A tract of land located in a portion of Section

one (1) mile north of Parachute on the

I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The subject tract is located in District D - Rural Areas/Moderate Environmental Constraints,
as designated by the Garfield County Comprehensive Plan's Management Districts Map
(1981; 1984 Plans).
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The subject tract is approximately 4.7 acres in size, located
approximately one (1) mile north of Parachute on the southwest side of County Road
215. The tract slopes gently toward Parachute Creek and is largely ee of
improvements and vegetated by various grasses. See vicinity map, page
Adjacent Land Uses: There is a mix of land uses adjacent to and in the vicinity of the
subject tract, including agricultural, industrial and residential.

C. Proposal: The applicant, Rulison Gathering Company (RGC) proposes the
installation of two (2) natural gas compressors and a processing facility that would
connect its existing gathering system with the Colorado Interstate Gas (CIG) mainline
interconnect point. The processing facility is intended to strip liquids from the gas
stream. Currently, RGC sends the natural gas it collects to the Questar/Public Service
facility in Rifle. See the site plan, page 7 .
111. MAJOR ISSUES AND CONCERNS
A. Ownership: The tract is owned by Unocal, who leases a portion of its property, in
this area, to CIG. CIG has assigned a portion of this lease to RGC, including use of
a common access easement to County Road 215, and a private ac ss across
additional Unocal property. See letters, agreements, and maps, pages ' / Ti .
B. Zoning: The site is within the R/L (Resource Lands - Gentle Slope/Lower Valley
Floor) zone district, which does allow the requested land use, upon the issuance of
a Special Use Permit. The lands subject to the surface lease and assignment are in
excess of the required setbacks within the zone district and no amendments to the
setbacks are proposed.
C. Access: According to the various agreements, access to County Road 215 exists by
virtue of a shared access easement, 50 feet in width, that intersects with the county
road approximately 250 feet east of the proposed facility. Staff has visited the site
and contemplates no site distance problems associated with this access. Apparently,
the applicant has the right to use an additional, private access west of the site;
however, staff has not investigated the viability of this access.
D. Water and Sewer: At this time, no water or sewer will be used for this project;
however, the applicant does have plans to equip a shop/office building with a
bathroom, sometime in the future. Staff suggests this intent be reflected in the Special
Use Permit, with a provision that when the shop/office is proposed to be so equipped,
the application for the building permit shall be accompanied by a copy of an approved
well permit. At that time, percolation tests should be conducted to determine specific
ISDS needs on the site.
E. State and Local Health Standards/Permits: An application for an Air Pollution
Emission Permit has been submitted to the Colorado Department of Public Health and
Environment, which would allow up to 12 emission points on the site. See Permit
application, pages / 3 • /4 . To date, the permit has not been issued by the State,
and staff recommends the permit be issued prior to issuance of the Special Use
Permit.
F Drainage/Soils: The site does not exist in a designated flood zone, nor are there any
streams or drainages on the site. The Soil Conservation Service identifies the soils on
the tract as being Heldt clay loam and Nihill channery loam. The Heldt soil is

considered to have a severe shrink -swell potential and severe constraints to use of
ISD systems. Staff recommends the design and placement of all structures and
facilities occur with respect to the soil limitations and, additionally, that the applicant
monitor the site and take prudent steps to mitigate erosion and off-site sedimentation
from the tract. All construction shall occur in a manner that minimizes soil
disturbances.
G. Fire Protection: The facility would be equipped with a natural gas flare that would
be used to burn waste gas. The application does address general fire control measures,
which wo ld likely control or contain a fire at the site. See fire control measures,
page . Given the nature of the facility, staff recommends the applicant
submit this information to the County Office of Emergency Management and the
appropriate fire district.
H. Noise: There would be two (2) compressor units placed on the site, each consisting
of a Caterpillar 3516 TALE natural gas-fired engine and Ariel JGK2 compressor.
Definitive noise assessments for the proposed compressor units have not been
calculated; however, the compressors would be housed within a permanent structure
and be equipped with hospital grade mufflers. The application states that estimated
sound power levels (SPL) will not exceed 60 decibels at the property lines. Although
this information does not directly state that noise would not be a factor, staffs
experience with these types of facilities suggests that noise generally does not impact
the surrounding area. The Board may want to guarantee staffs assumption by
requiring a noise study be conducted, prior to final approval.
Traffic: The applicant expects traffic in the immediate area to increase during the
construction of the facility, but would return to levels consistent with pre -construction
traffic levels. The applicant estimates that five (5) tanker trucks would visit the site,
per day, to remove the natural gas liquids from the facilities. County Road 215 is one
of the more substantial roads in the County and should be capable of handling the
additional traffic that would be generated by this facility.
J. Wildlife Considerations: Impacts caused to wildlife from the construction and
operation of this site have not been quantified and are therefore, unknown. The
application states that impacts will be minimal as no migration routes would be
changed or obstructed. Upon completion of construction at the site, the facility
would be completely fenced.
Vibration: The operation of the compressor would likely cause vibration on and near
the site. According to regulations, the applicant shall be required to construct a
foundation that will make vibrations imperceptible, except by instruments, at any point
outside of the property boundary line where the unit will be located.

