HomeMy WebLinkAbout2.0 Director's Decision 03.14.2012Gurfield County BUILDING & PLANNING DEPARTMENT March 14,2012 John Gudger Wong Strauch Architects 820 Santa Fe Drive Denver, CO 80204 RE: Public Seruice/Xcel Energy a Non-Substantial Amendment to an Existing Land Use PermiUApproval (File No. SUAA-7171, amending File No. SUAA-6958) Dear John: Your application submitted on behalf of Public Service Company of Colorado and Xcel Energy, for a Second Amendment to a Land Use PermiUApproval associated with the Rifle Substation was deemed technically complete today, March 14,2012. This determination is in part made possible by the Director's waiver of some submittal requirements provided with the original amendment request. The Application requests a Non-Substantial Amendment to the recently approved amendment (SUAA-6958) to allow the building footprint for the proposed 3,000 sq.ft. storage building to be shifted to the south 20 ft. The property is located at 620 County Road 319, Rifle, CO 81650. The site is also known byAssessor's Parce! No.2177-144- 00-126. The Application information contained updated site plans and drainage plans as appropriate for the shifted building footprint. The relocation is required based on the discovery of a major underground electric line within the original building footprint. No further information is requested to complete the Application. Based on the Staff review and pursuant to Section 4-107( )(SXa), and Section 16-101, Definition of Non-Substantial Change of the Garfield County Unified Land Use Resolution of 2008, as amended (ULUR), the Director of the Garfield County Building and Planning Department has determined that the Amendment request is considered to be a Non- Substantial change and has approved the proposed amendment to the Land Use Change Permit. Based on this determination no referrals shall be required. This determination is subject to the following conditions: a. All prior approvals including but not limited: (i) Resolution No.80-243 and conditions of approval for the Public Service Company of Colorado - Xcel Energy Rifle Substation; and (ii) Public Service Company of Colorado - Xcel Energy Amended Land Use Change Permit - Special Use Approval dated 10124111, shall remain in effect except as amended herein. 108 Eighth Street, Suite 401 . The storage structure shall be limited to a maximum of 3,000 sq.ft. and shall comply with all zoning and building code requirements inctuding grading and drainage torthe proposed improvements. The Building footprint shall be shifted louth approximately 20 ft. as shown on the revised site plans. c. The building permit submittal shall contain storm water management plans and best management practices prepared by a licensed professional engineer for the relocated drainage swale adjacent to the building and any other related storm water impacts. d. The amended site plan shall be attached as an exhibit to the Amended Land Use Change Permit issued for the non-substantialAmendment request. ln accordance with Section 4-107(A)(6), this review letter - notice of decision, will be sentto the Board of County Commissioners which have a 14 day review period in which to decide whether to reconsider (call up) the Director's Decision. lou are also required to send a notice of decision to all adjacent property owners within 200 ft. of the subject property within 5 working days of this decision.' A courtesy notice form is attached for your convenience. The Applicant must verify all information frovidedin the notice and correct any deficiencies such that proper notice in form and substance can be established. The mailing must be completed no later than March 21,2012. please present to the Building and Planning Department copies of certified return receipts from your mailings once completed. Please note that if no request for reconsideration is filed with the County within 14 days of the date of the Director's decision, it shall become final.
