from a public right-of-way, with notice signs provided by the Planning Department.
The posting must take place at least thirty (30) but not more than sixty (60) days
prior to the hearing date and is the sole responsibility of the applicant to post the
notice, and ensure that it remains posted until and during the date of the hearing.
4. The Applicant is required to appear before the Board of County Commissioners at the time
and date of the public hearing at which time the Board will consider the request. In addition,
the Applicant shall provide proof, at the hearing, that proper notice was provided.
5. Once the Board makes a decision regarding the Special Use request, Staff will provide the
Applicant with a signed resolution memorializing the action taken by the Board. Following
the Board's approval, this office will issue the Special Use Permit to the applicant. If the
Board's approval includes specific conditions of approval to be met, this office will not issue
the Official Special Use Permit certificate until the applicant has satisfied all conditions of
approval. The Special Use Permit approval is not finalized until this office has issued the
Official Special Use Permit certificate signed by the Chairman of the Board of County
Commissioners.

9. Depending on the type of Special Use Permit requested, you may need to respond to
additional review standards in the Garfield County Zoning Resolution Section 5.00
[Supplementary Regulations]. This may include uses such industrial uses [section 5.03.07 &
5.03.08], Accessory Dwelling Units [section 5.03.21], Utility line/Utility Substations, etc. Specific

obtained from this office
10. A $400.00 Base Fee: Applicant shall sign the "Agreement for Payment" form and provide the
fee with the application.
11. Submit 2 copies of this completed application form and all the required submittal materials to
the Building and Planning Department. Staff will request additional copies once the Special
Use Permit application has been deemed technically complete.
II. PROCEDURAL REQUIREMENTS
(The following steps outline how the Special Use Permit Application review process works in
Garfield County.)
1. Submit this completed application form, base fee, and all supplemental information to the
Garfield County Planning Department. It will be received and given to a Staff Planner who
will review the application for technical completeness.
2. Once the application is deemed technically complete, the Staff Planner will send you a
letter indicating the application is complete. In addition, Staff will also send you a "Public
Notice Form(s)" indicating the time and date of your hearing before the Board of County
Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum
regarding your requested Special Use. (If Staff determines you application to be deficient,
a letter will be sent to you indicating that additional information is needed to deem your
application complete.)
3. It is solely the Applicant's responsibility to ensure proper noticing occurs regarding the
requested Special Use and the public hearing. If proper notice has not occurred, the
public hearing will not occur. Notice requirements are as follows:
a. Notice by publication, including the name of the applicant, description of the subject
lot, a description of the proposed special use and nature of the hearing, and the
date, time and place for the hearing shall be given once in a newspaper of general
circulation in that portion of the County in which the subject property is located at
least thirty (30) but not more than sixty (60) days prior to the date of such hearing,
and proof of publication shall be presented at hearing by the applicant.
b. Notice by mail, containing information as described in the paragraph above, shall
be mailed to all owners of record as shown in the County Assessor's Office of lots
within two hundred feet (200') of the subject lot and to all owners of mineral interest
in the subject property at least thirty (30) but not more than sixty (60) days prior to
such hearing time by certified return receipt mail. and receints shall he nresented at
the hearing by the applicant.

GARFIELD COUNTY BUILDING AND PLANMNG DEPARTMENT
AGREEMENT FOR PAYMENT FORM
(Shall be submitted with application)
GARFIELD COUNTY (hereinafter COUNTY) and
(hereinafter APPLICANT) agree as follows:
1. APPLICANT has submitted to COUNTY an application for
(hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended,
establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for the
administration of the fee structure.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
application. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to
thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional
payments upon notification by the COUNTY when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of consulting
service determined necessary by the Board of County Commissioners for the consideration of an application or
additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs exceed the
initial Base Fee, APPLICANT shall pay additional billings to COUNTY to reimburse the COUNTY for the
processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid prior to
the final consideration by the COUNTY of any land use permit, zoning amendment, or subdivision plan.