IV. SUGGESTED FINDINGS
1 That proper posting and public notice was provided as required for the meeting before
the Board of County Commissioners.
2. That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting.
3. That the application is in compliance with the Garfield County Zoning Resolution of
1978, as amended.
4. That for the above stated and other reasons, the proposed exemption is in the best
interest of the health, safety, morals, convenience, order, prosperity and welfare of
the citizens of Garfield County.
V. RECOMMENDATION
Staff recommends APPROVAL of the application, subject to the following conditions:
1. That all representations of the applicant, either within the application or stated at the
meeting before the Board of County Commissioners, shall be considered conditions
of approval.
2. Prior to the operation of the facilities, all air pollution emission permits) shall be
issued and operation of the facilities shall be consistent with the conditions of
approval of such permit(s). Upon receipt of the permit(s), copies shall be submitted
to the Planning Department for review and inclusion within the file.
3. The amount of noise to be generated by the operation of this facility be consistent
with the predicted levels. If noise complaints are received by the County, the Board
of County Commissioners shall have the authority to require the applicant or operator
of the facility to conduct a noise assessment and develop strategies to reduce the
amount of noise emanating from the applicant's property.
4. The construction of the foundation for the engine/compressor unit and all other
facilities shall be done in a manner to prevent perceptible vibration from occurring
outside of the property boundary. Any foundations shall be constructed with respect
to the shrink -swell and erosive potential of the soil and construction shall strive to
minimize soil disturbance.
5. Reclamation and revegetation of the site shall be required when the operator ceases
use of the facility, in a manner that returns the site to its original, preconstruction
state.

6. The applicant shall file an emergency plan with the appropriate fire protection district
and the Garfield County Department of Emergency Management, prior to the
issuance of the Special Use Permit.
7. Any out-of-state vehicles used in the construction, operation or maintenance of the
facility shall be registered or apportioned in the State of Colorado.
8. The Special Use Permit shall be issued upon demonstration of satisfactory compliance
of all listed conditions of approval.
The applicant/operator of the facility shall control noxious weeds on the site.
10. The allowance for a bathroom and/or toilet facilities shall be allowed within the
proposed shop/office building so long as the applicant demonstrates a legal water
right at the time of building permit application to the County Building Department.
Such application shall clearly indicate the bathroom facilities. The shop/office may
be permitted without bathroom facilities.
11. The shop/office shall not be used for housing employees or agents of the applicant or
operator of the facility, either temporarily or permanently.

Colorado Interstate Gas Company (CIG) is the holder of an option to lease an additional 7.282
acres of land from Union Oil Company of California (Unocal) located in the North Half of Section
2, Township 7 South, Range 96 West, Garfield County, Colorado. CIG plans to exercise this
option and plans, with the consent of Unocal, subject to the other provisions of this letter, to
assign a portion of this site, consisting of approximately 4.5 acres to Rulison for the purpose of
installing a plant and compressor facility_ This assignment will cover the portion of the site lying
southeast of the barbed wire fence roughly splitting the overall site in half In conjunction with
this assignment, CIG will also assign Rulison use of its approved access off of County Road 215,
as well as use of the existing temporary access off of Unocal's private road.
The foregoing plans are subject to CIG and Rulison completing a definitive agreement with such
agreement acceptable to Unocal, and management approval. Such assignment, if made, will
occur upon receipt by CIG of a survey of the portion of the site to be assigned and of the
proposed revision in the access road alignment.

FIRE CONTROL MEASURES
General
• All project personnel are instructed as to:
Fire danger for the day
Location of fire control equipment
Proper operation of fire control equipment
Emergency procedures and how to call for additional resources
Welding Operations
• A minimum of one person is dedicated to act as a fire watch during welding operations
with a fire extinguisher at hand.
• Welding shields are used during grinding operation to prevent sparks from leaving the
work areas and igniting vegetation.
• Water trucks are used to wet down ground and nearby vegetation, as conditions dictate.
• At the close of each day, welding personnel inspect the area of welding activities for any
smoldering debris and any conditions conductive to fires.

• In the event of a fire, all personnel and appropriate equipment on site will be committed
to its containment and control.
The BLM and appropriate fire authorities will be notified immediately.
Direction of fire control efforts will be transferred to appropriate fire fighting agency
personnel upon their arrival on site.
