HomeMy WebLinkAbout4.0 Resolution 97-278/3 STATE OF COLORADO County of Garfield )ss ) At a regular hearing of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on Monday , the 7th of April A.D. 19 97 , there were present: Marian I. Smith , Commissioner Chairman John Martin , Commissioner Larry McCown Commissioner Don DeFord ,County Attorney Mildred Alsdorf , Clerk of the Board Chuck Deschenes , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 97-27 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT FOR SNYDER OIL CORPORATION/SOUTHEAST PICEANCE JOINT VENTURE WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Snyder Oil Corporation/Southeast Piceance Joint Venture to allow an additional natural gas compressor and related equipment on the following described tract of land: See Attached: Exhibit A (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 4th day of November, 1996, upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. 1111111 11111 111111 11111 111111 11111 11111 111 11111 1111 1111 506741 04/08/1997 03 37P B1014 P813 447 1 of 4 R 0.00 D 0.00 N 0.00 GARFIELD COUNTY CLER 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit be and hereby is authorized permitting the use of the above described tract of land for an additional natural gas compressor and related equipment, upon the following specific conditions: That all representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. That prior to the operation of the additional facilities, all air pollution emission permits shall be issued by the Colorado Department of Health and opration of the facilites shall be consistent with the conditions of apporval of such permit(s). Upon receipt of the permit(s), copies shall be submitted to the Planning Department for review. That the amount of noise to be generated by the operation of this facility be consistent with the predicted amounts as contained in the Staff Report. The predicted amounts will be used as the maximum allowable level and if sound power levels exceed these limits, immediate mitigation must take place at the sole expense of the operator of the facility. That the construction of the foundation for the engine/compressor unit and all other facilities shall be done in a manner to prevent perceptible vibration from occurring outside of the propoerty boundary as it exists on the Existing Conditions Survey Map. Any foundation shall be constructed with respect to the shrink -swell and erosive potential of the soil, as identified by the Lincoln DeVore soil study. That construction at the site shall be accomplished in a manner to control further erosion of the parcel. That reclamation and revegetation of the site shall be required when the operator ceases use of the faciity, in a manner that returns the site to its original, preconstruction state. That the applicant file an updated emergency plan with the Rifle Fire Department and the Garfield County Department of Emergency Management, prior to the issuance of the Special Use Permit. That any out-of-state vehicles used in theconstruction, operation or maintenance of the facility shall be registered or apportioned in the State of Colorado. 8. That the Special Use Permit shall be issed upon demonstration of satisfactory compliance of all listed conditions of approval. 9. That the applicant/operator of the faciliyt shall control noxious weeds on the site.
