William & Eunice Smith Ross Kauffman, Beacon 360, LLC South of the Town of Silt, CO 40 acres Agricultural Residential Rural Density Approval 217923300202 -1- BOCC 04/14/2008 CR I REQUEST The requested Special Use Permit will allow construct a Control Beacon Interrogator Automatic Dependent Surveillance — Broadcast System. Specifically, the requested Special Use Permit will the construction of a 30' monopole communication mast supported by three (3) guide wires to host an air traffic control antenna. The proposed facility is part of the proposed Garfield County Airport Air Traffic Control System and will host a "receive only" antenna to report aircraft positions the FAA Denver Traffic Control Center. I_. -ti.- SITE LD NAM: StW ai NA Sensis SENSIS SITE PLAN INO TOWER ELEVATION II REFERRALS Town of Silt: No comments received Garfield County Airport: No objection to proposal CO-AMER-RS-02 III 4 5.03 Review Standards Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use; Staff Finding The proposed use will not require water or sanitation services. Street Improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use; -2- BOCC 04/14/2008 CR Staff Finding The Applicant's request is to construct an un -manned facility that will not generate daily traffic. It is represented that once constructed the only traffic generated by the proposed use will be for maintenance and repair. Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character; Staff Finding The proposed facility is to be located within a rural parcel in Garfield County. It is represented that the communication tower will be constructed 150' from the nearest property line. A chain link fence for safety and security purposes will enclose the facility. The application specifically states that lighting will not be utilized on-site and that signs will small and only visible to visitors of the proposed site. IV 45.03.13 Broad Casting Studio and/or Communication Facility (1) All facilities shall comply with the radio frequency emission requirements of the Federal Communication Commission and any facility in compliance cannot be denied. Staff Finding The proposed facility will receive communication from 1090 MHz with no transmission from the site. A Federal Communication Commission license is not required for the proposed facility. Staff has included a condition of approval requiring the compliance with all Federal, State and Local regulations governing this type of facility. (2) The co -location of telecommunication facilities on one site is encouraged and the denial of a landowner/lessor of the co -location of a site shall be based on technical reasons, not on competitive interests. It is the County's policy to minimize the number of communication facilities by the encouragement of co -locating such facilities. Staff Finding In all, nine (9) sites have been located for the proposed Garfield County Airport Air Traffic Control System. The placement of each facility is to be done in a manner to provide complete coverage of the airport. It is represented that in the geographical area which the proposed facility needs to be located, co -location options do not exist. (3) A freestanding telecommunication facility, including antennas, shall not exceed the maximum structure height in the applicable zone district unless an exception is approved by the Board based on the applicant demonstrating the following: - 3 - BOCC 04/14/2008 CR Staff Finding The Applicant is requesting that the Board allow construction of a 30' tower which exceeds the maximum height requirement by 5'. As identified in §5.03.13 (3) at the Board discretion an Applicant may deviate from the maximum height requirement is the following can be demonstrated. (a) Use of existing land forms, vegetation and structures to aid in screening the facility from view or blending in with the surrounding built natural environment. Applicant Response The existing land forms, vegetation and structures on the Smith Property, along with the distance from other uses will provide adequate screening of the proposed facility. (b) Design, materials and colors of antennas and their support structures, shall be compatible with the surrounding environment, and monopole support structures shall taper from the base to the tip. Applicant Response The design, materials and colors of the antennas and their support structure shall be consistent, so as to blend in with the surrounding environment and the monopole structure proposed tapers from base to tip, to be as minimally visually obtrusive as possible. (c) It is consistent with existing communication facilities on the same site. Applicant response No other communication sites exist at this location. V SUGGESTED FINDINGS 1.) That proper public notice was provided as required for the hearing before the Board of County Commissioners; 2.) That the hearing before the Board of County Commissioners was extensive and complete and that all interested parties were heard at that meeting; 3.) The Application is in conformance with Garfield County Zoning Resolution of 1978, as amended; 4.) That for the above stated and other reason, the proposed Special Use Permit is in the best interest of the health, safety and welfare of the citizens of Garfield County; VI STAFF RECOMMENDATION Staff recommends approval of the proposed Special Use Permit allowing a "Communication Facility" on a property owned by POW Inc. with the following conditions: 1) That all representations made by the Applicant in the application and as testimony in the public hearing before the Board of County Commissioners shall be conditions of approval, unless specifically altered by the Board of County Commissioners; -4- BOCC 04/14/2008 CR 2) The operation of this facility shall be done in accordance with all applicable Federal, State and Local regulations governing the operation of this type of facility; 3) The communication facility shall be available for future co -location and the denial of a requested co -location shall be based on technical reasons, not on competitive interests; - 5 - March 11, 2008 Mr. Craig Richardson Garfield County Building and Planning Department 108 8th street, Site 401 Glenwood Springs, CO 81601 Dear Mr. Richardson: EXHIBIT 1 F Garfield County Regional Airport In reviewing, the enclosed special use permit for property located in New Castle and owned by William & Eunice Smith the Airport has no objections to this tower as the FAA Part 77 airspace surface starts at 475' above this location.
