Request for a Mobile Home Special Use
Permit for the temporary placement
of a Mobile Home.

The site is approximately 2 miles North-
west of Rifle off County Road 245.
The site is approximately 5.38 acres in
size and lies on the South side of
County Road 245. It sits directly
across the County Road from the
main entrance to the Elk Creek
Subdivision. The Elk Creek Subdivision
well and pump house sit on the far
Southwestern portion of the lot.

WATER: The Town of New Castle will supply
water to the site. (See page 34 .)
SEWER: The applicant proposes a septic system.
ACCESS: The existing access is directly off
County Road 245.
ZONING: The site is zoned A/R/RD.
I. RELATIONSHIP TO THE COMPREHENSIVE PLAN:
The site lies within district 2b of the Comprehensive Plan. This area has
central water with individual sewage treatment and moderate environmental constraints.
II. MAJOR ISSUES AND CONCERNS:
A. Review agency comments:
1. The City of New Castle has no objection to the mobile home as a temporary
use of the lot.
2. The Elk Creek Subdivision Homeowners Association has expressed a concern
regarding the actual installation and removal of the mobile home. The
4" water main that serves the Elk Creek Subdivision is shallowly buried,
lying parallel to the existing driveway. The Association's concern
is that the pipe could easily be damaged during the installation and
removal of the mobile home if the existing drive is used. The Association
otherwise has no objection to the property being used for a temporary
mobile home site.
B. Staff comments:
The County Environmental Health Officer stated that the 5 acre parcel has
suitable soils for a septic system and that any septic approved on the lot
would be at least 100' from the water well site.
III. RECOMMENDATIONS:
The staff recommends approval with the following conditions:
A. The applicants must comply with all county building and septic permit regulations.
B. The sanitation permit must be obtained at the same time the Special Use Permit
is issued and the septic system must be installed within 45 days.
C. The water supply system must be available at the time of the issuance of the
building permit.
D. Skirting around the mobile home must be securely in place within 60 days after
placement of the mobile home.

E. No permits for other temporary additions or buildings shall be issued, other
than for a conventional stick -built home.
F. The Special Use Permit shall expire one year after the date of issuance.

Dear Mr. Dawson:
In response to your question regarding the 5.38 acre land
parcel south of Elk Creek Subdivision, be advised the
minimum horizontal distance from any well and an individual
sewage disposal system leach field serving a three bedroom
single family dwelling is one hundred feet, provided suitable
soil is available.
As a general policy, this office recommends a distance greater
than one hundred feet when a public water supply well is in the
proximity of a septic system. This is recommended as an extra
margin of safety only.

