The subject property currently lras a log house (applicant's primary residence) and a 30' x 50' steel building -ot -rit" to be used for the kennel. The subject propertyis _ accessed via a thirty foot (30) recorded "non-exclusive" access easement offof County Road 125. The applicant is proposing a dog kennel on-site to house, raise and breed husky dogs for personal dog sledding/raci"g a"a a future toui ldog sledding) business to be run oflsite. The tour business is a future venture where the dogs are to ue Lougtrt to a designated site ( ofl site) to meet clients for dog sledding tours. No parking of iehicles by clienti is to occur on- site. Client vehicles are to be parked at the ofl site area where the dog sledding tours are to occur. A total of five ( 5) employees is envisioned at the height of the tour busiiess. One ( I ) employee will reside on-site to help with the dogs and an additional "-f,ny"" along with a total of three (3) guides will be emqlgved for the tour business, not to reside on- site'. The applicant is proposing a maximum of forty (40) dogs at anyone time on premises. The dogs are to be tethered in ,-, clustered outdoor kennels immediately adjacent to the steel building located approximately 150 feet t south of the main residence. II . ZONING RESOLUTION : The subject property is zoned AgriculturallResidential,/Rural Density (AIR/RD) which allows a kennel as a Special Use. A kennel is defined as follows in Section 2.02.311 " An establishment other than a pet shop or veterinary clinic, in which more than four ( 4) adult dogs or domesticated animals are housed, groomed, bred, boarded, or trained, with or without fees being charged for services and no more than two litter of dogs or domesticated animals are bred in anyone calendar year." The applicant's proposed kennel meets this definition. All Special Use permit applications are required to meet the following three basic standards contained in Section 5.03 ofthe Zonng Resolution: As listed under the Zone District Regulations, conditional and special uses shall conform to all requirements listed thereunder and elsewhere in this Resolution plus thefollowing requirements: (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissionerc shall either be in place or shall be constracted in conjunction with the proposed use; The applicant has stated that he has a commercial well permit No. 54336-F, which allows all of the uses proposed in the application. According to a letter from the Division of Water Resources, dated September 6,2000, well permit No. 54336-F will expire August 15, 2001 unless the well is put to use and a Statement of Beneficial Use is submitted to the State. The permit and verffication ofthe Statement of Beneficial Use has been submitted to the State Division of Water Resources and is included in the application. 2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient occess to the use shall either be in place or shall be constructed in conjunction with the proposed use; The proposed use will access the property via an existing 30 ft. wide private access easement offof CR 125. A kennel will not have a signfficant impact on the access easement or County Road 125. (3) Design of the proposed use is organized to minimize impact on andtmm adjacent uses of land through installation of screenfences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character; The nearest residential uses to the proposed kennel are located less than % ml/te away in the Fourth Filing of Oak Meadows Ranch PUD in the Four Mile Creek drainage to the west of the site. Springridge Place subdivision residents have complained in the past about the applicant's previous kennel operation noise due to barking dogs. As a part of the last application, the applicant proposed to have a noise study done to demonstrate the level ofnoise impact from the property to barking dogs to adjacent properties. No such study has been submitted. At this time the application does not propose any sound mitigation measures. At this time, the applicant has not met this standard. At the time of the staffreport being written, a kennel is required to meet the previous standards in Section 5.03 and the following standards contained in Section 5.03.15, which are the following: 5.03.15 Kennel: (l) All kennels shall be completely enclosed within a building that prevents any soundsfrom emonatingfrom the propefi boundary in all agricultural and residential zone district. Commercial zone districts may allow kennek with outdoor dog rans, provided dogs are only allowed outside during the hourc of 8:00 u.n. to 5:00 p.m. and it can be demonstrated that no noise will emanate beyond the property boundaries to any residential area after those hourc. As noted previously, the applicant has not proposed any sound mitigation measures and would not comply with this standard, since the dogs are not proposed to be within a building of any sort. (2) No dust, nohe, odorc or source offtkh shall emanatefrom the propefi. There is no discussion ofthe method of dealing with dust, noise, odors or source of filth, other than to say that the property is located in rural area that is appropriate for such a use. (3) An individual sewage disposal system capable of handling all wastefor the kennel shall be installed The proposed open pit for animal waste, with lime added is not an individual sewage disposal system. @ No outdoor dog runs will be allowed, except in commercially zoned areas and approved with conditions consistent with u. above. The application proposes to keep the