn off-site. The tour
business is a future venture where the dogs are to be brought to a designated site (offsite)
to meet clients for dog sledding tours. No parking of vehicles by clients is to occur on-
site. Clierlt vehicles are to be parked at the off-site area where the dog sledding tours are
to occur. A total of five (5) employees is envisioned at the height of the tour business. One
(1) ernployee will reside on-site to help with the dogs and an additional ernployee along
with a total of three (3) guides will be ernployed for the tour business, not to reside on-
site. Ample parking is available on-site for the residents of the premises and the single
employee to be on-site (12+ parking spaces available). There will be approximately three
(3) vehicle trips per day to and from the subject property including amlty and the single
employee on-site. Except during the operation of the off-site touring business and when I
am training with the dogs or competing in races, the dogs will be kenneled on-site. Hours
of operation of the oflsite tour business will be from 8:00 a.m. to 5:00 p.m. Sunday
through Saturday (7 days a week) during the winter months, snow conditioni permitting.
Originally, waste remaining on-site was proposed to be treated in a large p1t, first by
burning and then adding lime. I am proposing a maximum of forty (40) dogs at any one
time on premises. These dogs are to be tethered in clustered outdoor kennelJimmediately
adjacent to the steel building located approximately 150 feet south of my residence.
Objective 4.1 (Commercial and Industrial Uses) encourages compatibility with adjacent
land uses. Because the area is rural in nature it is an acceptable lotation for the proposed
special use. Again, no "commercial" touring activities will occur on-site. If opiraied in
accordance with the noise abatement regulations and waste disposal controls proposed in
the Zone Text Amendment request, no adverse impacts to adjacent propertiei should
occur.
In addition, the dog sledding tours which I hope to operate in the upper Four Mile park
area would further promote Objective 5.1 (Recreation and Open Space) of the
Comprehensive PIan, which states that uses should "encourage the location of active
recreational opportunities that are accessible to county residents."
The subject property is zoned Agricultural/Residential/Rural Density (A/R/RD) which
allows kennels as a Special Use. I believe that I can successfully operate a kennel in
accordance with the noise abatement and waste disposal regulations proposed in the
companion Zone Text Amendment request. The noise abatement regulations would
impose objective, measurable noise level standards which are consistent with the State's
standards, and the waste disposal regulations would permit the State Health Department to
recorrunend appropriate waste disposal practices on a site-specific basis.

the permit does not assure the applicant that no injury will occur to another vested water right or preclude

The use of ground water from this well is limited to Iire protection, ordinary household purposes inside up to
3 single family dwellings, the irrigation of not more than one (1) acre of home gardens and lawns and the
watering of domestic animals.
The maximum pumping rate shall not exceed 15 GPM'
The return flow from the use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.
This well shall be constructed not more than 200 feet from the location specified on this permit.

Mountain Reservoir which ui. B**u of Reclamation projects. Federal policy relating to endangered

interruptible. Moreover, the forces of nature are always such that no source of water can be
guaranteed from year to year. West Divide continues to make good-faith efforts to obtain alternative