Upon the request of Mack Burchett, the County Veterans Service Officer, Chairman Drinkhouse and
Commissioner Cerise signed the County Veterans Service officer's Monthly Report and Certification of
Pay.
Upon previous approval, C a.rnan Drinkhouse signed a resolution concerned with the adoption of the
County Road maps for the year 1983 ($83-37).
County Attorney Earl Rhodes informed the Board that the County had purchased a right-of-way along the
northside of the Stagecoach Inn property for access into the Ranch at the Roaring Fork.
After a brief discussion, Commissioner Cerise moved that the Board approve free dumping at the County
Landfill for the Rifle Chamber of Commerce during April 4th through the 9th, which was designated as
Rifle Clean-up week. Com. Drinkhouse stepped down as Chairmen to second the motion; carried.
County Manager Stan Broome reported that an elected officials luncheon meeting was set up for Monday,
March 14, 1983, at the Holiday Inn.
There was a discussion with the Communications Board regarding the possibility of moving a dispatcher
to the Parachute Comm Center on a temporary basis for 90 days. Vern Soucie, County Sheriff, and. Bob
Halbert were present. The two main topics of discussion were to make the "911" telephone system work
and to get the coverage for the sheriff within the dead areas of the west end of the County. At the
time of setting the 1983 County Budget, Parachute requested $10,000 in supplemental funding for the
Parachute Comm Center, but the Board rejected this request. After speaking with Steve Rhoads,
Parachute Police Chief, Mr. Soucie felt that there were no problems with combining the two Comm
Centers. Mr. Halbert would contact the dispatchers to fill the position in Parachute and would then
report back to the Board.
Mark Bean, of the Planning Dept., presented a referral to the Planning Commission regarding Preliminary
plan for River Bluff Filing 45, located 1 mile south of Parachute in Battlement Mesa, Inc. Kari Stauss
was present and pointed out the location of the water pumping station site. The purpose was to
subdivide and transfer a 0.27 acre pump station site to the Battlement Mesa Water and Sanitation
District. There were no comments from the Board, so Commissioner Cerise moved that the Preliminary
plan for River Bluff Filing 45, applicant Battlement Mesa, Inc., be referred to the Planning Commission
for review. Com. Drinkhouse stepped down as Chairmen to second the motion; carried.
Upon the request of the County Attorney, Commissioner Cerise moved that the Chairmen be authorized to
sign the following resolutions:
-a resolution (483-45) concerned with a grant of a subdivision sketch plan exemption to Iron
Mountain Investments;
- a rennl ution (483-44) concerned with the cancellation of tax schedule No. 040219 in the year 1982
for Donald M. and Dorothy L. Marshall;
-a resolution (483-46) concerned with the approval of an application of the Lazier -Sills
Partnership for modification of the Canyon Creek Planned Unit Development Plan;
- a resolution (483-43) concerned with the approval of the Preliminary Plan of the Canyon Creek
Planned Unit Development;
-a resolution (483-39) concerned with the approval of an application of William E. Foster, Warren
E. Gardner, John G. Jebsen, Charles V. Woodard, and Wendy' Lafaye Bishop, for modification of the
Parachute Industrial Park Planned Unit Development and approval of a Master Plan therefore.
Commissioner Drinkhouse stepped dam as Chairman to second the motion; carried.
Upon the request of Mark Bean, Senior Planner, Commissioner Cerise moved that the Board refer the final
plat of the Iron Mountain Condominiums to the Planning Commission for review. Com. Drinkhouse stepped
down as Chairman to second the motion; carried.
Attorney Rhodes discussed a letter which he sent to John Savage regarding the Coloroso lawsuit.
Attorney Rhodes had filed a brief in support of the County's motion to dismiss and submitted a copy to
the Board.
After examination of the Pollard zoning violation, Attorney Rhodes sent a demand letter to the Pollards
and the landowner. If there was no response, Attorney Rhodes recommended that the Board proceed with
anne type of suit with regards to the illegal mobile here trailer on the property.
Attorney Rhodes discussed a visit with Bill Thompson, Chief Building Inspector, to Beverly Johnston's
mobile home park of approximately 18 units. Attorney Rhodes discussed potential solutions to the
lawsuit.
After a meeting with Lave Kunkel, of Eagle Computer Systems, it was decided that the County continue
with the present Systems Support Agreement at the same rate through June 1, 1983. The Board agreed
with this decision and authorized the County Attorney to write up the agreement.
The next item on the agenda was a Public Hearing regarding a Special Use Permit for a mobile home,
located south of Elk Creek Subdivision off County Road 245; applied for by Johnny Ross and Retha
Walter. County Attorney Rhodes read the legal procedure for the Public Hearing. The Chairmen swore in
Cindy Houten, of the Planning Dept., Johnny Ross, of Carbondale, and Retha Walter, also of Carbondale.
Ms. Houben marked the exhibits as follows: A) Application; B) Proof of Publication - Glenwood Post; C)
Certified Return Mail Receipts to the adjacent landowners; D) Staff Comments; E) Letter from Walter
Huber, an adjacent landowner. The Chairman accepted the exhibits as evidence.
Ms. Houton presented the project information. The site was approximately 5.38 acres in size and fell
on the South side of County Road 245. The property sat directly across the County Road from the main
entrance to the Elk Creek Subdivision, which the well and pump house sit on the far Southwestern
portion of the lot: -:.The Town of New Castle would supply water to the site and the applicant proposed a
septic system. The existing access was directly off County Road 245 and the site was zoned A/R/RD.
The site fell within District 2b of the Comprehensive Plan; the area had central water with individual
sewage treatment and moderate environmental constraints.
Ms. Houten indicated that the time was unknown when the 5 acre parcel was created.

