Dear Mr. Morganfield;
Garfield County is in receipt of your request to amend the approvals for the Rifle Gas
Plant facility located in parts of Sections 12 and 13, Township 6 South, Range 94 West,
west of the City of Rifle on Parcel Number 2175-124-00-165.
Consideration of an Amendment of a Special Use Permit must first determine whether
there is 'substantial Change' to the original approval, pursuant to the definition of
Substantial Change contained within Article 16: Definitions. Unified Land Use
Resolution of 2008, as amended (ULUR). lf the application does not meet the criteria
for a determination of Substantial Change the Director has the authority to approve your
application.
A decision is hereby issued that the proposed amendment does not constitute a
substantial modification therefore your request is hereby approved, subject to all prior
conditions of approval, specifically allowing the following changes/additions:
1. lnstallation of a skid-mounted Sulfur Trap which shall be located consistent with
the submitted site plan entitled "Rifle Gas Plant Site Plan", Drawing #201 by
Public Service GomPanY of Colorado;
2. Construction of access ramps with handrails and ladder cages on existing bulk
storage tanks.
The Director decision is not final until such time as notice requirements have been
satisfied pursuant to Section 4-107 A.6. which includes notice to the Board of County
Commissioners and adjacent property owners. This notice will be sent out and a 14-
day review period shall commence. lf no request for reconsideration is received within
that period the decision shall become final and a Land Use Change Permit recorded'

We will keep you informed regarding the notice period. Please be aware that
construction cannot commence until such time as a recorded Land Use Change Permit
is provided to you.
Feel free to contact our office if you have any questions regarding this process. Notice
will be mailed to adjacent property owners and provided to the Board of County
commissioners today with expiration of the 14-day review on May 29, 2012.