Statement specifically responding to criteria established in Section 5.03 of the Garfield
County Zoning Regulations in support of request for a Special Use Permit for a 30'
communications tower to be located at: 260 Lazy S Reverse Rd, New Castle, CO 81467
(1) The proposed use requires no water or sanitation service. Electrical and
Telecommunications service are available for the proposed use.
(2) No street improvements are proposed or necessary; the proposed use is an
unmanned site that will be visited infrequently for maintenance or repair.
The existing road is adequate for this proposed amount of traffic.
(3) The site has been designed to have the least amount of possible impact on
all adjacent uses. At only 30' in height the proposed communications
mast is the no taller than necessary for the safe operation of the proposed
air traffic control network and is setback from the nearest adjoining
property by a distance of 150' feet. Given the rural nature of the property,
amount that the facility is setback from adjoining properties a standard
chain link fence is proposed for safety and security. No regular lighting or
beacons are included in this proposal and any signs will be small and
visible only by visitors to the site. No detrimental effects to the established
character of the surrounding area are anticipated by this proposed use.

Additional Statement specifically responding to criteria established in Section 5.03.13 of
the Garfield County Zoning Regulations in support of request for a Special Use Permit
for a 30' communications tower to be located at: 260 Lazy S Reverse Rd, New Castle,
CO 81467

The proposed facilities comply with all relevant radio frequency emissions
requirements of the Federal Communications Commission. The
particular antenna to be installed at this location is a receive only antenna
and will receive at 1090 MHz, with no transmissions from the site no FCC
license is required for the operation of the facility.
(2) Collocation on an existing tower or structure is not an option for this
particular site. This site is one of 9 planned sites for the proposed Garfield
County Airport Air Traffic Control System, each of the nine sites have to
be placed around the airport in such a manner as to provide complete
coverage of the Airport. In the geographical Area in which this antenna
site needs to be located, there is no existing structure that is adequate
upon which to collocate the proposed site. As the collocation of 8 of 9
proposed sites demonstrates, every effort has been made to collocate sites
where possible.

In the ARRD (Agricultural/Residential/Rural Density) district in which
this facility is proposed the maximum building height is 25'. The
proposed support structure including antennas is 30', which is the
minimum height, required for the site to work as part of the proposed Air
Traffic Control System. Therefore, we request from the Board an
Exception to allow for an overall structure height of 30'
a) The existing land forms, vegetation and structures on the Smith
Property, along with the distance from other uses will provide
adequate screening of the proposed facility.
b) The design, materials and colors of the antennas and their support
structure shall be consistent, so as to blend in with the surrounding
environment and the monopole structure proposed tapers from base to
tip, to be as minimally visually obtrusive as possible.
c) No other communications sites exist at this location.

An Application for A Special Use Permit submitted to Garfield County Colorado on behalf of
Sensis Corporation and Pyramid Network Services to allow for the Construction of a
Proposed 30' Communications Tower to support Air Traffic Control Beacon and 30' by 30'
fenced compound to be located at 260 Lazy S Reverse Rd, New Castle, CO 81467 on
property owned by William V. & Eunice M. Smith.
Nature and Character of Request
Sensis Corporation has been retained by the Colorado Department of Transportation to construct
and maintain a Control Beacon Interrogator Automatic Dependent Surveillance — Broadcast System
— which will allow airplanes using the Garfield County Airport to report their positions directly and
continually to the FAA Denver Traffic Control Center. This system will greatly increase safety and
efficiency for planes landing at the Garfield County Airport.
The proposed system consists of 9 small antennas deployed around the airport of which the
proposed tower on the Smith property is designed to provide a needed location for one of the
antennas required for the deployment of the proposed system. It should be noted, that of the 9
necessary antenna sites, this is the only site that is going to require the construction of a new
communications tower, each of the other 8 sites will be collocated on existing towers or structures.
The tower proposed for the Smith Property is a 30' monopole communications mast supported by 3
guide wires; it is engineered for the specific conditions of the property and proposed use of hosting
an air traffic control antenna. It is proposed at a height no higher than is necessary for the operation
of the proposed air traffic network. The tower will be surrounded by a 30' by 30' chain link fenced
gravel compound, within which will be radio equipment to support the operation of the site. The
radio equipment will be housed in all weather equipment cabinets; no structures or equipment
shelters are proposed.
This will be an unmanned facility operating 24 hours a day. The site will be visited a couple of
times per year for maintenance by service personnel driving service vans or light trucks, no
significant increase in vehicle traffic is anticipated by this use following construction.
Operation of the site will require electrical and telecommunications service, both of which are
available at the proposed site. No water will be used at the site nor will any wastewater be generated
by the site.