Del Dawson, of New Castle, was sworn in by the Chairman. Mr. Dawson stated that the property showed up
on the tax rolls in 1977 and prior to that the property was conveyed frau the Development Corporation
to Henry Deeds to his son. The property was transferred at least 3 times without exemption or
s>htivision. Mr. Rawson believed that the last conveyance took place in 1976 and the property was
shown on the tax rolls as a separate parcel in 1977. He indicated that he could not find a deed to
identify that specific tract at the Assessor's office.
After more discussion, County Attorney Earl Rhodes advised the Board not to proceed further until there
was some demonstration of a deed which identified this tract and further until the Board was satisfied
that it was a legal split or a preexisting property. Since the application was incomplete, the Board
did not take any action on the matter.
The next item on the agenda was a decision regarding ll Preliminary Plans, all located within the
Battlement Mesa POD; applied for by Battlement Mesa, Inc. Karl Stauss, of BMD, was present and Mark
Bean, Senior Planner, presented the project information. The applicant agreed to deal with all of the
conditions and there were no major problems. Mr. Stauss pointed out the sites ona map.
There were no convents from the Board, so Commissioner Cerise moved that the Beard approve the
following 11 Preliminary Plans as applied for by Battlement Mesa, Inc. with their respective conditions
as follows:
1) Biver Bluff Subdivision Filing 2 - request for a well field site.
Conditions:
a) That the powerline easement conflicts be resolved prior to submittal of and shown on the
Final Plat; -
b) The developer shall submit a letter detailing the timing of the conveyance of the water
and sewage facilities to the Battlement Mesa Water and Sanitation District prior to submittal of final
plat.
2) Biver Bluff Si,trlivicion Filing 3 - request for a clear well and pump station site.
Conditions:
a) That the powerline easement conflicts be resolved prior to sutmittal of and be shown on
the final plat;
b) The developer shall submit a letter detailing the time of the conveyance of the water and
sewage facilities to the Battlement Mesa Water and Sanitation District prior to final plat submittal.
3) River_ Bluff Subdivision. Filing 4 - request for a sewer lift.
Condition:
a) The developer shall submit a letter detailing the timing of the conveyance of the water
and sewage facilities to the Battlement Mesa Water and Sanitation District prior to final plat
submittal.
4) Biver Bluff Subdivision. filing 6 - request for a ball field.
Condition:
a) The developer should identify the points for vehicular access and indicate them on the
final plat.
5) giver Bluff Subdivision. Filing 8 - request for a church site.
Conditions:
a)That the recouisendation of the Bookcliff Soil Conservation District be followed.
b) The Developer note access point on the northern portion of the parcel to eliminate
potential line of sight problems with any access points in the southern portion.
6) Biver Bluff Subdivision Filing 9 - request for a church site.
Conditions:
a) That the powerline easement conflicts be resolved prior to submittal of and shown on the
Final Plat.
b) That the recommendation of the Bookcliff Soil Conservation District be followed.
7) Jack's Pocket Village. Filing 1 - request for public safety building.
Approval with no conditions.
8) Jack's Pocket village. Filing 2 - request for pump station site.
Conditions:
a) That the powerline easement conflicts be resolved prior to submittal of and shown on the
Final Plat.
b) The developer shall submit a letter detailing the timing of the conveyance of the water
and sanitation facilities to the Battlement Mesa Water and Sanitation District.
9) .Jack's Pork Vintage. Fili_�e 3 - request for a water tank site.
Condition:
a) The developer shall submit a letter detailing the timing of the conveyance of the water
and sewage facilities to the Battlement Mesa Water and Sanitation District, prior to final plat
submittal.
10) Mack's Pocket Village Filing 4 - request for a church site.
Condition:
a) That the recommendation of the Bookcliff Soil Conservation District be followed.
11) The Hiyhjands, Filing . - request for a water storage tank.
Conditions:
a) That the powerline easement conflicts be resolved prior to submittal of and shown on the
Final Plat.
b) That the recomendation of the Bookcliff Soil Conservation District be followed.
. c) The developer shall submit a letter detailing the timing of the conveyance of the water
and sewage facilities to the Battlement Mesa Water and Sanitataion District prior to final plat 1
submittal.

Upon the request of the county Attorney and the County Clerk, Commissioner Cerise moved that the
Chairmen be authorized to .sign the renewal liquor license applications for Hop's Pit Bar -B -Q and
Huesnart. Can. Drinkhouse stepped down as Chariman to second the notion; carried.
There was a discussion with the County Attorney regarding a letter received from Jack Pepper, of the
Boettcher Canpany, stating the status of the County's 1981 Single Family Mortgage Bond issue.

Attorney Rhodes discussed a question regarding the representation of the County Coroner by either the
County Attorney or the District Attorney's Office. The Board decided to offer the services of the
County Attorney to the Coroner, if he would desire it.