Applicant, hereby applies to the Wes.t Divide Water Conservancy District, a political subdivision of tt e Stute of Coloradq
organized pursuant to and existing by virtue of c.R.S. 1973, 53745-101, et seg., (hereinafter referred to as the'District') for an allofrnent
contract/lease to beneficially and perpetually use water or water righrc owned, leased, or hereafter acquired by the District. By execution of
this contract/lease and the attached application, Applicant hereby agrees to the following terms and conditions:
l. Wat., Riehts: Applicant shall own water rights at the point of diversion herein lawfully entitling Applicant to
]ir".t water, which will be supplemented and augmented by water leased herein. If Applicant intends to divert through a well, it must be
Vunderstood by Applicant that no right to divert exists until a valid well permit is obtained fiom the colorado Division of water Resources.
2. Ouantitf Water applied frr by the Applicant in the amount set forth above shall be diverted at Applicant's point
ofdiversion fiom the Disricts dir€ct flow water rights, and when water is unavailable for diversion pursuant to administration by the Colorado
State Engineer during periods when said direct flow water right is not in priority, the District shall release for the use of Applicant up to said
quantity in acre feet per.year ofstorage water owned or controlled by the District. It is undentood that any quantity allotted from direct flow,
storage or otherwise, to the Applicant by the Distict will be limited by the priority of the District's decrees and by the physical and legal
availability ofwater fiom Disrict,s sources. Any quantity allotted will only be provided so long as water is available and the Applicant fully
mmplies with all ofthe terms and conditiqrs ofttris contact/lease. The Distict and the Applicant recognize that some of the Distric's decrees
may be in the name ofthe Colorado River water Conservation Distric! and the ability of the District to allot direct flow right to the Applicant
may be dependeat on the cons€nt of the colorado River water conservation District. If at any time the Applicant determines it requires less
water than the amount herein providd Applicant may so notiry the Disrict in writing, and the amount of water allotted under this
contract/lease shall be reduced permanently in accordance wittr such notice. Rates shall be adjusted accordingly in following water years only.
3. Beneficial Use and Location ofBeneficial Usq Any and all water allotted Applicant by the Distria shall be used
for the following boreficial use or uses: muricipal, domestic and related uses, or commercial (except to the extent that Ruedi Reservoir water
may not be available for commercial as that term is defined on Page 5 of Conhact No. 2-07'70-WO547 between the United States and the
West Divide Water Conservancy Di*ia). Applicant's beneficial use of any and all water allotted shall be within or through facilities or upon
land owned, leased, operatd or under Applicant's control'
4. Decrees and Delivew: Exchange releases made by the District out of storage from Ruedi Reservoir and Green
Mountain Reservoir, or other works or facilities of the District, or from other sources available to the District, shall be delivered to the
Applicant at the outl€t works of said storage ficilities or at ttre decreed point of diversion for said other sources, and release or delivery of water
! *"n outlet or points shall constitute performance of the Districts total obligation. Delivery of water by the District tom Ruedi Reservoir
or Green Mountain Reservoir shall be subject to the District's lease contracts with the United states Bureau of Reclamation' Releases from
other facilities available to District shall be subject to the contracts, laws, rules, and regulations goveming releases therefrom' Furthermore,
the District hereby expressly reseryes the right to store water and to make exchange releases from structures that may be built or controlled
by the Distria in the future, so long as the water service to the Applicant pursuant to this agreemen! is not impaired by said action' Any
quantity ofthe Applicant's allocation not delivered to or used by Applicant by the end of each water year (october l), shall revert to the water
supplies of the District. Such reversion shall not entitle Applicant to any refund of payment made for such water'
Water service provided by the Disrict shall be limited to the amount of water available in priority at the original point of
diversion of the Districts applicable water right, and neither the District, nor those entitled to utilize the District's decrees, may call on any
gr€ater amotmt at new or altemate points of diversion. The District shall request the colorado Division of water Resources to estimate any
conveyanc€ losses between the original point and any altemate point, and such estimate shall be deducted from this amount in each case'
5. Decrees for altemate points of diversion ofthe Districts
water rights or storage waler may be required in order for Applicant to use the water service conternplated hereunder' obtaining such decree
is the exclusive responsibiliry of Applicant. The District reserves the right to review and approve any conditions which may be attached to
judicial approval of said altemate point of diversion as contemplated or necessary to serve Applicant's facilities or lands' Applicant

and agrees that it shall be solely responsible for the procedures and legal algineering costs necessary for any changes in water
e* *t"*prur.a herein, and fi.rther agrees to indemnifi the Disria fiom any costs or losses related thereto. Applicant is solety responsible
for providing works and facilities necessary to obtain/divert the waters at said alternate point of diversion and deliver them to Applicant's
intended beneficial use. Inespective ofthe amount ofwater actually bansferred to the Applicant's point of divenion, the Applicant shall make
annual payments to the District based upon the amount of water allotted under this contract/lease'
In the event the Applicant intends to apply for an altemate point of diversion and to develop an augmentation plan and
institute legal proceedings for the approval of such augmentation plan to allow the Applicant to utilize the water allotted to Applicant
hereunder, the Applicant shall give the District written notice of such intent. In the event the Applicant develops and adjudicates its own
augmentation plan to utilize the water allotted hereunder, Applicant shall not be obligated to pay any amount under Paragraph l9 below. ln
any event, the District shall have the right to approve or disapprove the Applicant's augmentation plan and the Applicant shall provide the
District copies ofsuch plan and of all pleadings and other papers filed with the water court in the adjudication thereof.
6. Co,ntracvlease pavmenE Non-refi,ndablg one time administrative charge, in the amount determined by the Board
of Directors of the District from time to time, shall be submitted with the application for consideration by the Distict.
Annual payment for the water service dccribed herein shall be determined by the Board of Directors of the Distria. The
initial annual payment shall be made in full, within thirty (30) days after the date of notice to the Applicant that the initial payment is due.
1}"ia notice will advise the Applicaqt, among other things, of the water delivery year to which the initial payment shall apply and the price
which is aPPlicable to that Year'
Annual payments for each year thereafter shall be due and payable by the Applicant on or before each January l. Ifan
annual payment is nct made by the duc date a flat $50 late fee will b€ assessed. Final written notice prior to cancellation will be sent certified
mail, retum receipt requestd to the Applicant at such address as may be desigrated by the Applicant in writing or set forth in this