dogs all outside and tethered . It is not a commercially zoned area. The proposed new Section 5.03.15 kennel standards are as follows: Q) AA kennels sholl be completely enclosed within a building that prevents any soundsfrom emanatingfrom the property boundary in all agricultural and residential zone district unless it can be demonstrated that no noise will emanate beyond the properly boundaries in excess of the standards established by CRS S 25-12-103 to any residential area. The application does not contain any ffirmation regarding noise impacts beyond the property boundary. (2) No noise in ucess of the stundards contained in CRS S 25-12-103, dust, odors or source offtlth shall emanatefrom the property. The application states that due to rural nature of the property proposed for the kennel, there should not be any impacts resulting from noise, dust, odors or source of filth from the property. 3) A waste container capable of handling all wastefor the kennel shall be installed. It shall be demonstrated thot the owner con properly dispose of the woste. The applicant has proposed digging a pit and putting the waste in it, then adding lime and buming the waste. There is no identificutio, of ttr" locatlon, dimensions or any other criteria to judge the proposed pit in terms of adequacy. As noted in the zoning discussion, this does not provide any ground water protection by just digging a pit, nor is there any assurance the pit will not over flow and result in a surface discharge to adjoining property. (4) No outdoor dog runs will be allowed, acceptfacilities that meet the previous conditions and are approved with conditions consistent with a. above. None of the above criteria have been addressed in the application, other than the general statement that there will be no impacts. III. SUGGESTED FTNDINGS: l. That proper postmg and public notice was provided as required for the hearing before the Board of County Commissioners. 2.Thatthe hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed Special Use Permit is not in the best interest of the healttr, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. Thatthe application is not in conformance with Sections 5.03 (1),5.03 (3),5.03.15 (1),5.03.15 (2), and 5.03.15 (3) ofthe Garfield county zonngResolution of 1978, as amended. IV. RECOMMENDATION Staff recommends that the application be continued to a date certain, to allow the applicant to provide additional information to deal with the standards required by the amended resolution. Single commercial well, Commercial Permit #54336-F, which allows for the watering of domestic animals. ISDS. A/R/RD A/R/RD NARRATIVE DESCRIPTION OF THE PROPOSAL: I am requesting a Special Use Permit for the purpose of allowing a Kennel in conjunction with and pursuant to the anticipated approval of a Zone Text Amendment request dated March 7, 2000 proposing standards for kennel noise abatement and sanitary waste disposal issues. My property currently has a log house (my primary residence) and a 30' x 50' steel building. The property is accessed from Dry Park Road via a thirty foot (30') recorded "non-exclusive" access easement. I am proposing a dog kennel on-site to house, raise and breed husky dogs for personal dog sledding/racing and a future tour (dog sledding) business to be run off-site. The tour business is a future venture where the dogs are to be brought to a designated site (offsite) to meet clients for dog sledding tours. No parking of vehicles by clients is to occur on- site. Client vehicles are to be parked at the off-site area where the dog sledding tours are to occur. A total of five (5) employees is envisioned at the height of the tour business. One (l) employee will reside on-site to help with the dogs and an additional employee along oo o a o with a total of three (3) guides will be employed for the tour business, not to reside on- site. Ample parking is available on-site for the residents of the premises and the single employee to be on-site (12+ parking spaces available). There will be approximately three (3) vehicle trips per day to and from the subject property including family and the single employee on-site. Except during the operation of the off-site touring business and when I am training with the dogs or competing in races, the dogs will be kenneled on-site. Hours of operation of the off-site tour business will be from 8:00 a.m. to 5:00 p.m. Sunday through Saturday (7 days a week) during the winter months, snow conditions permitting. Objective 4.1 (Commercial and Industrial Uses) encourages compatibility with adjacent land uses. Because the area is rural in nature it is an acceptable location for the proposed special use. Again, no "commercial" touring activities will occur on-site. If operated in accordance with the noise abatement regulations and waste disposal controls proposed in the Zone Text Amendment request, no adverse impacts to adjacent properties should occur. In addition, the dog sledding tours which I hope to operate in the upper Four Mile Park area would further promote Objective 5.1 (Recreation and Open Space) of the Comprehensive Plan, which states that uses should "encourage the location of active recreational opportunities that are accessible to County residents." The subject property is zoned Agricultural/Residential/Rural Density (A/R/RD) which allows kennels as a Special Use. I believe that I can successfully operate a kennel in accordance with the noise abatement and waste disposal regulations proposed in the companion Zone Text Amendment request.