construed so as to prevent the District fiom adjusting the annual rate in its sole discretion for future years only'
If payment is nct made within fiftEm (15) days after the date of said written notice, Applicant shall at District's sole option
have no fi.'ther righg title or inter€st under this contract/lease without fi.uther notice, and delivery may be immediately curtailed' The allotrnent
of water, as herein made, may be hansfened, lease4 or otherwise disposed of at the discretion of the Board of Directors of the District-
Upon cancellation of this water allotrnent conmct/lease with the Disrict, ttre Disuict shall notiff the Division of Water
Resources offices in Denver and Glenwood Springs. The Division of water Resources may then order cessation of all water use.
7. Additional Fees and Ccs: Applicant agrees to defray any expenses incuned by the Distic in connection with
the allclrnent of water rights hereunder, including but nct limited to, reimbursement of legal and engineering costs incuned in connection with
any water rights and adjudication nec€ssary to allow Applicant's use of such allotted water rights.
g. Assiprrment This oontract/lease shall inure to the benefit of the heirs, successors or assigns of the parties hereto.
Any assignment ofthe Applicanfs rights undertris contract/lease shall be subject to, and must comply with, such requirements as the District
may hereafter adopt regarding assignment ofcurract/lease rights and the assumption of conhact/lease obligations by assigrrees and successors.
d.lothing herein shall prevent succ€ssors to a por.tion of Applicant's property from applying to the District for individual and separate allotrnent
Iontracts/leases. No assignment shall be recogrrized by the District exc€pt upon completion and filing of proper forms for change of
ownershiP.
Upon the sale of the real property to which this contract/lease pertains, Applicant has a duty to make buyer.aware of this
contract/lease and proper forms for change ofownership must be completed.
g. Other Rules: Applicant shall be bound by the provisions of the Water Conservancy Act of Colorado; by the rules
and regulatiors ofthe Bmrd ofDirectors ofttre Disrict; and all amendments thereof and supplements thereto and by all other applicable law.
10. Ooeration and Maintenance Agresnent: Applicant shall enter into an "Operation and Maintenance Agreernent"
with the District under terms and conditions deermined by the board of Directors of the Disrict, if and when, the Board of said District
deennines in its sole discretion that such an agreement is required. Said agreement may contain, but shall not be limited to, provisions for
additional annual monetary consideration for extension of Disrict delivery services and for additional administration, operation, and
maintenance costs; or for other costs to the Disrict which may arise through services made available to the APPlicant.
I l. Chanee ofUse: The Disfict reserves ttre crclwive right to review, reapprove or disapprove any proposed change
in use of the water allotted hereunder. Any use other than that set forth herein or any lease or sale of the water or water rights allotted

12. Use and place of Use: Applicant agrees to use the water in the manner and on the property described in the
documens submitted to the District at the time this contract/lease is executed, or in any operation and maintenance agreernent provided by

13. 'fitle: It is undentood and agreed that nothing herein shall be interpreted to give the Applicant any equitable or
legal fee title interest in or to any water or water righr refened to herein.
14. Corsenatiqr: Applicant shall use commonly accepted conservation practic€s with respect to the water and water
rights hereiq and hereby agrees to be bornd by any conservation plan adopted hereafter by the District for use of Disuict owned or connolled
water or water rights'
15. Resu.ictior|s: Applicant shall resfict actual diversions to not exceed the Contract/I-€ase amount, which provides
water (on the formula of one acre foot per dwelling) for ordinary household purposes inside one single family dwelling, the watering of
domestic liyestock, fire protection, and the irrigation of up to 6,000 square feet of lawn and garden'
Applicant shall also mmply with all restrictions and limitations set forth in the well permit obtained from the Colorado
Division of Water Resources.
Watering of livestock shall be restricted to Applicant's domestic animals not to be used for commercial purposes unless

16. Well permit If Applicant intends to divert through a well, then Applicant must provide to District a copy of
Applicant's valid well permit before Disfict is obligated to deliver any water hereunder'
17. Measurine Dwice or Meter: Applicant agrees to provide, at its own expense, a totalizing flow meter with remote
reado,t o oontinuously and accurately measure at all times all water diverted pursuant to the terms of Applicant's water right and the terms
ofthis conrtact/lease. Applicant agrees to provide accurate readings fiom such device or meter to District upon District's request. Applicant
acknowledges that failure to comply with this paragraph could result in legal action to terminate Applicant's diversion of water by the State
ofCotorado Division ofWater ResoIces. By signing this mntract, Applicant hereby specifically allows District, through is authorized agent,
to enter upon applicant's property during ordinary business hours for the purposes ofdetermining applicant's actual use ofwater.
lg. Representations: By executing this contract/lease, Applicant agrees that it is not relying on any legal or
engineering advice that Applicant may believe has been received fiom the District. Applicant further acknowledges that it has obtained all
necessary lepl and argineering advice torn Applicant's own sources other than the District. Applicant further acknowledges that the District

Should the Disuict be unable to provide the water contracted for herein, no damages may be assessed against the District, nor may Applicant

19. Ccs ofWater Court Filing and Auernentatim Plan: Should the DisfiiG in its own discretion, choose to include
-Applicands contracr/lease herein in a water court filing for altemate point of diversion or plan of augmentation, then Applicant hereby agrees
to pay to the District, when assessed, an additional fee representing the District's actual and reasonable costs and fees for Applicant's share
ofthe proceedings. Applicant shall be assessed a pro-rata share of the total cost incuned by the District in preparing, filing and pursuing to
decree the water court case. The prorata share shall be calculated by dividing such total cost by the number of contractees/lessees included
inthefiling. Totheo<tenttlrattheDisriaiscausedadditional costsbecauseofobjectionfiledspecificallyduetotheinclusionofApplicant's
contract/lease in the filing, such additional costs may be charged specifically to Applicant and not shared on a pGftrta basis by all
confiactees/lessees.
